cnn law enforcement correspondent whitney wild is following this story. whitney, it is becoming more and more convoluted and, you know, hard to decipher here, but the national archives has asked the doj to look at the former president's handling of records. has the doj now responded? >> the justice department has declined to comment, but what is important to remember here is to understand the landscape, national archives requested the doj look this. what they want is for a federal prosecutor to decide was this casual, was it just sloppy, or was this into criminal space? again, trying to push that responsibility off on to federal prosecutors, but the reality is not all referrals that go to the justice department end up as prosecutions. sometimes they don't even take it. so this is still an extremely opaque territory, but it is an example of something that the national archives finds so troubling, they're trying to have somebody, a professional figure out whether or not this is criminal. meanwhile, as you pointed out, we have this new reporting from our col

so whitney, would this be a violation of the presidential records act? >> well, that is the biggest question right now. was this just sloppy or sinister? and we know it's going to be really difficult for people in trump's camp to try to make the argument they simply didn't know because as we reported for months, there are many examples of attorneys telling people within the trump administration you must keep these documents for the presidential records act. "the washington post" is reporting that these national archivists went out to mar-a-lago to retrieve records trump apparently took down with him to his florida resort that would include, bianna, letters with him and world leaders like kim jong-un, hard to argue that would not be considered a presidential record when you consider that the law specifically says that these records should also contain letters. so the presidential records act lays out examples and memos, letters, notes, those are all supposed to be handed over once an administration concludes. now the question is, what do those records sho

cnn law enforcement correspondent whitney wild is following all of the latest developments. whitney, let's start with this new reporting related to the national archives discovery and reaching out to the doj hoere. what do we know? >> reporter: it's not clear if they'll launch a formal investigation. the reality is the vast majority of these referrals to the department do not end up as a formal investigation. in a statement wednesday, the archives said we do not comment on potential or ongoing investigations. the request came after recent revelations that the national archives had to retreat 15 boxes of records that end up with trump at mar-a-lago, his florida resort and other documents given to the archives were torn up and had to be pieced back together. this is obviously a totality so troubling to the national archives that they are asking the doj to take a look at this, they want formal prosecutors to decide whether or not this was going to be simply sloppy or whether or not this is something in a more criminal space, jim and bianna. >> whitney wild, thank you. let's dis
