so, vaughn, you're outside the jail there. what have you seen and what is the process going to be like going forward? >> reporter: right, rudy giuliani would call this a misapplication of justice, but that is an argument that he and his own counselor have to make in most likely a fulton county courtroom. in the next nine days, rudy giuliani, donald trump, and 17 other defendants, are going to have to show up here at the fulton county jail, just down that road from the courthouse, where ultimately the indictment was handed down, just about 36 hours ago. and they're going to have to surrender to the sheriff's office here. the sheriff, two weeks ago, said he intended if donald trump or others were to be indicted to treat these defendants like any other individual who is brought in, and here in atlanta. and that would be a process that includes a mug shot, and a fingerprint process here. you know, for the 19 defendants, nine days, they have 24 hours to appear here, the jail is open 24 hours a day. and the authorities have said the

so vaughn, what's the latest from trump world? do we have any insight into the discussions about trump's next move, or as everyone's waiting to hear what the timing of his surrender might be. >> right, we know there are deliberations that were continuing overnight into exactly when he will come down here to georgia. we know that he will be going to a fundraiser in nashville tomorrow, so potentially thursday or friday are still possibilities, though we have seen in past obviously a great amount of protocol and preparation made ahead of his actual movements for his arraignments, and i think that's an important point here is that in georgia he will not only have to surrender here at the fulton county jail, but he will also have to take part in an arraignment, and those events could take -- happen at two different times and the arraignment could potentially be waived. it could potentially happen virtually. we're working on better understanding the actual mechanics of this here. we know that the secret service has been in touch with th

let's get the latest on this and more from nbc's vaughn hillyard. blayne alexander is standing by in atlanta where we're expecting developments in the georgia election probe. vaughn, tell us more about why the special counsel is asking for this protective order and how trump world is reacting. >> they submitted the file on friday. in the filing they made it clear they're looking for this protective order which would very specifically prohibit the former president from revealing evidence obtained through the discovery process, this during a criminal proceeding is when the department of justice turns over the evidence it has gathered that it plans and intends to present during these criminal proceedings and gives it to the defense counsel. the concern from the department of justice is that donald trump has not only shown a keenness to revealing evidence, but also to putting pressure on potential witnesses. mike pence was one of those this weekend in which he called his former vice president delusional. of course, mike pence may be one of the witnesses

joining us now is nbc news correspondent vaughn hillyard who's outside of the fulton county jail for us, nbc news senior legal correspondent laura jarrett, and "atlanta journal-constitution" political reporter and an msnbc political contributor, greg bluestein. those are big questions, let's get to the reporting about what's going on. laura, i'm going to start with you. donald trump and the others were originally going to have a trial date a little bit later on. now at least one of them wants their trial date on october 23rd. we'll see if that happens. we also have hearings coming about whether this case should be sent to federal court and taken out of state court. what's the argument there? >> this all starts because the former chief of staff mark meadows decides to file a motion to pluck the case out of state court into federal court. he filed that just on behalf of himself, saying because i was acting as chief of staff, as part of my official duties, this case should be in federal court. the judge said fine, you want a hearing, it's going it happen 10:00 a.m. on monday. it's a big

vaughn is absolutely right.hat is, and it's a bit of an issue to say, i gave it my best, i'm willing to drop out. we go into iowa, and there's four or five other people still there, donald trump is going to run away with it, just like we saw in 2016. >> we see that trump's nearest rival still is ron desantis, but he faced some backlash after this comment. >> we have a strand in our party that views supporting trump as whether you are a rhino or not. you could be the most conservative person since sliced bread, unless you're kicking his rear end, they will call you a rhino. if we're listless vessels that are supposed to follow whatever happens down the pike on truth social, that's not a durable movement. >> during the 2016 campaign, we saw the impact of hillary clinton's basket of deplorable, is that remark going to come back to haunt desantis? will trump make sure it comes back to haunt desantis or is it one more thing in a long list of campaign problems? >> you have seen the trump campaign jump all over this. i

. >> here is vaughn hillyard and karol lam. >> vaughn, a lot to sort through and prosecutors first requestedon friday, right, there was a lot of back and forth that has taken place since then, walk us through it. >> a filing that was present bid the department of justice, the prosecutors bringing this case against donald trump. what prosecutors are contending if donald trump if he were to secure the evidence they're turning over to his legal counsel as part of what's called the discovery process that he would share that information that's supposed to be private and only used for the purposes of t criminal trial and that's where this protective order is attempted to be had by the department of justice, now we're waiting a 5:00 p.m. deadline just two hours from now in which we expect donald trump's legal counsel to file a response to push back on that. donald trump has pushed back on this effort on having this protective order against him impeding his first amendment rights. it's important to note that for donald trump he already has a protective order case in the classified documents case. >>

