so, kimberly mentioned by tremendous vails with free speech at dartmouth. i just came from a radio interview with laura ingram who was on the board at dartmouth, so i had some good teachers and mentors when i was a young college student at dartmouth. and those are some of my best friends today. and we're still fighting the same battles, just kind of disappointing. i think the stakes are higher now than they were at dartmouth so to set the stage here and i so to set the stage here and i hope i don't bore you with dry, constitutional law, but, i'm sure most of you know that the first amendment is part of the bill of rights and it's sort of the cornerstone of our concept and it's one of the really unique things about the american democratic thoughts is that we have this concept of free speech. even other democracies don't have free speech rights to the extent that we do. and freedom of thought and speech and freedom of association are natural rights. those are what the founders of our country believe to be rights that la god-given, but not given by the governm

this is a promise that i think he made in a vailed way on tuesday, and he's following through on that also signaling to law enforcement people that if you violate someone's rights or if you run afoul of the courts, i may intervene ahead of time and pardon you before you have even been sentenced, and i think that's a dangerous thing to do. i think one of the things that you are trying to point out is there are people in the president's own party who are objecting to what he's done and there are officials who are high ranking officials in arizona. that's remarkable. it is not remarkable that an official who's in the president's party supports him. that's the norm. i think what is important to note is when there are exceptions. that's when the difference between man bites dog and the dog biting the man. you are pointing out something noteworthy. so the president here is really on, i think, new territory. we've not had a president who has been so willing to preemptively, before someone's been sentenced, issue a pardon. and i think the other thing to consider is what signal does this send

the judges rejected the application of sweats and -- which were two cases where the naacp has per vailed, it did include a finding of facts indicating that segregation of schools was harmful, which was incredib incredible. for the naacp it's precisely the issue that was so controversy y'all before the supreme court. so it was a decision that on the merits was adverse to naacp but to that finding of fact there was a nugget in there that was helpful. >> so jeff rosen could you explain how these cases made it to the supreme court. were the jays looking for a case to decide this? what was the process where these cases were psychologicaled and the courts agreed to hear them? >> i don't know that the justices were looking for it but there was a disagreement among the lower courts which increases the possibility the court will take the case. it was very important that the president had both the trumanize enhowever administration had filed briefs. so, i think to a certain extent the court felt it couldn't avoid it. but then something very dramatic happened. i don't know if this is the time to te

without any counter vailing authority to intervene or get in the way, we depend on the state governments to protect us in life, liberty and property. and where was the state government of virginia when the lovings needed a friend or just to be left alone? so states rights have a different face on it in these terms, projected downward rather than outward. but also, what else do i have? racial marriage is not a thing, it's a construct, it's a definition. virginia kept changing its definition. virginia's definition never was the same as georgia's or mississippi's. they always had different ones. so the laws against interracial marriage and the laws that were thrown out by the supreme court ruling in loving versus virginia were not all at peace. nor did the states ever stay true to the faith that they got it right and i'm going to stick to it that way. virginia, there was 1/8 black in the colonial period. then one quarter -- if you are one quarter black then you are black. but anything less than that you're not. the one rule of black racial identity is the 20th century intervention. virginia

so, kimberly mentioned by tremendous vails with free speech at dartmouth. i just came from a radio interview with laura ingram who was on the board at dartmouth, so i had some good teachers and mentors when i was a young college student at dartmouth. and those are some of my best friends today. and we're still fighting the same battles, just kind of disappointing. i think the stakers are higher now than they were at dartmouth so to set the stage here and i hope i don't bore you with dry, constitutional law, but, i'm sure most of you know that the first amendment is part of the bill of rights and it's sort of the cornerstone of our concept and it's one of the really unique things about the american democratic thoughts is that we have this concept of free speech. even other democracies don't have free speech rights to the extent that we do. and freedom of thought and speech and freedom of association are natural rights. those are what the founders of our country believe to be rights that la god-given, but not given by the government. they're inherent rights.
