joining our discussion now is andrew weissmann, former fbi general counsel.drew, did you ever have occasion to leave out that many potential defendants in a case? especially one as big and central to it as donald trump? >> so this is a bit of a head- scratcher in terms of what is going on here. you know my job is to try to think what are legitimate arguments that could have been in the heads of prosecutors and obviously it is true and it certainly shows that this is hardly a witchhunt with prosecutors out for vengeance against donald trump, given what they represented to the court. and the only thing i could think of, which i think is a really good explanation, is that sometimes if you have a defendant who could be charged federally and in state court, in two jurisdictions, there could be a sort of discussion about it is better to go in one versus the other. certainly a factor that the federal government would consider in deciding whether to bring charges. but here, the reason i don't think that is likely are not a i terribly good argument is that you have a
