acting attorney general whitaker. i'll remind some of the folks. they were trying to get acting attorney general whitaker here because they were trying to make political points before as the year got started because there was nothing rolling yet. mueller hadn't happened so they couldn't talk about it except in broad generic terms. bill barr wasn't sworn in yet. one week before bill barr was sworn in, we brought in mr. whitaker. we threatened him with a subpoena and made public declaration about a subpoena. until we find out the night before sent him a letter saying if you showed up we won't do a subpoena. so, it's a little bit hard for me to hear how this congress, this committee, and then we're not even going to get started on mr. schiff who, again, loves a camera, loves a microphone, loves his own gavel, but doesn't like to have to answer his own questions about his own work and what he's actually done. he like to have to answer questions. him and mr. goldman last week on who ordered the matching of that so that they could unmask ranking member a

former acting attorney general matthew whitaker with us right now.k this is all going to go? if, for example, the supreme court were to rule or you have to turn all of this over, then what? >> well, i think it's going to be really interesting case to watch because it's going to see if there are limits to congress's oversight abilities. we know that congress, as soon as they get documents, as soon as they would get these tax returns, they would leak them or they would be leaked to the media and that is a very dangerous situation because as you know, tax returns are probably one of the most confidential documents that an american submits to their government, medical records are in that same category of things that, you know, we don't want sort of walking around the street and so, i think this case is going to maybe back fire on the democrats in the house because it could put limits on their oversight ability and i think that would be an unintended consequence of some of the lawsuits that they have going on an all over the country. >> we don't know why

maria: joining us right now is former acting attorney general, matt whitaker.aria: what did you make of that? the president seems to go -- dig in here. he wants a trial in the senate, he says, so that he can see people like adam schiff go under oath, hunter biden, joe biden, but lindsey graham has a different idea. he wants to get through with this pretty quickly. how do you see this playing out? >> well, there is a little bit of a disagreement in the senate as to how they're going to proceed with the trial. as as you know from watching it, mitch mcconnell will have a strong control of this process, he's not going to let it go out of control. at the same time, i'm certain that it will be a more fair process than we saw in the house and these vague articles of impeachment that suggest really that no crimes has been committed, that really there's a policy disagreement or at most just a dislike of the president, i think it's going to -- the american people are going to see a much different process when it gets to the senate. maria: she's very upset about it, don.

. >> bill: we want to bring in matthew whitaker former u.s. acting attorney general. welcome to our program. you heard the news from nancy pelosi. forecast this for us. how does it play out? >> it appears impeachment fever has affected the dems in the house and they'll ignore what the evidence shows. they'll ignore an ability to get more evidence and use the legitimate constitutional process of all three branches who are co-equal and independent and they'll move forward. it is really a sad day for america. it is i think going to hurt people's christmas experience because this is going to be playing in the background instead of bing crosby's christmas album we'll have impeachment. >> bill: that was the way it was in 1998. you said turley did significant damage to the democratic case yesterday. why do you say that knowing they've got the majority and do you think they have the votes to proceed? >> by putting him on the same panel as their three witnesses they gave turley equal weight to his testimony. he was calm, persuasive and poked holes in many of their theories inc
