okay, whitney, let's talk about the subpoenas, who is complying and who isn't here? >> well, of a list of basically rally organizers we know, a minimum of five of them are actively giving over to the committee the documents that they're looking for. so these are people who would have been at the very nucleus of the rally that preceded the riot. what we know now is that other people of these trump allies are engaging with the committee, though it is unclear what engagement means. so that's where we're going to find out a lot more about today. we know, again, steve bannon, not going to comply. there is still a big question mark over kash patel, because we know that he's been engaging with the committee, we don't know what the result is going to be with his deposition. so that's the big question. this week will be extremely telling. and really the committee is going to have a moment where they're going to have to decide how hard they're going to go here and they made it very clear they're willing to explore every option available to them and that will include criminal c

cnn law enforcement correspondent whitney wild joins me now. the committee chose to delay deadlines to respond for meadows, scavino and patel as it pursues bannon. how long are those delayed and would they face the same, the same potential charges if they refuse? >> if in the end they decide they're going to completely defy the subpoena, i think the committee made very clear they're willing to exercise as much severity when it comes to those three as they have with bannon. let's look at the bannon timeline. so what we know now is the committee is planning to hold a business meeting on tuesday of next week, then they will assume -- we assume advance this referral out of committee, send it to the house floor for a vote where it will end up at the department of justice. there is still a chance there is prosecutorial discretion, but at this point the house sending referral to the department of justice is, you know, for them, a compelling reason to at least very strongly consider moving forward with this criminal contempt. and the reality is here, t

cnn law enforcement correspondent whitney wild ask joining us with details. what is this whistleblower saying? >> the letter obtained by cnn and reported by politico claims that two of the top u.s. capitol police officers failed to act on january 6th as violence unfolded. the letter also says former acting chief yogananda pittman lied to congress earlier this year. the whistleblower says in this letter that a high ranking officer with 31 years at capitol police. this person came forward because pittman and sean gallagher played a role in disciplining officers for actions on january 6th, but this whistleblower feels they were never personally held fully accountable. some of the allegations mirrored conclusions of other reports but this letter takes aim at pittman and gallagher and accuses congress of failing to investigate their missteps, wolf. >> one major issue raised is the allegation that assistant chief pittman hasn't been honest about how the threat, the intelligence was shared. >> that's right. specifically the whistleblower is taking issue with what sh

whitney wild joins us. you look at this.s, as i have said before, this message to bannon was also meant to be a message for anyone planning to defy the subpoenas. there's an expectation people are supposed to be handing over documents this week and next week. the assumption is those documents are rolling in. several people know many of the people who have been subpoenaed are cooperating, and by cooperating we mean actually giving the committee what they're looking for. when we're talking about the department of justice, there are steps until they get to the point where steve bannon might face a criminal contempt charge. first it goes to the u.s. attorney's office in d.c. it will certainly have to be signed off on by main justice, specifically attorney general merrick garland. there's a possibility it could go to grand jury, a possibility they could move forward with the criminal charge. we don't kno logistics. there are points this could all dissolve. it could be the justice department says we're not doing it. >> there are o

whitney wile, appreciate it, thank you. let's bring in asha rangappa.to go back to this renewed discussion of executive privilege since we're having it a lot. in this specific instance, right, because the former president is no longer in office, joe biden is now, we talk about executive privilege, does that work here? >> so, the exact parameters of executive privilege aren't completely clear. but it is generally accepted that the privilege is held by the sitting president. so, you know, trump is on very weak ground as a former president trying to invoke this. there is a lot of precedent for sitting administrations to hand over documents or get permission for prior administration officials to testify, so going back to the church hearings in the 1970s with ford and nixon, after 9/11, the bush administration gave over documents from the clinton administration, and then the obama administration, of course, cooperated with congress about torture. so there is a lot of precedent here, but, you know, normally these are negotiated between congress and the execut

whitney wild joins us now. listen, congress is moving forward here to hold bannon accountable for defying the subpoena. tell us what happens now and what happens next. >> reporter: so tonight, 7:30, anybody can watch this, it will be live streamed, the committee will vote on this criminal contempt referral. then it goes to the house for a vote then to the department of justice. the chances that the most extreme punishment will be levied against bannon are slim. if things get jammed up in appeal, the time line begins to be extended. but what the committee is looking for here is leverage. they are trying to throw the book at steve bannon because they want his testimony. they believe he was at the nexus of this big election lie that preceded the rally that preceded the riot. they want to know who he spoke with, the intention of the rally, what was leading up to the rally and the violence. what is notable about this information is for the first time we're seeing steve bannon's full subpoena. before we had a two-pag

let's bring in whitney wild. whitney, why can they not find dan scavino?ld think that would not be that difficult? >> it's the big question because he's out there on social media tweeting away. but the bigger question here is when are they going to find him? because there's this deadline for october 7th. that was when all of these people were supposed to supply the committee with relevant documents. then he was supposed to come in on october 15th for a deposition -- i should say virtually or in person. and that date is by design. he was one of the last people they wanted to speak with. so other people that were subpoenaed were to come in on the 14th. what the committee is trying to do is get all the information first and then ask these relevant questions later. this is making this timeline a little stickier for them because they need, in theory, to have these informed questions. they want the documents first and also want to know for sure that people know they've been subpoenaed. it's hard to believe he wouldn't know that with all of the media coverage but
