it started as a routine traffic stop and then walter scott ran.there you see the officer who opened fire. now, there had been a tussle, but you saw that walter scott was able to break away. michael slager, allegedly fired eight times, striking walter scott five times in the back. it was that video that once it was released, triggered what would be, of course, outrage and the murder charge on state charges. but now comes this federal indictment that's been handed down and as you pointed out, there is one count of civil rights violations that's basically because law enforcement over excessive use of power, it was the use of a weapon in the commission of a crime and then obstruction of justice. this is brought up because michael slager allegedly told investigators initially that walter scott was charging at him with his own taser and he had to shoot to protect himself. that video shows a very different story. the attorney that represents walter scott's family issued a statement. it reads, this rare and federal indictment reconfirms the fact that walt

it captures michael slager, the north charleston cop, firing aet times at walter scott. from a traffic stop in april of 2015. slager was charged with murder. he was promptly fired from his job as well. his criminal trial is scheduled to start in the fall where if guilty he could face a possible life sentence without parole. ari joins me now. the officer in question is out on bond. what do we expect to happen in court, ari? >> reporter: they'll walk through what the federal charges are. i will tell you, you just ran through exactly what he's facing at the state level. and that is typically all we would have in the case. what is unusual today, what is new today, is the federal government moving forward on these charges. you see it in the video there. the cell phone video capturing him basically being shot in the back while retreating from the officer. that video, what you're looking at, is the basis for the charges i'm about to read, depriving someone of their civil rights under color of law, using a firearm in committing a crime of violence, and then obstructing justice.

he's charged with violating walter scott's civil rights under color of law. that could carry the death penalty. the government in the federal system has to make a separate decision about whether to pursue it but based on the legal experts i've talked to this morning, that does seem to be an option here. finally, it's interesting to note that the government says in these charges that when slager, the police officer, was initially interviewed, he misled the south carolina investigators by saying that scott was firing at him with a taser that he stole from him while they say in these charged that that is not in fact the case. so he'll appear in federal court this afternoon at 1:30 to face these charges, but it is a ratcheting up of the legal process against him. >> so, pete, i'm curious, he has been out on bond since january for the criminal charges that the state filed here. how will that potentially be impacted regarding these federal charges? >> well, that's a good question, because there will be a separate hearing. the way this normally goes in federal court
