wendy davis, what is this like on the ground? there were so many fights and the whole country saw the ridiculous lines to vote in texas. how are your average citizens in austin and houston and dallas, how are they responding to this ridiculous law by the governor? >> we recognize exactly what's happening here. these laws are a way to try to maneuver around the changing electorate rather than trying to solve any problem of fraud. our own secretary of state came forward after this election which by the way donald trump won by 9 points in our state to say that we have had a safe and secure election. she was pretty quickly removed from her position. she's a gubernatorial appointee. people are ready to fight. we know that because we lost the protection of the voting rights act preclearance provision. the lost of those protections and we are going to do everything we can to support the efforts this wonderful congresswoman and others in congress who are fighting to make sure voting right protection are put in place. >> i want to follow

let's discuss this with former texas democratic state senator wendy davis. in 2013, as our viewers might remember, you held an 11-hour filibuster in an attempt to block a law that banned abortions in texas after 20 weeks. this new law bans abortions as early as six weeks, which obviously is before many women even know they're pregnant. how did texas get here? >> it's been a year-after-year legislative session after legislative session creep to this. it had already closed over half of our abortion providers in texas. the supreme court overturned that law, but we've yet to reopen all of them. and so it's already been the case that for many women here in our state, access to abortion has been difficult if not impossible. and a number of abortion providers, supporters have grown up around this issue to help women with costs, with travel costs. but now, of course, women are going to have to travel in most instances 20 times the distance they would have had to travel to the furthest abortion clinic here in our state. and for the 7 million plus women of child-beari

wendy davis, former texas state senator is joining us and mark herrin for center for reproductive rightsrk i want to kind of understand the legal challenges ahead at this point if he has any for dr. braid. >> sure. so there's several cases pending right now. there's the federal lawsuit that's currently pending in court of appeals where the supreme court denied an injunction. justice department filed a lawsuit but this law is in effect for two weeks. over 85% of patients in texas are toned away from exercising the constitutional rights and travel hundreds of miles to go outside the state. clinics in oh states are jam packed with patients from texas. there's a clinic in kansas where half of the patients coming from texas now. the doctor took a courageous act to provide care. he had a duty of care to the patient and provided protected health care and we'll see whether he faces any legal consequences as a result. >> at this point just to be clear i want to understand this accurately. he faces no legal consequences. nobody approached him for suing him for providing this abortion care? >> righ

and wendy davis who filibustered for 11 hours against another restrictive abortion law back in 2013.ment have a strong case here? >> well, they -- it was certainly a powerful and persuasive case. that this law is outrageous, that it conflicts with the constitution. the problem is when you dig into the 27-page complaint, the issue is standing. the issue is does the justice department, under federal law, have the right to bring this lawsuit? because this lawsuit says nothing about the federal government. now, attorney general garland tried to make the case that it has an effect on federal agencies in texas. that may or may not be a persuasive argument to -- to the -- to the courts there. but -- um -- the -- the problem with this whole case from the beginning has been, procedurally, how to get the issue squarely before the court. the supreme court of the united states didn't address it when it allowed the court to go in -- it allowed the law to go into effect. this is an attempt to get the courts to address it. but under the standing rules, i'm not sure it'll be successful. >> senator d

joining us two former texas state senator wendy davis.lain what happened and how big a deal this is and what the ruling means. >> well, a trial court judge in austin, which is travis county, texas, just ruled that planned parenthood could not be sued under this new law for at least two weeks. this is a temporary injunction until september 17th. there is going to be a hearing on september 13th. but unless an appeals court steps in, planned parenthood is insulated from any lawsuits that individuals might file to stop them or punish them for conducting abortions after six weeks. this ruling only applies to planned parenthood. so other institutions, other medical operations, other people who assist women in having abortions could till be sued in this two-week period. for at least for these two weeks, planned parenthood is safe. of course, unless this ruling is overturned by an appeals court. >> so i'm clear, would other people -- under this new law, you know, uber drivers who drive somebody to a planned parenthood, could they be sued? >> atha

let's go back to 2013, the wendy davis filibuster. most restrictive abortion laws in the nation at that time. since that happened back in 2013, we've seen over half of the abortion clinics here in texas close. texas is a huge state. it's as big as some of the northeastern states put together. so what that means is the ability for women for reproductive rights was severely constrained. but the impact really is among women of lower ses, which here in texas means black and brown women. so for these women, they can't just buy a plane ticket and go to a neighboring state that still allows for reproductive rights to be upheld they have to drive to other states and the states around texas are conservative and has loopholes that texas doesn't have. so you have rights of women constrained all over the state and you see the impact of it particularly on women of color. >> victoria, i was going to ask you, what are democrats inside the state of texas we're talking nationally in a minute but inside the state of texas, what recourse do they have? w
