never got to the merits, because what they ruled, 5-4 was this republican-led house of delegates just one chamber of the virginiaon its own. did not have its own injury. so you had senior liberal ruth bader ginsburg being joined by clarence thomas. so you could see the alignment was different than what we company for coming further in the term. and, you know, the way it works, the justices can't just rule on any case or controversy unless somebody has actually been harmed. and what ruth bader ginsburg said for the majority is that the house by itself, as just one chamber of the legislature, could not show harm to it. >> and further in the term, we're now at the end of the term. >> right. >> there are some 20 cases left, including a major jergerrymandeg case, the census case. how will they fit that in, get to those, and also maintain what chief justice john roberts has tried to call an apolitical court? >> well, first of all, it's like anything with a deadline. you know, you with a deadline, with a story. me with a deadline with a story. a senior with a deadline with a term paper. they tape until the last minute.

house delegates, you cannot bring this lawsuit. what the supreme court did today, the supreme court agreed with the democratic attorney general in virginia and said, no, the republican-led legislature in the house of delegates cannot bring this lawsuit. as such, they let the lower court ruling stand. these court-ordered districts will stand that do more favorably go to democrats. there's still a lot to come at the supreme court. this was an issue the supreme court somewhat resolved on partisan gerrymandering -- i'm sorry, racial gerrymandering, even though they didn't go to what is unconstitutional and what isn't. . we are awaiting decisions on partial gerrymandering, when politicians go too far in drawing the district lines for the political gain of one party or another. we're awaiting a decision on the citizenship question and whether or not that can be included in the 2020 census. a lot of political issues here at the supreme court. the supreme court tries to stay apolitical but they have been front and center in this political depabatedebate. we're winding into the final days of the supreme court's term ending at the end of june. >> in these final days in the next week or two they could be tac

we see a little pledge card, are familiar you with house of delegates race in virginia. stead of asking voters to fill out cards pledging to vote, we ask them, the people who said no to volunteering for the campaign, we asked them to take a pledge to hold three friends accountable to vote. it did not signal that the campaign did not trust the voter, there was not any risk of not voting, it came off as flattering because we were able to look at people like my little brother and say, thank you so much for supporting us and saying you will vote for us, we bet you have runs you could folks we will, probably never get the chance to talk to, and you will be way better at getting them to vote than we would. it would be one thing to say as part of the canvassing script, will you get some friends to vote? most people say yeah and life would go on and it doesn't change many people's behavior. this card is based on behavioral science research that shows that if you get people to make a plan and concretize which a specific friend there can hold accountable to vote, so in this example

the state of virginia realigned its state legislative districts to favor democrats. and the republican house of delegatese supreme court said one house can't sue. it really means nothing. only both houses can sue. they threw the case out. bottom line a win for the democrats in state legislative districts. i have to tell you, courts are reluctant to get involved in redistricting. it is essentially a legislative function. and they only want to get involved in the legislature is way out of line, like say my legislative district in new jersey where i live along the delaware river and my congressman lives along the hudson river. it's the same legislative district. okay. but what has me steamed yesterday and we were talking about this during the break is the double jeopardy decision. the whole history of the constitution is a reaction to the excesses of british colonial rule. and one of those excesses was repeatedly trying someone until they got the verdict they want and the punishment they want. steve: only get tried one time. >> correct. that's why we have a clause in the fifth amendment that prohibits repea
