bottom line, did william porter help his case?reporter: you know, that's obviously his demeanor. as he was testifying, he was calm, he was real, down to earth. some of his answers appeared a little rehearsed, based on my experience and just some words that maybe were given to him to say. on cross-examination he didn't really become defensive, except for that one area when he was asked about the code of silence when it came to identifying other officers on the scene on april 12th when freddie gray was put into that transport van. he couldn't remember one of the officers that initially helped. he said, i'm insulted by that. i can't remember. i can tell you it was a white officer and he was slim. but right now, timothy longo is on the stand. that is the chief of police of charlottesville, virginia. you might remember the hannah graham case last year when she went missing and it was timothy longo that was at the forefront of the missing persons case. now the defense has called him, conceivably to be that expert, that officer who is in

a jury has been seated in the trial of officer william porter. he is the first of six officers to go to trial. our sam swinney is in the ewsroom. >> they started with 150 potential jurors. eight women, four men and four male alternates. these jurors went through a lot of scrutiny. the trick was to find a jury and it would be almost impossible to find a juror that did not know about this case. william porter was the first officer charged with the death of gray and prosecutors say he ignored depray's pleas for medical help from the back of that van. they say if the prosecutors fail to convict in this case it would be nearly impossible in the upcoming trials and opening statements are likely to begin shortly. my colleague brad bell is inside that courtroom. we will have updates beginning at 4:00 p.m. jummy: sam, thank you. now we turn to the war on terror. defense secretary ash carter announcing a new plan putting special forces on the ground to carry out missions in iraq and syria. we have the latest on the new military action. >> two of the world'

. >>> william porter is going on trial in this connection with the death of freddie gray in april.ohn we're getting word that the jury has been selected now. what can you tell us? >> reporter: yes, good morning from a rainy baltimore, del, the news is that the judge has its jury, and he did it in remarkably quick time. interviewing personally 75 jurors on monday, and another 75 yesterday, tuesday, because he did the voir dire as it is known behind closed doors, we have no idea what questions he asked, but now he has a panel that is acceptable to him, the prosecution, and the defense. and the news is that the panel is predominantly female and predominantly african american. the four alternates are all male. three are white, and one is african american. so now we have the jury in place. the other jurors thanked them for their service and thanked them for their ability to be fair, and now we wait the beginning of the trial of officer william porter, it will come no doubt sometime this afternoon, del. >> john, on that note, do we know how long this trial might last? >> reporter: we do.

the jury was unable to agree on all four charges that william porter faced.he judge announced that that was the case. the jury had actually gone back a fee times and requested that they get transcripts of various witness testimonies. the judge declined those requests. we were already getting an indication. yesterday, they said they could not make up their minds. we had an indication that although they went back for more deliberation -- what happens next? there are six officers in total that have been charged over the death of freddie gray. what the prosecutors wanted to do with officer porter's testimony is use him as a witness in the other trials. he could face a trial after those trials. the next trials will begin in january, meaning he could not be a material witness. it sounds complicated, but it means it could be a setback for the prosecution. katty: talk to me about baltimore. is it tense? what are they anticipating tonight? rajini: at the moment it is relatively calm. throughout the trial there only been a handful of protesters. i think i counted 4 or
