you do see the defendants, travis mcmichael, gregory mchighle and william roddie bryan along with theirthe pledge has entered the courtroom. danny, the -- the judges -- i'm sorry. the defense attorneys, one in particular, the defense attorney for roddie bryan had been calling for a mistrial over and over and over again. is he trying to lay the ground work for an appeal? >> this might have been some high-level chess by making this reference -- >> he made it very specifically about race over and over again. >> right. and predictably the backlash led to 100 black pastors to congregate at the trial. he may be setting up for an argument on appeal that the atmosphere was circus like at this trial denying his client the right to a fair trial. the condition i use "circus-like" is what the supreme court used. but that trial was one in which the level of publicity went to the point that it denied a defendant a fair trial. it is very rare. >> cal, has it been circus-like out there? >> i'm sorry. say again. has it been what? >> circus-like out there as the defense attorney has been trying to claim?

it seems as if you think william "roddie" bryan may have a decent shot at acquittal. why? >> william "roddie" bryan has a path to acquittal in this case because the evidence that came out at trial was essentially there was no cooperation, no discussion with the other defendants that bryan got in his car, he followed arbery, he videotaped. he did not possess a gun. the defendant's marshalled the evidence to show it's possible that he wasn't even aware that the defendants had firearms, let alone they would use them and confront arbery with them. so i think, in closing, bryan's attorney has given the jury enough to say, well, maybe these two defendants with the guns are responsible, but the guy who was essentially rubber necking, following this entire incident, there may not be enough evidence, at least not beyond a reason able doubt, that he was a coparty with these other defendants. >> danny, before we heard the jury instructions, it also seemed as if the prosecution was being very methodical in her approach to speaking to the jury, telling them precisely what she wanted the

. >> reporter: gregory mcmichael, his son travis and a neighbor william "roddie" bryan face nine counts each, including murder, aggravated assault and attempted kidnapping accused of chasing, shooting and killing ahmaud arbery. they have all pleaded not guilty now, after questioning hundreds of potential jurors in a county that's about 26% black, 11 white and 1 black juror selected the defense using its legal challenges to eliminate 11 potential black jurors from the jury pool on the final day. >> this court has found that there appears to be intentional discrimination. >> reporter: he added georgia law prevents him from taking action because the attorneys gave reasons other than race for the dismissals like insisting the perspective jurors could not be impartial. >> that's really what the court is to decide are those race neutral explanations that were offered, are they satisfactory and in this case, the judge said he did find them to be satisfactory. >> reporter: now prosecutors expected to cite arbery's race as a significant factor in his death and the defendants are expected to say
