he had a negative bill into the virginia plan. the congress would have veto power over all state laws which is what the crown has. his image of the congress is a replacement for the crown. he doesn't get -- it is impractical. can you imagine if congress had to sort out the state laws coming in from 50 states? it was impractical. the convention in its wisdom has article i section x which is a series of prohibitions on what the states can do. madison had to be satisfied with that. he was not satisfied. his letter to jefferson in october of 1787 is full of despair. they killed my veto power. it is not just not going to work. that is how much he feared the state. that was his image of the government. hamilton has a very different image. washington buys into hamilton's vision that we are a european tight state. it will take a while but we will build up, we will be as strong eventually as england and france and then we can take iman. in the meantime, let's just lay low. let's not create premature conflict with them until we get strong e

questions raised by chief justice roberts last term in west virginia. the chief justice listed 40 questions that he said were unresolved by the court's ruling including how much money is too much, how do we determine what is disproportionate, what if the case involved a social or ideological issue rather than a financial one, must a judge recuse himself if he got a disproportionate support from pro-life or pro-choice groups. i do have to note that these are the kind of questions that legislative bodies usually resolve. in those states that have dealt with this issue is the state bench and bar that have been charged with establishing recusal rules. so far i have to say with very little success. so is there any way to do this short of getting rid of parts and elections of judges altogether? barring that was the supreme court's decision in the case from west virginia just a shot in the dark soon to be eclipsed and forgotten under the rubric of citizens united? and by the way, with the supreme court's decision last week unleashing unlimited special-interest

a judge ordered her to turn over her daughter to janet jenkins yesterday in virginia. miller didn't show up. miller and jenkins were joined in a civil union in 2000. their daughter was born in 2002. when the couple broke up the following year, miller moved to virginia, renounced homosexuality and became an evangelical christian and later given custody of the girl but late ear judge determined she denied jenkins proper visitation rights and ordered her to turn the girl over to jenkins. >>> thousands of people who fled a volcano were allowed back home today even though the danger isn't over yet. most of the people who were evacuated lived within five miles of the mayon volcano. the activities have been decreasing over the past few days but warn the level of volcanic unrest is still high. >>> rescuers are searching for people who may have been buried in mudslides. more than 50 people have been killed after heavy rains hit brazil and include 22 people who died when part of a mountain collapsed and slammed into an upscale resort popular with celebrities. other mudslides lef

in virginia, it is one-third, one-third, one-third. again, independents broke for mcdonald over creigh deeds. there are certain aspects of it that are unique to new jersey and virginia. chris christie defeated an incumbent. jon corzine who had that job approval numbers -- the voters are fed up with him after one term, tired of one-party rule. there was lot of frustration aimed at trenton. in virginia, winter is a one- term limit on the governorship, there is more of an open seat dynamic. mcdonald had a positive agenda putting ideas out on transportation, and job creation. that was a singular focus for his campaign. there was a bumper sticker that read "bob for jobs." that constant stream of policy proposals on education, higher education, charter schools, more assistance for of virginia students, putting aside green space conservation areas -- it was a proactive, positive agenda. in full disclosure, she is a friend, and i volunteered on his campaign, but i think he set a high bar for candidates to reach. host: what happened in 2006 the
