tom rains, former state prosecutor, now director of colorado district attorney's counsel joins us from denverbreak it down for us. while this is legal, to a degree, it still has to be, the law has to be enforced. use of pot still has to be enforced. how difficult will it be to do that? >> you know, fredricka, there are numerous challenges, whether you talk about driving or just possession in general. folks really need to understand their rights. obviously under the current law now, an individual can have one ounce of marijuana in their possession. if they have more than that, they're committing an offense. it is a low level offense at the beginning but can work up to a felony if they have way too much, over 12 ounces. as far as driving, your report mentioned driving issues. we're very concerned about possible increase in folks driving under the influence of marijuana. >> so you're concerned about that. does that mean that law enforcement is equipped, prepared, to look for the signs, know when there's probable cause to stop someone. >> that's a great question. it is difficult to know when you'

he joins us from denver. it is good to talk to you. got to tell you, i haven't heard your perspective or the perspective from someone who has spent so much time with law enforcement on this subject. what does legalizing marijuana in your state, what does it mean to you? >> quite frankly, it's an experiment, for one thing, as to what is going to happen when you taktake a drug and legalize it. on one hand one group says nothing will happen. it's a good thing. on the other hand people say it will be devastating to the state of colorado with the impact. in one way we have a lab for everyone to look at and see what is the truth about the legalization debate. it will end the argument once and for all. it will take two to six years to get all the data, but no longer will you be listening to rhetoric. you'll be looking at facts. >> that will be good to get to fact and go back and forth on the rhetoric. you say it's an experiment. you're right about that. there is no denying that. but don't you think it's an experiment that has all the possibil

jenna: let's bring in our legal panel joining us from denver and former federal prosecutor.i am sure you are familiar with this case, has been in the area. what did you think this morning? >> being prosecuted by the district of new york u.s. attorney's office. 64 minutes legendary back in december of 1978, $5 million in cash, $875,000 in jewels taken, and as you guys have been saying, dormant for all this time. other have returned racketeeri racketeering, the main defendant listed first and they charge him flat out with being involved in a conspiracy as well as the murder whose remains were turned up in what was then his daughter's house but previously his house. jenna: am so curious what you think of this working on the defense side. what are some of the challenges at this time not only with arresting, getting enough evidence to arrest somebody but now having to prosecute him. >> we see the indictment has come out. having a clear and convincing evidence to get the jury to convict beyond a reasonable doubt is a whole another challenge. people's memories are not as good, the
