fbi director, aaron zebley at the intelligence committee testimony, zebley will be sworn in. so mueller will be sworn in for his testimony and zebley will be sworn in to testify as well. and that means that the expectation is that at the intelligence committee tomorrow, aaron zebley will be answering questions from members of that committee alongside mueller. now, again, that's the second hearing tomorrow. the first hearing we still don't have clarity. as far as we understand it, with the judiciary committee what we think is going to happen is that mueller will be sworn in and zebley will be sitting there with him, but zebley himself won't be sworn in. he will be there basically as a counselor, as an adviser to mueller. that means that mueller will be the one answering all the questions in the first round with judiciary tomorrow and zebley can speak in his ear and can advise him what to say, but zebley himself won't be sworn in and directly asking questions. that will be the case for the morning and in the afternoon zebley and mueller will both be witnesses and both be testif

aaron zebley first worked with robert mueller when mueller was the director of the fbi and zebley was his fbi chief of staff. he then joined the same private law firm that robert mueller joined and left that law firm with robert mueller to work at the special counsel's office where aaron zebley was the deputy special counsel. aaron zebley had wide-ranging responsibilities oversees the entire mueller investigation. volume i and volume ii of the report. and he was the primary go-between with the justice department. that puts aaron zebley in a position to know everything about the mueller deep's communications with deputy attorney general rod rosenstein, who was supervising the investigation, and then attorney general william barr when he took over the supervision of the investigation. the chairman of the judiciary committee and the intelligence committee both said today that they believe robert mueller does not have to comply with the restrictions on his testimony that appeared in last night's letter from the justice department to robert mueller. >> i think it's incredibly arrogant of t

zebley we have less of a read on. now democrats are betting even if we hear nothing new, hearing it on television will finally get americans' attention. polls show only one in ten americans ever read the report. seeing it on tv could be more influential. just look what happened when attorney general bill barr gave the world his impression of the mueller report, before anybody could actually read it. many people took barr's interpretation as gospel and believed the report clears the president. it does nothing of the sort, but barr said it on television. so if this is all you saw of the mueller report, you may think the report cleared the president. the truth is much more nuanced. summarizing 448 pages in a couple of bullet points the report says the russians interfered, the trump campaign knew about it, benefitted from it, but the special counsel lacked the evidence to prove conspiracy in court. it did establish the trump administration impeded and interfered with the investigation, but mueller's team concluded it was

what's unusual here is the fact that zebley was part of this investigation. he was, as the statement from the spokesman said, had day-to-day oversight. he's also a witness essentially, wolf. if you're the president's lawyers, you have to wonder whether the answers zebley is giving to mueller, if he asks for them, are zebley's point of view that are different from mueller's. it does create an odd situation that is not exactly normal for these types of situations. so i think it does raise some concern if you're the president's lawyers as to what exactly is happening behind the scenes here and whether this changes the tenor of tomorrow's hearing as far as the president is concerned. >> like mueller, zebley is now a private citizen. you are not necessarily bound by any gag orders from the department of justice. >> he is not. the justice department is objecting to this testimony, but he's a private citizen and can ignore that. again, the difference know. and so that's what this creates. >> you think mueller will be whispering in his ear asking for some advice? i d

tonight a spokesman for mueller said aaron zebley was a deputy special counsel. he will accompany special counsel mueller to the hearing as was discussed more than a week ago. mueller's more than 148-page report clearly shows conduct by the president that at the absolutely most charitable, if you really bend over backwards, demonstrates a profound failure to uphold his oath to faithfully execute the laws of the united states. at the worst, it constitutes not only high crimes and misdemeanors, but actual crimes. for all the coverage we've seen about how the american people haven't read the mueller report and don't care about it and don't know what's going on, a quinnipiac poll taken just after the poll was released found 57% of voters said trump committed crimes before he became president. 54% said trump attempted to derail or obstruct the investigation into the russian interference in the 2016 election. and 51% said the mueller report did not clear trump of any wrongdoing. but that was almost three months ago. at a certain point the idea tomorrow for this spectac
