jeff zeleny, thank you. >>> let's hear from elie honig, walk us through this.s the 14th amendment apply here and what got us to the colorado supreme court? >> always a good idea to start with the actual constitution itself, we're talking about the 14th amendment, ratified in 1868, after the civil war. section 3 tells us no person shall hold any office who shall have engaged in insurrection or rebellion, makes sense, fairly straightforward. it gets more complicated when we get to the question of how does this work? if we jump ahead to section 5 of the same 14th amendment, it tells us that congress shall have the power to enforce by appropriate legislation the provisions of this article. congress here, means the federal, united states congress, they can pass laws to enforce this, but they haven't done so in 150 years, which leaves us in a little bit of uncertainty. nonetheless, the colorado state court has a state law proceeding under colorado law that they can use in some circumstances, not specific to insurrection, on election questions. >> makes a difference i

cnn's jeff zeleny joins us now. what can you tell us about this decision from the haley campaign? >> reporter: we can say nikki haley, the former governor of south carolina and the former u.n. ambassador, is agreeing to participate. she's doing more than that. she is noticed that the field is getting small er. she said it's getting harder for donald trump to hide. so as she accepted this debate invitation just days before the iowa caucuses, she's trying to persuade donald trump to come into this debate, or make clear that this her words, he's afraid to debate. we will see. he's made a decision by decision every debate throughout the fall. he's not attended. that's served him just fine. he's in a commanding lead of this race. something would have to change for him to jump in. what this is going to shine a light on is is that race for second place. between nikki haley and ron desantis. and this is the criteria for that debate. each of the candidates must have at least 10% in 3 polls. the qualifying window is january 2nd, so some of the other candidates like vivek ramaswamy out there

let's break down the numbers with cnn's jeff zeleny.e will expand more on georgia and michigan in a moment, but let's go to the polling in iowa because as i said, all that is contingent on trump becoming the nominee, the new numbers out of iowa don't dissuade anyone that he likely will become the nominee. >> they sure don't they show a commanding lead in a widening lead. the reason this matters is five weeks from tonight on the iowa caucuses, the first votes in the iowa campaign, and look. florida governor ron desantis had hoped he would be gaining some ground. nikki haley hoped she would be as well, but if you look at these numbers, which i think we have, a 32 point lead in iowa come of the former president has over desantis, over haley, slightly more than that. you can see the change .. 43% in october, up to 51% now , slightly over the majority. that is significant. the desantis, holding steady a slight amount, and haley at 16%. so, as this field is contracted, getting smaller, that has benefited donald trump. >> he now has the majori
