then we sought roe v wade in 1972 -- then we saw roe v wade in 1973.tices ruled that the u.s. constitution guarantees women a right to privacy in deciding whether to end pregnancy. he states longer can prohibit abortion -- states can no longer prohibit abortion except in cases of viability. even then, states must allow abortions when necessary to save a woman's life or protect her health. how have we seen the law worked on by states since that jacko u.s. out -- how have we seen the law worked on by states since then? effective v wade right now compared to what states are doing? guest: there were two very landmark cases at the high court related to abortion. obviously roe v wade was the first. and we saw in 1992 a case called land parenthood -- planned parenthood v. casey, and what the high court decided in 1992 is that states have the right to restrict -- to pass certain restrictions, and certain restrictions are legal. what the court said is that the state cannot impose an undue burden or great obstacle to a woman trying to get an abortion. that is ex

it is clear that roe v wade has remained an unresolvable question. the competing rhts between the pre-born and a mother carrying , this is, in large part, i think, because we did not come to a political, democratic resolution of it. >> six states allow civil unions but not marriage. nine states allow same-sex marriage. but because of the defense of marriage act, the federal government does not recognize same-sex marriage in those jurisdictions. it is a very odd situation. >> it is a very odd situation. what is interesting about these two cases is that justice kennedy, who really is the linchpin in these two cases, was really not very interested in the e quality argument. what did interest tampa -- what was that thetamphim federal government would not recognize marriages in states where they are legal. the government has always allowed states to define marriage. why canis the case, california not define marriage as between a man and woman, which is a of the case now -- which is the case now? >> i stand in defense of oba in this. you can have a view th

wade.s measure is one of many attempts by north dakota's republican-ruled legislature to "discover the boundaries of roe vs. wade." the state passed a measure that defines life beginning at concept. it would question the legality of birth control and in vitro fertilization. it may seem like north dakota's lawmakers want to clamp down on abortion clinics, but the number of abortion clinics is exactly one. for a legislature intent on protecting life, no matter what settled law dictates, it's regulations are inconsistent at best. for example, in north dakota, drivers are not required to wear a seat belt. and while all eyes may be focused on the state, what happens in north dakota does not stay in north dakota. all over the country, anti choice groups like personhood usa are targeting states with republican controlled legislatures and are seizing this moment of single party control to chip away at a woman's constitutional right to choose what happens to her body, one state at a time. and with 5

wade. it's going to be struck down in federal court.uestion is whether or not the supreme court would want to take this case. i actually think that it's not likely that the supreme court will take it. i don't think justice kennedy, who is the court's central swing vote on abortion, is going to want to take this case because it's so clearly would overturn roe. clearly as krystal said, the agenda is to challenge roe versus wade directly. it's pushed by a wing of the anti-abortion movement tired of waiting and chipping away. the trap laws are chipping away without really admitting the ultimate goal is to ban all abortion. this puts it out on the table. >> to the point of the chipping away point, it's not just north dakota. these laws have been showing up in arkansas. mississippi, obviously, the fetal heart bill was -- heartbeat bill was defeated. but these states, i mean, these lel legislatures, we've seen them come back this next legislative session and try again and again and again to chip away at women's rights. you say you don't think
