our thanks to you and zach cohen who is in d.c. joining me is retired air force colonel and cnn military analyst cedric leighton. great to see you, as always. it want to talk to you about these attacks that involved that u.s. ship. does it appear these attacks were trying to do damage, or was this about trying to test the u.s. and just be provacative in a way? >> it might be both actually. my understanding from the reporting that we've seen is that the missiles that the houthis sent in the direction of the civilian ship, that came pretty close. so that -- that would indicate there was a deliberate attempt to do some damage. the ship in question, called the m.b. unity explorer, that is a bahamian-flagged vessel. it's also owned, in part, by an israeli entity. the houthis are clearly looking at this as a possibility for doing some economic damage to the israelis. as far as they're concerned, it doesn't hurt from their perspective to put at risk u.s. naval forces. i think that's what we're seeing there. they want to send a message tha

zach cohen and ivan watson are following the latest on this situation. let's start first with zach and talk about what more we know about this attack. >> reporter: u.s. official saying both of the drones belonged to iranian backed houthi rebels in yemen. first was shot down as it flew towards an american warship. at that very moment, u.s. officials saying that the warship's crew saw a ballistic missile launched and land in the vicinity of a commercial ship that was sailing nearby. as the american warship responded to the distress call of that commercial ship, u.s. officials say another drone flew toward both ships and subsequently shot down by an american destroyer. this is just the latest in a series of incidents like this in the red sea and across the middle east since the october 7 attack in israel by the terror group hamas. and u.s. officials and u.s. military deployed these ships, this carrier strike group, to the region in an effort to deter iran and other of its proxies including the houthi rebels from expanding the war that is happening in israel

zach >> and kristen. thankfully the evacuation warnings that were in place here in santa cruz county have been lifted just under an hour ago. but it's been a difficult day for the county. and once again, capitola village is not an exception. we're on the esplanade right now where the oceanfront businesses are, businesses that are once again in recovery mode. jeff lantis is nearly back to square one, and his capitola business, the sandbar. it was devastated by january's high surf, forcing it to close for six months. now, almost a year later, high waves are once again flooding the village. the day before. this damaged, the city of capitola put in sand barriers trying to protect the businesses. initially helpful, the protection didn't last very long, helped block us a bit, but one day is all it takes for this to be cleared out now. thursday. much of the repairs made by lantis have been undone. >> our floor is ruined. it'll take at least a month to repair. i would think the high surf forcing evacuation warnin

zach, i appreciate that. now let's go to meteorologist roberta gonzalez. roberta, the rain still really coming down out there. yes, it has moved out of the santa cruz mountains. >> just very light there where zach is now and is traversing in an easterly direction. let's show you the size of this mammoth system that streams from actually seattle all the way into monterey bay and carmel and as we zoom on in, you can see the front is still slicing through the eastern portion of our bay area, but behind it there, the waves are building again, right now, 13 to 17ft off our shore. but it is a pretty impressive northwest swell that will make those waves build to mountains up to 33ft. anticipated remember, bodega bay had a 28 foot wave just yesterday and this is why we have a high surf warning in effect until tomorrow afternoon. in addition to the coastal flood warning, because we have a lot of this water lapping on shore now. sure, the waves will begin to back off on sunday just a bit, but they're still mighty high now we go from the ocean to the mountains, where

paula reid and zach cohen are here to discuss. also with us is correspondent for law fair, thank you for being with us. zach, talk to us about what's been happening inside the courtroom today. >> if hearing from trump's lawyers is the main event of today, the warm-up act has been one of the lawyers for his fellow codefendant also charged in this case. that's david schaffer, the top fake elector in georgia. he's accused of organizing all of these fake electors to sign those certificates and sending them to congress. schaffer's attorney is arguing there were no fake electors because they weren't fake. they were contingent electors. and really they were just on standby because donald trump was still trying to fight this out in court. if that sounds familiar, we have heard this before from the same attorney who argued this same point. they move to federal court unsuccessfully. now the federal judge was not having this argument. it would be interest figure the judge is more receptive to it. we are still waiting to see the main event to

joining me now is cnn's zach cohen. so zach, the trump campaign is responding tonight. what are they saying? >> yeah. as you meninged the trump campaign and maine's republican party saying they will quickly appeal this decision in state court and fight this all the way to the u.s. supreme court. we are hearing familiar attacks against maine's secretary of state directly. she is accused of being a partisan actor. it is important to remember this is not happening in a vacuum as the secretary of state mentioned. she was required to hold this hearing and in her decision, she writes that the challengers presented evidence made clear to her that trump engaged in an insurrection. that aligns closely with what we heard from colorado's supreme court. that decision will ultimately be appealed to the supreme court. and, we do expect the supreme court will ultimately have the last say over this. but the decision by maine's secretary of state is a big win for these trump critics who have said trump engaged in an insurrection under the 14th amendment. he should not be on the state's

