how can we talk about ordinary injustice without talking about the inherent problem us plea- bargain is and how the use of plea bargains undermines the truth finding process of the justice system? >> i gave a talk at n.y.u. to a small group of criminal justice law professors, and one professor stood up and said, why didn't you recommend your conclusion that we get rid of clean bargaining and that we have trials for everybody. clearly, these plea-bargain are inherently coercive, and my answer is if you got rid of a plea-bargain in, that is like saying 50% of marriages end in divorce. we should get rid of the institution of marriage. it is so much a part of our system that if we turned it on its head, first of all, people say the system would collapse, but it is an inherent part of our society and judicial system, so given the system we have worked with, i believe a plea is not inherently coercive. a plea bargain can be a good deal if individual circumstances are looked at, and public defenders talk to their clients. they do investigations. they negotiate with the prosecutor, and if the

s attorney's general's office used breath machines to get guilty pleas in dwi cases. paul wagner, what's the latest? >> we've uncovered documents showing prosecutors in the d.c. attorney general's office used a breath machine that had been decertified by the chief toxicologist to win convictions in at least two cases. in one of those cases a man was sentenced to serve six consecutive weekends in jail. on july 7th, 2010, d.c. police arrested a man in the district on success suspicion of dwi -- on success suspicion of dwi. he was tested on an intoximeter. court records show he pled guilty on september 70 of the same year, but according to the -- 7th of the same year, but according to the officer of the chief medical examiner that machine was not approved for use over a three month period including the date of this man's arrest. in another case a 19-year-old girl was arrested may 9th in 2010 tested on the same machine. a separate document listing the same serial number shows the chief toxicologist said the results should not be used for a three-month period which includes

us they're praying for his recovery. they're hoping the two attackers will be caught. last night los angeles police made a similar plea to the public. >> help us get those brutal cowardly predators off the street and bring them to justice. >> los angeles police say the attack was unprovoked and that stow and his friends tried to ignore the hecklers before they were jumped from behind. >>> the sheriff's department tells us this morning there have been no major incidents overnight in richmond, but they are still worried it could be a violent weekend. investigators are bracing for retaliation attacks. after a week of suspected gang- related shootings in the richmond area. police believe the killings were probably provoked by last weekend's killing of a richmond gang member in san francisco. richmond police believe the shooting death of a 15-year-old girl was accidental. she was with her 16-year-old boyfriend inside a house on south 8th street on thursday. they were playing with a gun when it went off. police say it's unclear who was holding the gun at the time. she was a student at richmond high school. grief counselors
