you being the number one law enforcement official in the judiciary, in the justice system in utah, i saying that. we've lost sight of how we have, you know, rules, regulations and laws that guide things in this country. and my purpose for having you on here, tonight, is that is there really legal merit for states to challenge a federal law? i mean, doesn't federal law supersede state law? what do you think? >> ed, it does. they can't just pass any law and say because we're the feds then we supersede any state law. they can only pass laws granted to them within the jurisdiction granted to them in the constitution. argument in this case there's no specific grant in the constitution to do that individual mandate. now, i know they will argue, the feds will argue vigorously the expansion of the commerce clause gives them this authority. we don't believe so. we believe, therefore, under the tenth amendment those rights are reserved to the states and insurance, in particular, like auto insurance. health care, medical insurance has been left to the states. traditionally speaking this is the

i'm so encouraged by what they're doing in utah. in 2002, utah's governor challenged the highest education committee through the engineering initiative to double and then triple the number of students that they graduate. each year since the legislators allocated funds to support the engineering education. these funds have been matched first by the university and then by corporate dough neighses and then by the federal government. utah's governor also prioritized qut by the college of engining. while the utah science, technology, and research initiative provides salaries and start-up packages. faculty members grew by 46% since the initiative began. tenure-track faculty members grew by 46% since utah's engineering initiative began frvment 2002 to 2009, engineering research, research expenditures went from 25 million to $56.9 million. the number of engineering degrees granded by the university of utah rose 76% in the last decade. and roughly 80% of those undergraduates accept engineerinengineering jobs righn utah. what is more, the col

utah has more small businesses on average than most states do. and in my district, almost 98% of those according to the i.r.s. will have a bottom line that is $250,000. the taxes that are imposed are also imposed to the business community. one of the reasons why the state of utah, when they looked to reform in the state, tried to come up with a policy that would give a consistent number to small business so they knew how to plan for what the health care costs would be. and then come up with a defined contribution level they could give their employees, who could go to the exchange and fits into what they need. that consistency is extremely important. it's very difficult for small business to provide health care for their employees when they don't know the escalating, almost roller-coaster cost will be to them. they can't plan. so they basically don't do it at all. if we add a tax to them at this stage of the game, that means we are making it even harder for the business community to recover to provide jobs, to grow our community and get people wor
