wayne hay reports from the capital. >> reporter: ever since the national league for democracy party won november's election, the question has been who will be the next president of myanmar. under the constitution the n.l.d.'s leader aung san suu kyi cannot become the president because there's a clause that states that anyone who has immediate family members who are foreigners cannot take the top job. aung san suu kyi has two sons who are british citizens. since the election we know there have been negotiations betweenment n.l.d. and the military which holds veto power over any constitutional changes. those talks have been around suspending that article of the constitution to allow aung san suu kyi to become president. it seems those talks have failed. speculation centers around a man becoming the president who is not a member of parliament but a member of n.l.d. but is a cloeft confidenta of aung san suu kyi.

wayne hay can tell us more. who is likely to become the president? >> reporter: all signs are that when that vote wraps up in the parliament that it will be the man you mentioned, a 69 year old member of the n.l.d. party. a man with a pretty low-profile, really. certainly internationally. he is close to the party leader and has known her since they went to school together. he is known to be very loyal to her. that's important because while she cannot become president right now, it is believed that the n.l.d. will not give up its hope that she can become president in the future and, in fact, they may make another push to amend the constitution within the next 12 months. if they are successful, then they need someone in place now who is president who is going to be happy to step aside, who is not going to be corrupted by power, if you like, and certainly they believe that they have that man, a loyal man in the form of him >>> if that happens, that change in the constitution, what will aung san suu kyi's role be? >> reporter: it hasn't been made clear.

live to wayne hay who is joining us in neighboring thailand. what can you tell us about the new president of myanmar? >> reporter: well, very little outside of yanggong. little was known about him when he was elected to become the president. he is a 69-year-old man, a long time member of n.l.d. he is not a member of parliament, but he is close to the party leader aung san suu kyi. they have known each other since they went to school together. he is believed to be very close in terms of loyalty, a trust p confidente after aung san suu kyi. that was very important criteria for aung san suu kyi to be able to pick someone to be the president that she could trust and clearly she needed that. she cannot be the president under the existing constitution, something she tried very hard to change, tried to negotiate with the military since november's election to set aside that section of the constitution. clearly those talks failed, so she had to go back to plan b, which was getting someone that she could trust to take up the position of president >>> thi

wayne hay reports from neighboring thailand. >> reporter: in recent years he has called thailand home. the former buddhist monk volunteers at a temple teaching english to be migrant workers. he is also active in myanmar and made regular trips back back to that where his family lives >> translation: for our family, living here is very bad compared to other places. even if we go for an eye check up, they're always following us. >> reporter: he travelled to a city where he was arrested on charges of entering the country illegally. he was going there to collect a new passport. his family believes the case against him is political and is another example of harassment that has seen him jailed several times. he played a leading role in the so-called saffron revolution in 2007. monks protested the government at the time. the following year he was sentenced to 68 years in jail. he was eventually released in 2012 but has suffered mental and physical health problems ever since and needs regular medical attention, something he is not receiving now. >> translation: my brother was tortured a lot in