. >> zach cohen, thank you very much. joining us now with more, cnn senior legal analyst elie honig. elie, you never cower. that's why we like you here at cnn. but it sounds like trump is backing down from fighting this out on the witness stand. what do you think? >> yeah, jim. this is the smart move, or i guess i should say the least self-destructive move for a couple reasons. first of all, as zach just said, trump has already lost a piece of this case. the judge has already ruled against donald trump for the a.g. on one of the causes of action. it's not as if donald trump's testimony was going to get the judge to reverse himself. the other thing is donald trump already testified in this case. he was called to the stand as one of the a.g.'s witnesses. that did not go well for donald trump. his testimony was all over the map, was nonresponsive, as timed was self-contradictory. so looking at this from a lawyer's point of view, there is no reason for him to get up on the stand. politics and p.r.-wise, that's not my area. bu

abc seven news south bay reporter zach fuentes was in court today and tells us what happened. >> they trusted these people. they not only were responsive for these children, they were being paid for it. >> it was a difficult day in court wednesday for this woman who says she is the grandmother of one year old payton cobb, cobb and lillian hannon, who was also one year old, both drowned on october second in a backyard pool at this san jose at home daycare. one other child was also found in the pool and survived. >> nobody sends kids out into the backyard. three toddlers to play by themselves. those defendants are nina feticide and her mother, shaheen glaucescens. >> both owners of the daycare, the santa clara county da's office said globicornis went to another. unlike licensed daycare that day, she left four children with feticide, according to the investigation report, golovkin's husband, propped open the pool gate with a closed hanging rack and did not close it while feticide was making breakfast. she left one child in a crib and three others in the backyard area. unsuper advised. in

abc7 news south bay reporter zach fuentes has the story. >> the silvery towers in downtown san jose nearpedro square. stand tall today, but the construction of them more than five years ago led to controversy. tsay, a subcontractor from hayward, was accused of recruiting undocumented mexican workers, forcing them to work more than 24 hours at a time. and not paying them proper wages. they also lived and worked in unsafe conditions as they were in a shipping container like warehouse where they were locked in at night after a federal investigation, the hayward man was convicted and received a prison sentence. ruth silverton is part of the santa clara county wage theft coalition and the south bay coalition to end human trafficking. she was there five years ago to offer services to the workers in 2021. she says the wage theft coalition found that more than 12,000 santa clara county construction workers were victims of wage theft. wage theft is really when employers do not pay workers, they don't pay them the wages they're owed. >> they don't pay them overtime. they make them work off the clo

mike zac sos live tonight in oakland. >> zach, thank you. in the south bay, san jose police are now investigating the city's 31st homicide of the year. officers say they were called yesterday afternoon to a home on thelma way not far from kelly park. when they arrived, they found a woman who they say had obvious signs of physical trauma. she was pronounced dead at the scene. police have not yet publicly identified a suspect or the circumstances of her death remain under investigation. >> nearly $150,000 worth of stolen goods seized in the east bay. coming up, the extensive investigation that ended in an arrest. but then there's some rain in the five day forecast. >> also behind me, you can see the fog, dense fog advisory around the area. that'll impact the morning commute. i'll have the forecast coming up. >> and cracking down on car break-ins. the new numbers from san francisco police and the strategies they say are now working investigators say they served several search warrants in various parts of oakland. ktvu is amber lee joins us now

zach thank you. staying in the city, san francisco's mayor says people refused shelter more than half of the time during street outreach operations last month. the mayor says workers contacted 350 people at encampments in november, 117 accepted shelter, 20 were already housed and 213 refused to accept help. that is, 60% of those contacted. and the release of these numbers comes as the city is appealing an injunction over the treatment of people in encampments. the ruling requires the city to offer shelter before clearing out an encampment. >> new at ten tonight, we are hearing from coworkers of a security guard shot and killed at a 7-eleven store in oakland last week. they say he was like family to them. ktvu is amber lee joins us now. she's in oakland and amber. the victim james johnson, had been transitioning out of homelessness. >> that's right, julie. coworkers and neighbors tell me they're stunned by the killing and they want the person caught and held accountable. surveillance video obtained by
