this is 56-year-old william gordon. he was the only one onboard. this video, awful. you can see this here showing the moment that this plane crashed and there are even some witness whose say that they saw the pilot struggling to get out. rachel crane is following the story from new york, and rachel, i guess people, they were able to see him try to get out, was there any sense that he could be rescued? >> reporter: well, there was an individual on a sailboat here in the hudson river who did jump into the water, and try and attempt to help the pilot. unfortunately, he was unsuccessful. this is a very populated portion of the hudson river. there is restaurants on both sides. there's running paths. so a lot of people did witness this crash. now, the nypd and the army corps of engineers recovered the plane just a few hours ago. that happened right behind me, lifting up the plane via a crane. you can see in the images it was relatively intact. that plane taken to the wall street heliport where the faa continued their investigation and the ntsb will begin theirs next week.

gordon is live in baltimore now. chris, tell us more about this verdict and what it means. >> reporter: well, i was in the courtroom, judge barry williams gave a well-reasoned opinion. it took about a half an hour for him to read. he went through each charge on assault he said that it was not officer nero who did the touching when freddie gray ran and was stopped and cuffed. that was another officer, garrett miller. therefore there was not enough evidence to prove assault or misconduct for the assault. and then there was the reckless endangerment that officer miller failed to seat belt freddie gray in a van where he sustained a broken neck, which led to his death. in this case the judge said that the reasonable officer could have assumed that a superior inside that van would have taken responsibility for belting, or ultimately is responsible and that a change in general orders which mandated seat belting freddie gray was not necessarily read by this officer. so the judge found him not guilty of assault, reckless endangerment and two counts of misconduct. and joining me now is the attorney for freddie gray's family, billie murphy. will y
