it closed at its van ness avenue location in 2011. it was displaced due to the expansion of the california medical center. while the polk street neighborhood district hosts a number of restaurants, the relocation would not result in a net increase in the number of restaurants in the area. it should be noted be location is currently vacant, so it would not displace an existing tenant providing services to the neighborhood. in 2005, this commission -- since that time, the restaurant not begin operation. therefore, the previous conditional use is no longer valid in the new conditional use authorization would be needed. staff does receive 14 communications in support of the project. i would like to pass out one additional letter. supporters cite responsible management of the previous location of the restaurant. staff has received no communications in opposition to the project. finally, i would like to address an issue. this letter alleges that the base of the building contains an illegal dwelling unit. staff visited the area. the area is

on the van ness brt, we are preparing to launch a 30% design effort, and also for the annual submittal to the transportation administration on draft starts. that is expected to begin circulating to the public as a draft eir/eis in the early fall. we are looking forward to making sure that the detailed designs start on time. the authority and got a joint award, together with the san francisco mta, for the greatest national impact from the department of the environment, for its work on the climate action strategy. we are very honored for the award. the bayview hunters point mobility study has continued to make progress and we are currently in the process of interviewing and working on basic needs issues with the community-based organizations, we have had detailed interviews with the bayview hunters point multi-purpose center, the southeast health center, and san francisco air transit. finally, i would like to take a moment to highlight the last two things in the report. first of all, it gives me great pleasure to introduce a new member of staff, filling the principal engineer position. s

high-speed rail, the transbay terminal, the electrification of caltrain, the subway, and the van ness and geary bus projects. in addition, we need to improve taxi availability, especially during peak times and for people who live in our neighborhoods and for disabled populations. we must do everything in our power to address pedestrian injuries and fatalities. making our streets and sidewalks safer and more enjoyable for everyone is a priority. i would also like the mta to continue making bike improvements. we have seen nearly a 60% increase in the number of people riding their bikes over the past a few years, and the new director should continue the positive trend. finally, the mta should encourage adoption of electric vehicles. as you may have already heard, i myself am now writing in a wonderful chevy -- riding in a wonderful chevy volt. i hope the mta will stay focused on increasing the ev infrastructure for this city. that is quite a bit for an mta board and directed to do, and i want to share with you that as i assist in my role to review with the mta board who they will select,

there is another thing to consider when you are buying and building to the east of the van ness ave. a third map. this map depicts the area of the fire that followed the 1906 earthquake. the blue is where all the buildings were destroyed or badly damaged by the fire. as a result, the ashes from those fires remained on site. in those days, lead paint was used to paint the sides of buildings. it is a known carcinogen. it is a hazardous material. what they did was after the earthquake, they took these mounds of sand, the valencia st. hill, if you go up market street, you know how it starts to climb? imagine that was a much larger hill. they mined 26 million cubic yards of sand out of theire, and they mixed it with the debris from the fire and they used it to fill basements. so you have sand, ash, pieces of wood, brick. well, the ash is a hazardous material. you come along and used to buy a site at sixth and mission, with the understanding you will demolish the building and build a 50 story building. and you thought you were just going to dig out the sand, the film, and haul it to anothe

i wanted to let the commission know that a pending board of appeals appeal for the 2080 van ness location that was called the heights has been finally withdrawn. as you might recall back in december of 2010, we issued a warning letter to the heights. at the request of sfpd, we calendar them for this commission -- which, under -- we calendared them for this commission discussion. the permit holder filed an appeal at the board of appeals. since that time, the business has folded. there has been a new permit issued to operators at the same location. the board of appeals formally receive their withdrawal from the appellant. that thankfully is now filed. in addition, the citation appeal, the first one we have ever filed -- we did finally get an outcome on the circolo appeal. the citation was issued on february 27 by mr. bernelli for a violation of their security plan. that was appealed and heard by an and the district of law judge under the office of the comptroller on april 29. the matter was taken under advisement and the final disposition was reported to staff on may 27. and they ruled in f