. >> joining me now, nbc's vaughn hillyard at the fulton county jail. vaughn, we should points out that rudy giuliani was for a while the number three official in the justice department and a well-known prosecutor who really was the first to use the rico law in these civil cases, while collar cases. vaughn, all 19 defendants will have to arrive there at some point over the next nine days for a big dose of reality. they have to arrive at the jail. they are white collar criminal cases. >> reporter: right. rudy giuliani is contesting that this is a misuse of the racketeering statute here in georgia. rudy giuliani will have to make that case in front of a judge. for rudy giuliani, the last time he was in georgia was when he was testifying in front of an official proceeding at the georgia capital building here in atlanta. this time around, he will have to show up at some point over the next nine days here at the fulton county jail to formally surrender. the sheriff here suggested that he would treat each of the defendants, including donald trump and rudy giu

msnbc legal analyst lisa rubin from outside the fulton county courthouse, from the jailhouse, nbc's vaughn hillyard, who is following the trump campaign for us. and former u.s. attorney and msnbc legal analyst, barbara mcquade. the clock has officially run out in atlanta for the defendants to turn themselves in after what has been, and i think this is an understatement, a whirlwind week. what's the latest from there? >> well, chris you know that all 19 defendants have now been booked and released. the latest being steven lee who spoke to our gabe gutierrez with his attorney after his release. steven lee told our folks that the reason that he was the last to post bond is he had trouble raising the money which has been a continuous theme this week. only harrison floyd remains in custody. he is entitled to a first appearance in the next 72 hours or 72 hours from his arrest, and then of course on monday, we're going to see twin hearings of major consequence to the when and where the election interference cases against donald trump are tried. one hearing here in fulton county, georgia, and fede

in his other cases, but for the rest of us, we'll see how much special treatment that he gets. >> vaughn, walk us through this 3:00 p.m. deadline for d.a. fani willis to respond to mark med ows request for an emergency stay. >> fani willis rejected mark meadows request to have his period of opportunity to surrender pushed back to next week, and in response to her rejection, mark meadows went to the judge, the judge then in turn ordered fani willis' office to essentially lay off their case as to why they need him to surrender and go through this booking process before friday. mark meadows contests he should have the opportunity to present his case about why a federal court should hear this trial as opposed to here in the county, and so this 3:00 p.m. deadline set up as mark meadows opportunity essentially to push back or i should say fani willis to push back against mark meadows' request here. we're now just learning that last night at bedminster, donald trump took part in a fundraiser for a group helping fund legal counsel for january 6th defendants. those defendants are not these indivi

nbc's vaughn hillyard has that part of our coverage. vaughn. >> reporter: chris, that's right. all 19 defendants here in fulton county have now formally surrendered and gone through the booking process. literally defendant number 19 met the deadline of just 90 minutes ago in that last hour, steven lee, he's an illinois pastor, part of the alleged scheme to put pressure on fulton county worker ruby freeman to falsely admit to voter fraud that she did not actually engage in. she turned himself in and posted bond. 18 of the 19 defendants posted bond and are out of jail. one of them, harrison floyd, he is still in jail here as we speak. he has yet to put up bond. for each of these defendants, it's very much finding their own paths forward. we have already seen multiple motions filed on behalf of these defendants. mark meadows has a hearing in front of a federal judge scheduled for this upcoming monday, to move his trial from the state court to the federal court. four others have made such a similar request but we're already seeing here, these defendants with differing interests fro

vaughn hillyard is in des moines for us. >> reporter: good morning.mer president trump had not visited the iowa state fair since 2015, right after he announced his first run for the presidency. yesterday was quite the time for his return with 2024 rival candidates ron desantis and nikki haley at the state fair at the same time. trump's motorcade rolled on to the fair. this after charges are considered against mr. trump as soon as this tuesday, investigating efforts to overturn georgia's 2020 results. this would be his fourth indictment this year. at the fair, i asked him about it. president trump, did you intend to overturn the 2020 election? >> you know the answer. >> reporter: that question is also at the heart of his pending federal criminal trial in washington, d.c. where the special counsel this month. when asked whether he would comply with the protective order to prevent him from disclosing sensitive material related to the case, he said he would have to talk a look at her order. he was also defiant when i asked whether he would consider taking
