must have been a friend of walter scott's from work we're told. uentes, your thoughts on what we saw there? >> well it gives reason why maybe the officer chased after scott, because he would have been aware -- we don't hear the radio dispatch. but he would have been aware how close backup is. if he knew a squad was coming quickly and he goes and pursuing scott on foot he would have been aware that the passenger is going to be covered by another police officer shortly. >> the lawyers for the scott family are back with us chris stewart and justin bamberg. i know you had a chance to watch the video. let me start with you, chris stewart. what's your reaction? >> nothing. you know it looked like a potentially proper stop. if so that's fine. you know he did get out of the vehicle and run. as we said he did run because he had outstanding child support, which he would have went to jail. and he didn't want to. he ran down the -- there's an alleyway down that street where this new alleged witness saw what she described as them not on ground whatsoever. she d

walter scott's vehicle pulling into the parking lot of the auto parts store and officer slager getting out and talking to scott for several minutes. then slager comes back to his vehicle. walter scott appears to get out of his vehicle briefly and put his hand up and goes back in the vehicle. a few seconds later, walter scott is seen taking off running to the left side of the screen. that is the extent of the videotape. we don't know why walter scott took off running. that is a key gap that has to be filled in this case. another new development we have just interviewed another witness. exclusively interviewed a witness to come forward to talk about what she saw. gwenn nichols. she saw say scuffle. she did not witness the gunshots. she said they scuffled and then saw walter scott go into the vacant lot where he eventually was shot. she heard the gunshots. >> i started to cry. sorry. i started to cry because i thought about the altercation with my son and it could have been my son. it could have been any one of these young black men around here. >> reporter: gwenn referred to her son ther

we don't know why walter scott took off running. that will be a key gap that has to be filled in this case. another new development. we just interviewed another witness. ex- exclusively interviewed another witness. gwenn nichols was in the neighborhood. she did not witness the actual gunshots but she said they scuffled a bit and she saw walter scott go into the vacant lot. she described to us how she felt when she heard the gunshots. >> i started to cry. i'm sorry. i started to cry because i thought about the altercation with my son and it could have been my son. it could have been any one of these young black men around here. >> reporter: she referred to her son there because she says her own son had his encounter with the north charleston police that was similar. her son was pulled over for routine traffic stop and they ended up roughing him up a bit and arresting him. she could relate to what happened to walter scott on that day. john and christine. >>> brian, an interesting look at the video. this morning, we are also hearing fr

michael said that walter scott tried to take his taser from him and he felt threatened. here we see a dark object that could be the taser on the ground as scott is running away and you can see the officer there in firing position firing those eight shots, five of which hit him. after he was shot we see the officer leave where scott was down on the ground run back to pick up what appears the same object. possibly the taser. we don't know that for sure. based on the circumstances it appears to be possible. next frame. here we're going to focus in on it. does this piece of video show the taser being dropped. you're a police officer 24 years this new york. when you look at that evidence i'm not asking you to be judge, jury what does that look like? >> something looks funny. the way he dropped it it was like he was walking and like he wasn't dropping it. >> like he wanted to hide what he was doing. >> the assumptions it might be the taser. we can't tell. we have to get the video enhanced. we have to read the real police report. even though he was videotaping, he was probably a

that north charleston policeman ended up firing eight shots as he pursued walter scott across a grassy lot in north charleston. mr. scott was shot multiple times and died of his injuries. the officer's attorney yesterday told the local paper that the officer had used his taser on mr. scott during this encounter but that it had not subdued him. the officer's attorney sudden walter scott tried to overpower the officer and take his taser a away from him and he felt threatened and followed all proper procedures before firing his gun eight times at walter scott. that was the news as of yesterday in south carolina. okay, the attorney for the police officer in that fatal shooting defending his client. things changed late today when we got another side of the story. turns out there was a cell phone video taken by a bystander of what happened on saturday morning. the attorney for the family of walter scott got a copy of that video and then gave it to "the new york times." they published it late today and this very difficult video i am not going to play this over and over again, it shows a man b

