joining our discussion now is andrew weissmann, former fbi general counsel.drew, did you ever have occasion to leave out that many potential defendants in a case? especially one as big and central to it as donald trump? >> so this is a bit of a head- scratcher in terms of what is going on here. you know my job is to try to think what are legitimate arguments that could have been in the heads of prosecutors and obviously it is true and it certainly shows that this is hardly a witchhunt with prosecutors out for vengeance against donald trump, given what they represented to the court. and the only thing i could think of, which i think is a really good explanation, is that sometimes if you have a defendant who could be charged federally and in state court, in two jurisdictions, there could be a sort of discussion about it is better to go in one versus the other. certainly a factor that the federal government would consider in deciding whether to bring charges. but here, the reason i don't think that is likely are not a i terribly good argument is that you have a

, former fbi general counsel and co-host of the msnbc podcast "prosecuting donald trump," andrew weissmann. what is jack smith hoping to do here? >> as you said, collision, to get the case back on track. following the supreme court's decision that a president -- any president is immune for official acts, official conduct, the difficulty now is figuring out what is official and what is unofficial, what is in and what is out. with the superseding indictment jack smith and his team proposed to the judge that everything that remains now, everything in the new indictment is unofficial conduct and prosecutable. donald trump's team will contest that and the judge has a difficult task. she still has to make a determination adhering to the supreme court's decision on what is prosecutable, an official act, and nonprosecutable. >> how do you think jack smith's team did in determining what is in and what is out? >> i think he really helped himself. first, he deleted the information that the supreme court required to be taken out, and that is that the court had said the president's interactions within

andrew weissmann, what is amazing about the attack line that something is politically motivated is thedisclose luxury travel. and it's not about where they went. it's not even really about how they got there. it's about the fact that they didn't deign to tell the public about it. what are your thoughts? >> absolutely. i mean, let's just leave aside -- let's assume that senator wyden was politically motivated. so what? the issue is did it happen? i mean, there's no evidence he's doing this just for politics as opposed to the actual facts. but that's just a sideshow. first, people need to understand, you were in government. i was in government. the idea -- you could not give somebody a cup of coffee. this is so beyond the pale. everybody i know who was in government, who was in government, certainly everybody who is a judicial officer understands how this is not just normal, this is a flagrant abuse. you do not go into public service, let alone being an article 3 judge and a judge on the highest court of the land, to make money from other people. and to me this is just a sign of not just

joining me now is andrew weissmann msnbc legal analyst and maya wiley president and ceo of the leadership attorney. that was a lot, friends. i'm going to start with you, andrew, because it's a lot to parse through. >> totally. >> i want to start with whether or not donald trump has any chance of taking that 34-count felony conviction and somehow moving it to federal court in order to throw it out based on what the supreme court has ruled. >> so the direct answer is it is highly unlikely that he is going to be able to get it to federal court. as you noted, he has made that motion -- >> before. >> -- and lost it and the only intervening fact is this supreme court decision that should not be enough to have judge hellerstein revisit his ruling. remember, though, that whether it's in state court or it's in federal court, that changes who the judge is, but whether the supreme court gets to ultimately weigh in on the 34 counts to say were they tainted by immunized system is something from the supreme court of the united states gets to weigh in on eventually. that's what i'm sort of mostly worrie
