where these programs are done correctly, when they do these programs, the mart like in florida, for example where they useecifically for counter terrorism immigrations not to check on somebody's legal status. they go out and have meetings with the stake holder communities to explain how to do this and actually in florida where they first instituted this program in north florida. they got enormous support from the immigration community because they explained what they're doing. a lot of times what they're doing is combatting the crimes that victimize immigrants both legal and illegal. juan: this is a law that the hispanic caucus wants undone. what you just heard was it's an opportunity for the police to build knowledge about how to develop rips with folks and sometimes even to prevent crimes against immigrants. >> well, you know what? i see this every day. this is my job. every day i deal with clients who are in the police station for half an hour, 45 minutes. a local police officer says um, something might be wrong with this person's status. they call immigration on them. that's how this program is workin

they're getting ready to start more live testimony in this courtroom in miami, florida. it gives us a chance to check in with beth karas who is covering the trial for us live. first question to you, originally the plan was to get started about an hour ago. this morning apparently that didn't happen. any idea why? >> yes. the assistant state attorney monica gordo informed the court that their next witness sam brown isn't around. they're out looking for him. he does have some health problems. they do think it is health related rather than another witness being recalcitrant or threatened. and he witnessed parts of the shooting and says there were actually three people shooting. so hopefully they have until 2:00 to locate mr. brown and to bring him to court. a police officer is about to take the stand. they really need mr. brown, though, to go forward with the rest of their witnesses. he sets the scene. this next officer will be jerry marquez who arrested damon darling on july 20th. >> thank you so much for getting us started here. you'll stand by. beth continuing her coverage. we're in

there are places in florida dieted for this kind of fraud where they use false i.d.'s and generate billions in incorrect billings to jilt the taxpayer. >> take a step back for a second and take us through what's going on in congress and in the senate. particularly in the senate finance committee proposal that this was raised. tell us who brought it up and what the pushback was that made it look like there won't be an identification requirement. >> a proposal by senator charles graphly of iowa. he's the ranking republican on the committee and he basically said we should have photo i.d. standards in place to prevent fraud. senator jeff binghampton, a democrat from new mexico said i don't think there's a sense of fraud. i think there's a solution without a problem that's behind it. it went down 13 votes to 10 votes. that indicates if it reaches the floor of the senate it's going to be voted down there, too. you have a complete indifference to the fraud problem in america. they said medicare and medicaid is great programs because they only have overhead costs of 2 or 3% c