but walter scott gets about 25 feet away, four seconds later and eight shots, walter scott drops to the ground. he is later pronounced dead at the scene. and then one interesting piece, if you look closely at the video, at one point you see slager go back to where the initial confrontation had taken place and dropped something next to walter scott's body. it's not clear if that's the taser. then moments later he goes back and picks up that very same object. it is clear, john and christine, that this video played a dramatic role in these murder charges being filed against officer michael slager. john and christine? >> ed lavandera, thanks. this was a traffic stop for a broken or cracked taillight. now, on top of the state murder charges, officer slager faces an fbi investigation for possibly violating walter scott's civil rights. he's also likely to be named in a civil lawsuit planned by scott's family. they were outraged heartbroken when they spoke to the media last night. their lawyer called slager, quote, a cop who felt like he could get away with just shooting someone in the back. wa

this news conference called after the shooting death of walter scott. 50-year-old walter scott by northrleston parole man michael charles slagger. one announcement made at this press conference. >> the officer that was terminated. his wife is eight months pregnant and while she--he has been terminated the city will continue to cover the insurance on her for the baby until after the baby is born. we think that is the humane thing for us to do. and we're going to do that. >> so the mayor indicating that while the officer has been terminated that there will be a continuing of insurance coverage for the wife of the police officer, who is now being investigated by the state law enforcement agency sled its called in south carolina. the state law enforcement department that is now handling the shooting death of walter scott. we have standing by live with us jonathan martin, who was able to listen to that news conference in north charleston. do you know anything about who those protesters were, who were shouting during the news conference? >> you randall they're a group with black lives matter.

local policeman who today lost his job and now as, you know faces murder charges for shooting walter scott again and again and again. judy scott is enduring the worst pain a parent can experience. that's not surprising. what is surprising and what you're going to hear tonight in the interview is that at the worst moment in her life she is experiencing incredible sense of faith and incredible strength and even forgiveness. she has forgiven she says the man who killed her son. you will hear that from her tonight. that man is michael slager. he was fired today less than 24 hours after being charged with murder. police chief eddie draeger today called it sickening. the victim's mother still has not been able to watch the full video of her son being gunned down. it was taken four days ago by a bystander and he took it to show the family after what the police said about this shooting was not true. the officer firing shot after shot eight shots in all. that's what the video shows after fleeing walter scott whose back was turned the entire time. take a look. that obviously is the pivotal sequence,

the officer that fired the shots reported that walter scott had taken his taser, or was trying to take his taser. after the officer shot and handcuffed mr. scott, you can see the officer afterwards jog back to another spot a few feet away where the tape basically started. the officer a researches toward the ground, and he returns back to where mr. scott is lying down, shot, be the handcuffs on. the "new york times" says he returns to mr. scott and drops an object next to his body, and it may be the afore mentioned taser. the uncovering of this video appears to have radically changed the case. today the officer was booked in a murder charge. the officer is michael slager. he has been on the force for five years. he was charged at the north charleston police station where he works. he have seen a string of police involved shootings recently. and many of those casings, the officers have not been charged and that is part of why those cases have become such high pro file things. that was case in ferguson, missouri with the killing of michael brown. that was the case in staten island, new yo

david, you've got from the time walter scott falls to the ground until the end of the video you see things like officer slagger checking the pulse of scott. then the officer appears to be looking at the wounds. there's no blood on his gloves. that's more than two and a half minutes. no life saving measures are given at that point. what's the protocol? >> generally -- i can tell you what it was for us. if you were not a first responder conscious we had a ent program. if you were involved in the shooting, you were the one that defended himself or herself and caused the injury you were not obligated to render aid. the initial protocol the only thing close to correct protocol is cuff him. why? that's just what we do. >> even if they're unconscious? >> the reason is people who we think are unconscious or even dead have suddenly come around and killed police officers. that's why that's done. the next responders when they arrive they should be giving aid. >> the real issue that you point out, and we were talking about this -- how does it get from a traffic stop a taillight out at 9:30 in the morn

