on walt nauta, he finally was arraigned today. there was quite a delay as he was trying to get a florida-based attorney to go in there with him. he pleaded not guilty. you think that's the wrong decision? >> no. i think he believes that by being the trumpiest trumper, that donald will protect him. so the answer would be, yes, i think it's a bad decision on his part. again, being the trumpiest trumper, he thinks donald will protect him and not throw him under the bus. well, the benefit for someone like walt nauta is the fact that he has the example of michael cohen to look at. he has the example of rudy giuliani to look at. he has the example of half a dozen other people, including people like stewart rhodes, who got an 18-year sentence. what happened to donald taking care of them? what happened to donald paying their legal fees? in fact, tomorrow i'm back in court for pretrial conference on legal fees where i'm suing donald in order to recover. that's after 4 1/2 years. >> you're suing the trump organization for those legal fees.

but, still, today walt nauta pleaded not guilty. i don't know if that was his own idea or it was the legal advice he's getting but a certainly bold decision here. and the very live question now is how long will walt nauta stick with that decision? will he make it all the way to the trial with a lawyer paid for by donald trump? joining us now to discuss is the former u.s. attorney for the eastern district of megs, msnbc legal analyst barbara mcquade as well as david aaron, former federal prosecutor and intelligence attorney with the u.s. department of justice. thank you both for being here. barb, i have a good set of theories about why walt nauta might be inclined to flip on trump, but why -- i mean entertain the idea for a moment that he doesn't flip on trump. what are the incentives to staying in the good graces of trump world at this point? >> well, as pleading guilty is a very personal decision and sometimes it takes people up until the very end to be convinced that their guilt could be proved. but i can imagine when you're in a

his co-defendant, walt nauta, was seen entering the courtroom. let's discuss this with evan pe pettis. what are attorneys specifically discussing in this hearing today? >> jake, the purpose of the hearing was to discuss the classified documents that are at the center of the case, but the judge indicated in the last 24 hours that she wanted the two sides to come prepared to talk about a potential trial date. this is something that the special counsel has been trying to push along. they have been trying to say that they're ready for trial as soon as december. the trump team has indicated that they don't wanthe judge to even set a trial date. they say there's a lot of litigation they believe they have to do between and even getting to a trial. the obvious push there appears to be that the former president wants this to go well past the 2024 election. but, you know, they've raised the possibility that they want to challenge the special counsel, whether the special counsel even has the authority to bring this case, whether these documents are even cla

and carlos de oliveira. >> walt nauta, run.arl -- run as fast. first of all he's not going to get you an attorney, he's not going to pay for it unless you stay on message. and if you stay on message, you will end up behind bars. there's no doubt about it. >> i don't know if anyone should take legal advice from michael cohen. he may not like to hear me say that, but obviously he has had extensive legal problems on not only related to former president trump but also related to his own business dealings. yes, of course, if you flip, you are going to lose your lawyer that is paid for by a trump-affiliated political action committee. but these two gentlemen need to assess their own situations, assess the fact that the former president could become the president once again, potentially make this go away. they need to look at their situation carefully, because neither one of these men is going to have the resources to go up against the justice department on their own. but former president trump, he has two jobs right now. one, he want

walt nauta, finally getting a lawyer. finally pleading not guilty. walk us through what happened. >> it was a short hearing. the big news is he did get this lawyer, and essentially one of the reasons i think it's more difficult to find someone is because, you know, donald trump hasn't been known to pay his bills. that's something you're on the hook for down the line if, you know, no matter where this goes, once you're on the case you're stuck with it no matter what, even if there's a dispute about payment or what have you. whoever signed on for that is in for the long haul. with donald trump, a significant retainer agreement, cash up front in order to take on that case. i think in this case, you have to find someone who's willing to take that on. obviously it would be interesting to find out the details of exactly what the deal was on the finances behind that because walt nauta, right now is firmly in trump's camp. he's still employed by donald trump, his legal bills are being paid for by the broader trump universe, so, you know, right now it seems l

walt nauta hasn't been arraigned yet. just to give you an idea, all the best laid plans, even in federal court where they're much more efficient, they simply don't pan out because unexpected things happen. for example, how many weeks has it been and walt nauta hasn't been arraignment? that was supposed to happen right away. to give that as an example, eddie, that's supposed to happen immediately after the indictment comes out, and it hasn't happened for one of the co-defendants. so the expectation that this case would be tried in this calendar year, it's just not going to happen. there's no way. it can't happen. we haven't even started the dispositive motions, and those are coming, believe me. donald trump's team is going file any number of motions to throw this case out entirely. so once those begin, that'll maybe give us a better idea, but it's not happening in this calendar year. save the tape. maybe don't save the tape. but save the tape. >> there's also inherent delays to a trial that involves classified information.

