william simma in a shooting that the prosecutors said was motivated by hate. the suspect was arrested in monterey county after a domestic dispute. sheriffs investigators said the man pulled the trigger and killed simms on november 12th. the arrest comes during a preliminary hearing for a second defendant. a witness testified that the man was inside of the bar, during a confrantation in the bar, porter, kelly is -- confrontation in the bar, porter, kelly and one other man started to punch simms. then one of the suspect opened fire hitting the victim on the head. simms' family was in court for the testimony. >> it was a challenge for them to hear the details but they want to know what happened to their son and why. >> reporter: kelly's attorney said the evidence points away from his client. >> i hope that everyone, including the prosecution realize that he had nothing to do with the shooting. you just heard two days of testimony from an officer that said a witness saw a fight that kelly had nothing to do with. >> reporter: the hearing continues tomorrow and a judge is expected to rule on whether or not he will stand trial. >> any idea if they are searching for the third suspect? >> reporter: sheriffs