jason carroll, cnn, north charleston, south carolina. >>> the brother of walter scott, anthony scott, joins us from outside the family home in charleston, south carolina. you see him on the right of the screen. in the center now is chris stewart, attorney representing the family in what are very difficult days. welcome to you both. anthony, i'm very sorry for your loss. i appreciate you joining us on cnn today. before the important video emerged, what did police tell you about what happened, and was there any question about the sequence of events initially? >> yes, there was. initial i they told me my brother of stopped for a traffic, broken taillight on his car. and then once they said he was stopped for a broken taillight, they said he proceeded to run out of the car after the officer ran his license. they said that in the pursuit of him, he was there for a taser. they said he took control of the taser. and i heard he was tasered more than one time. i thought that he was okay. but by the time i got to the actual site, my nephew told me he was gone. i said, how is he gone? they said

walter scott now a memory. in the meantime, we're also learning that the officer involved, michael slager, he's been charged with first-degree murder in this case. and he has now been separated from the general population in that jail. and that means he's in a cell by himself and is being monitored for his mental health. as far as the dashcam video is concerned, at first glance, it seems pretty routine, a traffic stop you may have seen before. and that is until mr. scott begins to run. the video i'm about to show you, it may give some answers to some questions that are looming over this case. but it certainly does not explain the biggest question, why officer slager chose to shoot walter scott in the back as he was running away. i want to show you the whole scene as it played out in front of officer michael slager's dash-mounted video camera. >> show me your license and registration card. >> [ inaudible ]. >> what's that? >> i got my license but -- >> let's start with your license. the reason for the stop is yo

this is where it all ends for walter scott. the chase ends in a confrontation in which officer slagger shoots scott with a taser. scott takes off running. officer slagger raised his pistol and fired eight shots. scott is fatally wounded. as scott lay dying, officer slagger put hand cuffs on him. he then jogs back to where the altercation began. he picks up an object off the ground and drops the object here at scott's feet. unbeknownst to officer slagger, there was a witness filming the entire episode from this side of the fence. he captured the last horrific moments of walter scott's life. >> joining me is trymaine. i've been talking to the people since i got here today, talking about the context in which this happened. we saw a little bit from the young man who shot the video. this is not ferguson. there are real key differences. but there are also some key similarities. obviously we're not seeing the arrest, we've seen the officials move in a very quick unanimous way. there's not the same kind of fraught sense of tension. yet

we take a look back at walter scott's life. >> walter scott now lives in our mind for the way he diedis family, the people who struggled for an imperfect world and his place in it. >> i had two brothers. i had two brothers. but now i have one brother. but out of my brothers, he was the most outgoing out of all of us. he knew everybody. >> that outgoing personality brought him to the u.s. coast guard at age 19. he served for two years until the coast guard says a drug-related offense led to an involuntary separation. scott received a general discharge under honorable conditions when he left in 1986. his family says the years that followed brought ups and downs. scott's first wife and the mother of his two older children died. scott remarried, had two more children. but that marriage ended in divorce. unpaid child support piled up and according to south carolina authorities, a warrant was issued for his arrest. that may be why, says the scott family attorney, he ran from officer michael slager. his brother says he was a huge dallas cowboys fan and was happy the last time the family was

the driver was 50-year-old walter scott. what happened after he exited his car is the subject of the video. in the officer's account which he gave on saturday he said mr. scott took the officer's taser. moments later, the officer reported on his radio shots fired and the subject is down, he took my taser. the video shows mr. scott running as officer slager fires as many as eight shots. [ gunfire ] moments later in the next piece of video, officer slager instructs the victim to put his hands behind his back. the victim appears unresponsive. the officer then handcuffs him. officer slager walks away, goes back to the original spot, and appears to lean over the ground. finally in this final piece of video, you will see at regular speed, and then in slow motion, it appears to show the officer dropping something near mr. scott. this is the video of officer slager walking back to the victim in slow motion. the officer appears to drop the stun gun near mr. scott. that's the stun gun he had run back to retrieve earlier in the video,