the classified documents case that involves former president donald trump just a couple hours ago, walt nauta, trump's personal aide pleaded not guilty to helping his boss hide classified documents after a judge unsealed more of the mar-a-lago search warrant affidavit. that justification for searching mar-a-lago last summer and it reveals that prosecutors have surveillance video showing someone moving dozens of boxes before the fbi search. cnn's carlos suarez is out of the federal courthouse in miami. what can you tell us about the arraignment? >> reporter: well, that arraignment lasted about five minutes, 40-year-old walt nauta didn't say a word as he left the federal courthouse here behind me in downtown miami after pleading not guilty to obstruction charges and lying to federal investigators, inside the courthouse he was joined by his d.c.-based lawyer as well as a new south florida-based attorney, we're told that she's former public defender in trying cases across south florida. with knowledge of the situation, nauta is being accused of moving several boxes with classified documents

and walt nauta was not able to plead guilty until today. it is a question of whether or not walt would eventually flip on the former president. they are so incredibly close. this is someone who, inside the white house, it was his valet, he would get the former presidents coax, those kinds of tasks, essentially. trump took him to mar-a-lago with him. i do think there is a strong sense of loyalty there between these two. i have been talking to people who worked with walt nauta inside the west wing and about what that relationship was like. clearly, that will not change. the idea of who is paying for the legal fees is incredibly significant here. we have seen the filings that show the super pack is paying the firm that is representing walt nauta here. so, it is not to be underestimated as a major factor here. even though walt did that have new florida-based lawyer with him today. listen to what former new jersey governor chris christie, who is running against trump, had to say about that on our show last hour. >> if you make the case go to tri

he had previously been represented by the same person who represents walt nauta, stan woodward. what do you make of this, that this individual received a target letter, decided they no longer wanted a trump-affiliated lawyer, and appears to have provided some of the information in this indictment? >> that is a classic example of what a target letter is used for. you provide somebody with notice they could be charged to give them an opportunity to come in and cooperate. so obviously he made a decision to switch lawyers and to go in and tell prosecutors something that would allow him not to be indicted. whether it's true or not, i don't know. but that is exactly what the purpose of a target letter is, which is why it was so surprising to me that they are sending one to donald trump because obviously he's not going to switch lawyers and come in and cooperate against walt. >> true, but it does help put him on notice, right? it puts us on notice that an indictment is coming because it puts it on truth social. >> exactly. that's the point. a target letter to somebody like donald trump

why did it take walt nauta to find local council? why are we only just now seeing this motion to continue the hearing on friday that has been set for a couple of weeks? i know that you practice in the southern district of florida, judges in my district, they wouldn't look very kindly on that when nauta's we have known as soon as this hearing was scheduled that he had a conflict and could've advised the court back then. ultimately, these are the sort of nickel and dime delays the trump could perhaps be motivating, or perhaps it is just nauta's lawyers doing it on his own. it pushes things back a few days, but ultimately, that will get them into the crunch time as campaign kicks up for real. at that point, i'm sure that we will see trump himself asking for motions to continue, because he has rallies to hold, or primaries to attend. that is when we will really find out whether the justice system here is up to the challenge of trying a former and would be future president. >> kyle, the filing today from jack smith made quick haste with p

he has pleaded not guilty to those charges, but he was charged alongside one of his longtime aide, waltve added another defendant. his name is carlos. he is a worker down at mar-a-lago. and according to our reporting, he was previously seen on surveillance footage moving boxes that are believed to contain classified materials alongside walt nauta. at this point we don't know what charges may have been filed against carlos. we're waiting for that to be populated here in the live court system. we know down in mar-a-lago even after they charged the former president and walt nauta that the special counsel continued its investigation. we know they have continued to gather evidence. they've even sent out one additional target letter to someone who was not carlos. so we expected that there could potentially be additional charges and possibly additional defendants. we're continuing to watch to see what exactly carlos will be charged with. >> very significant development indeed. paula, stand by. evan, what's your reaction to this? >> this is something that paula was pointing out, carlos is one o
