chris gordon reports on what happened next. >> reporter: judge barry williams denied the defense motiono dismiss all four charges against baltimore police officer edward nero. the judge said at this point the law requires him to view the evidence in the light most favorable to the state. prosecutors thought that by compelling fellow bike patrol officer garrett miller to testify he would help prove the charges in nero, but it apparently backfired. >> i think officer miller did a tremendous job on behalf of the defense. i'm not sure what the state has been able to elicit favorably for the state through officer miller. >> reporter: officer miller testified with immunity, meaning nothing he said can be used against him because he will stand trial in july on the same charges as officer nero. miller testified that it was he, not nero, who stopped and handcuffed freddie gray after a foot chase on april 12th, 2015. nero is charged with assault, but miller says he moved gray, not nero, who only touched gray to help him find an asthma inhaler. miller testified he thought the patrol wagon driver i

gordon, news 4. >> prosecutors are asking that a 17-year-old accused of murder be tried as an adult. that news just in from prince william county court. police say the teen killed 14-year-old eric kokocrespo last week. prosecutors call it a serious and heinous crime. the 17-year-old will be back in court next month ncht right now jury selection is underway for a fairfax county lawyer accused of terrorizing a mcclain couple. andrew schmuhl charged with abduction and malicious wounding for a 2014 attack on another lawyer and his wife. schmuhl's wife faces the same charges but be tried separately. at the time of the attack she had just been fired from the victim's law firm. news 4's northern virginia bureau chief julie carey has covered this story from the beginning. she's in the courtroom right now. follow her on twitter for updates on this case. >>> a woman killed in connection with the maryland shopping center shootings will be remembered today as a beloved chemistry teacher who pushed her students to do their best. tonight there will be a individual vigil for gladys. police say two weeks ago her estranged husband shot h

gordon is live in baltimore now. chris, tell us more about this verdict and what it means. >> reporter: well, i was in the courtroom, judge barry williams gave a well-reasoned opinion. it took about a half an hour for him to read. he went through each charge on assault he said that it was not officer nero who did the touching when freddie gray ran and was stopped and cuffed. that was another officer, garrett miller. therefore there was not enough evidence to prove assault or misconduct for the assault. and then there was the reckless endangerment that officer miller failed to seat belt freddie gray in a van where he sustained a broken neck, which led to his death. in this case the judge said that the reasonable officer could have assumed that a superior inside that van would have taken responsibility for belting, or ultimately is responsible and that a change in general orders which mandated seat belting freddie gray was not necessarily read by this officer. so the judge found him not guilty of assault, reckless endangerment and two counts of misconduct. and joining me now is the attorney for freddie gray's family, billie murphy. will y
