antonio elena rodriguez was 16 when he was killed with a bullet through the head by the united states border patrol. nine more shots went into body, as he lay on the ground in his hometown, nogales mexico. the bullets fired from the top of this cliff in arizona traveled through an international boundary, and into a legal vacuum. the agent has never been named.

immigration laws, our border patrol officers who patrol the border; customs and immigration service which evaluate and approve or disapprove people who apply for admission to the united states, and agency after agency. many of these are complex departments. i've watched it and i do not believe it has been brought together to the degree it ought to be, and it hasn't had the kind of strong leadership it needs to have to be an effective producer for the american people. in addition to that, we've got the difficulty that this administration has basically told the immigration component of homeland security, one of its largest component parts, that they shouldn't do their job. they have been blocked and instructed not to enforce law to a degree that professor turley said it represents an unacceptable alteration of the madisonian of separation of powers. in other words, the president is charged with the duty to enforce law, to see that the laws of the united states are faithfully enforced. he's not given the power to flatly direct his officers not to enforce laws of the united states congress. and so, mr. johnson i'm sure has many abilities. he's apparently a wall street lawyer, b

customs, i.c.e., the border patrol, the customs and immigration service that evaluates requests for admission to the united states, those are all in disarray. and this administration's goal is to further undermine their ability to be effective, because they don't really want vigorous enforcement in these agencies. and that's one reason their moral is so bad. now, i.c.e. officers of the united states of america filed a lawsuit in court in texas, and they said their supervisors were instructing them not to fulfill their sworn duty which was to enforce the laws of the united states. and the lawsuit wept on for some time and eventually got dismissed on technical grounds, but the judge found that the survivors of these agencies, the top people in these agencies could not direct people not to enforce the law, which is what they are doing. we can go into that in some depth. now, i am going to do it. if i have the time, i'm going to do it this afternoon, i'm going to do it tonight and i am going to document for the last four or five years the systematic actions by the president of the united states and his homeland secur
