trump's lawyers moved to disqualify fulton county da fani willis.on county superior court that the special grand jury investigation was, quote, confusing, flawed and, at times blatantly unconstitutional. and since then, little has happened. for about three months, there has not been a ruling. and now we are just over two weeks away from the start of the time period that dea da willis laid out. highlighted here are the day she could possibly file a criminal indictment against donald trump. and, as a result, trump's team is acting with, shall we say, greater urgency. today, trump's lawyers filed petitions into georgia courts, that's a in fulton county superior court they filed a petition in last march, and the georgia supreme court, which is the states highest court. and the point of these petitions was to ask for the same faith again, who shut down fani willis's investigation. team trump argues that her probe was unconstitutional, and causes, quote, injuries to trump as he seeks his party's nomination for the presidency. trump also wants to forbid th

i don't like to be in a courtroom unprepared. >> reporter: it's in that vein that willis requested a special purpose grand jury to assist in her investigation. >> special purpose grand juries are very, very, very rare in georgia. >> reporter: robert james is one of the few district attorneys who has overseen a special purpose grand jury in georgia. >> their own powers are much broader than a regular grand jury's. >> reporter: while a special purpose grand jury doesn't issue indictments, it can be a useful tool for a prosecutor. >> the d.a. wanted it because she wanted to use the powers to subpoena people, to get evidence, documented evidence that she wouldn't otherwise have access to. allegations that she was investigating. >> reporter: a special purpose grand jury was impaneled in may 2022. and after nearly seven months and 75 witnesses they authored a report in december 2022 recommending indictments. the sprawling case has involved some of the biggest names in the trump orbit, as well as some local and state-level politicians, many of which you may have never even heard of. and thi

fani willis is at the state level, jack smith at the federal level.er of them will conflict with mat the other is doing. photographs from a security standpoint and timing standpoint, they might seek to coordinate with one another. >> would more indictments, charles, create complications for the other cases already proceeding, the classified documents case, e. jean carroll case, u.s. fraud investigation. all of those have court dates on the calendar for the former president. if you are trump's lawyers, how in the world do you defend against all of this? >> that's a great question. i think the answers are tied into one another. first and foremost, because of judge cannon's may 20th, 2024 ruling in the mar-a-lago case, if i'm donald trump's attorneys, i'm going to be using that case for the benchmark for every other case that might come up, every other indictment. i'm going to be using that initial date to try to serve as the benchmark going forward for anything else that comes after it. why? that's the best opportunity i'm going to have to delay things

>> yeah, good questions, willie. generally speaking, the burden of proof is always with the government. it never passes to a defendant in a criminal case. a government has to prove its case unanimously by proof beyond a reasonable doubt. but what is the thing that they have to prove? generally speaking, it's that somebody acted with intent corruptly, right? making a mistake, an accident, negligence, all of those things are bad, but none of those things are criminal. to show that mr. trump, his minions or conspirators tried to defraud the u.s. government, perhaps, or that they tried to obstruct an official proceeding, that would be the counting of the electoral vote, they would have to show these people acted with intent. that's hard to prove. in order to prove intent, you have to crawl into someone's mind. one way you do that, of course, is to talk to people around the defendant. we saw reporting in "the new york times" and other outlets recently that a number of people near to mr. trump when he was still president w

fani willis is obviously looking at things that happen in georgia. call to the secretary of state, brad raffensperger. the ducey call though, to the extent that it follows the same playbook. she could use that in the same way that jack smith is using the fact that the former president allegedly, in the smith telling, was showing off a classified documents to a group of people. he did not charge that in the indictments, but it tells a story and it shows a pattern of behavior. it shows that this stuff is not on accident. it's not a coincidence. it's all part of the same scheme. so that's why to the extent that willis uses that door to the extent the jack smith uses things that happen in georgia, i think it tells a coherent story. and is certainly appealing to a jury to the extent that gets that far. >> when do you think we should expect a potential charges in either of these cases? look laura, you are very well. sourced in fani willis in georgia are specifically sent out memos in march and her office said something again in may. asking the court to not