walter scott's footage is from a bystander.is come to fruition? >> what happened was the family was given the video on monday and they immediately said we need to get this to the authorities in south carolina. there's a special law enforcement division that's investigating and they immediately gave it to them. they immediately gave them the copy and then within less than 24 hours you see charges. i have never seen something charged as quickly as this in one of these cases. think about ferguson. it was a long grand jury process that went on for a very long time. right before we were even able to post the video online they had announced that they had charged the officer and it really deescalated it locally. it's kind of an interesting thing here because the drama of what's going to happen to the officer is over. >> the family presumably knows who shot the provide, right? >> yes. >> did you have to verify the authenticity of this at some point? >> it was a difficult thing for us. so we got this video. it looks really interesting.

>> will they be able to show he was justified in shooting walter scott as walter scott ran away? when is the use of deadly force by an officer against a fleeing suspect justified? that's the key question here. legal analyst paul callan is here, former homicide prosecutor and current criminal defense attorney. tom bernie, former nypd detective and now law enforcement consultant. this is porptd because it very much gets to the core of this pending case. paul, we could go real deep into history books and legal jargon. this gets back to a supreme court case in '85 that got to the key question of when is an officer justified in shooting a suspect who is fleeing. this is a burglary suspect that at supreme court got to. this is a traffic stop here. somewhat the legal basis? >> up until 1985, the doctrine called the fleeing felon doctrine was that, if you committed a felony and the police were pursuing you, they could shoot you down if you tried to escape. it arose from the middle ages when all cases were punishable by death. you could shoot somebody if they were a fell len or suspect pd

we have to warn that this video is graphic. [ gunfire ] >> the officer told dispatchers, walter scott grabbed his taser. as the video continues, the officer returns to the spot where the men were standing and picks something up. the officer then returns and drops an object near scott's body. it's not clear whether it's the taser. i commend the city of north charleston for acting swiftly to deliver justice in this case. the video came out and they acted on it. but today, walter scott's father was asked what would have happened without the video? >> it would have never come to light. they would have swept it under the rug like many others. and i thank god that this young man, whoever it was, had the video. when i saw it i fell to my feet and it just -- my heart was broken. and i said oh no it can't be. and when i saw it i just couldn't take it anymore. >> reporter: this morning, the mayor and police chief of north charleston visited the scott family. the mayor says the police force has placed an order for body cameras. >> thanks to senator marlin kempson and also one of the members of t

vicente what, do we know about walter scott? >> reporter: well, scott we know that the family of walter scott is telling us the reason he ran is because he had a warrant out for his arrest, owed child support, and didn't want to go to jail again. the 50-year-old had been arrested at least three times before for not making payments. as for the second person in the car, today the attorney for scott's family told us they believe that person was a friend but they don't know who it is, and it's not clear what that person did after scott and slager took off running. that car was an older model mercedes-benz, and just a short while ago, the family told us that he had bought that car just a few days before and was in the process of transferring the paperwork. >> pelley: vicente arenas for us in north charleston. thank you, vicente. the cell phone video that captured the fatal shooting begins after officer slager's taser has been fired. the wires still connected to scott, who is struggling with the officer. jeff pegues has been working on

the reporter said he was shaken and stunned when walter scott confessed to killing jordan almgren. >> kind of was all these thoughts, he thinks the world is coming to an end. and he bought survival gear on thursday he said, including a bear grill knife, which he said was the murder weapon. and he said that night at 3:00 a.m. the issue was so important to him, he woke up and he went into the boy's bedroom to stab him. >>> during that interview walter scott admitted to stabbing the boy as he slept saying i wanted to see what it was like to take a life before someone tried to take mine. he said i wish that i hadn't done it. i think about that with my little brother in that sense i
