[bell ringing] >> supervisor walton: thank you, ace. >> supervisor walton: thank you, ace. next speaker. >> supervisors, thank you so much for holding this hearing. my name is christine lee. i'm a law fellow at the public defenders office and work in the bail unit. i was on assignment in late november to interview a client for the purpose of the bail motion. we collect stories in order to be able to advocate for our clients in this way. i went to interview a client on november 28 for the purpose of such a motion but it became apparent to me that he really needed to an emergent situation. this client, the night before, the emergency situation he had suffered from, he had routine cell inspection in his room in county jail 5. that would be in san bernardino. what happened at that incident, there was an issue with the sheriff's deputy. the client was severely beaten in the cell. so much so that he had to request to go to the emergency wing to receive medical assistance. at that time what he had related to me, they had taken him to the medical wing at which point he was chained

[bell ringing] >> supervisor walton: thank you. >> hello there, supervisors. i'm a member of the democratic socialists of america as well the campaign of dean preston, but i'm speaking as someone who has been within 850 bryant street as detainee. it seems evident to me, that no individual or organization can be safely charged to investigate itself. all the more so for an organization like the sheriff's department which holds custody of persons in profound isolation from the rest of the world. i want to speak in favor of the strongest policy of external oversight for the sheriff's department. it strikes me as one that is in itself fraught with capacity for injustice. as we've seen in the history and the cases we've heard about today, it will be in the interest of sheriff's deputies and officials to down play, cover up and obscure wrongdoing. i do not believe that the moral standards of the people of san francisco are the same as the processes of the sheriff's department. nor what discipline is appropriate for actions. it contains abuse of power and common cruel

the fox guarding the hen house, as supervisor walton put it. now, back in 2015, the sheriff's department considered a significant overhaul to the internal use of force policy. that overhaul would have set a higher standard thunder the minimum legal requirements under the law. the proposal would have defined terms that today under the existing policy are not even defined. terms such as "reasonable" or "excessive" force. and it would have required regular deescalation training for all sheriff's department staff. unfortunately, those proposed policies were never put into effect, and so we find ourselves here today. more than three months have passed since these complaints at issue were filed. they were first brought to the attention of the sheriff and her department around thanksgiving of last year. what that means is that under government code section 3304, there is barely nine months left to complete the investigation and impose any administrative sanction on those found culpable. it is highly problematic to restart an investigation at this stag

supervisor walton? >> just one question. i know we're 90% funded, and what's the average -- in your mind and thoughts, what's the possibility of getting to 100%? >> it's -- i'm going to give you a global answer because i really need to do a deeper dive to really answer that spot-on. i feel comfortable about accepting the nomination because i think we can reach it in a reasonable amount of time, but we have to make some changes, structural changes to it. i'm committed to doing it, to fully funding it. but i have to tell you, i can't answer that question in actual -- >> just for the record, madam chair, relative to other investment funds and public funds, we're doing exceedingly well. so at one point we were far less than 90%. we were down in the 80s. anyway, just for the record. >> sometimes it is good to see a case in point. in the actuaries, for the city and county service -- which is part of the reason i resigned. because we were able to actuarially take over a billion dollars out of the gaspesgaspi. a billion dollars usin
