sandra hughes reports. >> reporter: after serving three years for being an accomplice to rape, warren jeffsurned by the utah supreme court for incorrect jury instructions. >> mr. jeffs should never have been charged with being an accomplice to rape. >> reporter: jeffs, who led the group called the fundamentalist church of jesus christ of latter-day saints is believed to have 70 wives and 100 children. his lawyers say the state just didn't like his religion. prosecutors say that's not it. >> it's only about warren jeffs because he forced a 14-year-old girl to marry her 19-year-old cousin. that is why he was prosecuted. >> reporter: but the high court said prosecutors essentially put the cart before the horse, charging jeffs before they proved the 19-year-old had committed a rape. the utah attorney general is worried. >> what our biggest concern is, obviously, is how do we protect young girls, particularly within close societies, polygamist sects from being forced by their leaders to marry older men? >> reporter: he still faces charges in texas of bigamy and sexual assault of children, stemmi
