destruction in the caribbean in the wake hurricane beryl, the storm intensifying and heading toward jamaica all right, 5:00 a.m. here in washington alive. look at the washington monument on this tuesday morning. good morning, everyone in kasie hunt. it's wonderful to have you with us supreme court has spoken in the highly anticipated ruling, the justices may have reshaped the criminal cases against donald trump and redefined the role of the presidency. the court granting donald trump significant, but technically partial immunity from special counsel jack smith's election subversion case. and dramatically expanding what the president can do without fear of legal consequences but chief justice john roberts writing in the majority opinion, quote, the president is not above the law but congress may not

criminalize the president's conduct and carrying out the responsibilities of the executive branch under the constitution trump praised the decision on social media. he called it a big win and said that it clears the stench from the biden trials and hoaxes president biden, who now assumes an unprecedented shield of immunity for himself after this ruling, had this to say this nation was founded on the principle. i've are no kings in america each, each of us is equal before the law no one no one is above the law not even the president united states today's supreme court decision on presidential immunity that fundamentally changed for all, for all practical purposes. today's decision almost certainly means that there are virtually no limits or the president can do all right, joining me now to discuss his mark, his children, he has former counsel for the january

6 select committee, marcus. good morning to you a very significant de yesterday, the court going farther than many expected that they would go in offering immunity here, you worked inside the january 6 committee. how do you see this impacting the six case? >> so moving forward, i actually do think there is some hope, although it has uphill path forward for jack smith's team on january 6, qizan, the reason is because look, the court really said that there's official unofficial acts and the only official accidents said are off the table for immunity are the core executive powers that the president only as by himself, right? so if he had shared responsibility with the vice president or congress, there's a presumptive immunity, but that means that the jack smith's team can rebut that immunity in the lower courts. and so i think we're going to see now is a fact intensive evidentiary hearing where jack smith's team can put forward evidence to show that maybe it was candidate trump president trump that was acting out leading up to january 6. and judge chutkan can make a factual determination based upon a supreme court's ruling of

whether certain facts should come in to evidence. i think the big elephant in the room during court yesterday was that supreme court was making a ruling without necessarily considering the facts and circumstances of what actually happened leading up to january and six, they are making a ruling about presidential power without looking exactly what candidate trump was doing between november of 2020 and january 6, 2021. and i think that's how the lower court is going to distinguish the ruling from yesterday with what actually happened in 2020. >> do you think it is plausible that the court was actually doing this just based on law textbooks and not based on the context in which we live because i think a lot of voters find that implausible at this point you know, it, i think a lot of times our courts and lawyers, i'll just take the hit can be a little aloof from what's going on in the real-world, right? and i think that's where the lower court is. it's different. i think lower court district court, which is where i've practiced most of my career. it is very fact intensive where you're applying facts to the law. i think when you get to the appellate court and when you get to the supreme court, it becomes more of a legal exercising a little bit more

academic and less fact anticipate what's actually happening on the ground i think that's where some of that frustration can come through. i mean, even myself felt some frustration sitting in the room yesterday hearing the opinion being red, knowing the facts and circumstances that led to january 6, but yet hearing the supreme court say that you want a president that can have energy and exercising their role, right? it's like do you want energy and overturning an election? i don't think we do. and so that's where i think that the district court can take those words of energy and presidential power and apply and say, this was not presidential power to take care and measure the laws are faithfully executed. this was energy as a candidate to make sure that he remained and power. i think there's a key leinz from a blip phone and blessing opinion, which is another january 6 court opinion then the dc circuit where judge sreenivasan said, and i'm going to read it right when a first-term president gets to seek a second term, the campaign to win reelection is not an official presidential act, and i think that is a key theme that jack smith he will probably lean into when it gets down to the lower court and

we're seeing these evidentiary hearing. >> how quickly do you expect the judge in this case, tanya chutkan, to be able to hold such an evidentiary hearing because it does seem like the only additional information voters may have when they go to the polls in november is any fact-finding that goes zhan in that court ahead of november evidentiary hearings are held pretty frequently in criminal trials. so i expect that the hearing could probably get started within the next few months. now, whether there's an order that comes down from the court that makes terminations of what facts are actually official or unofficial. i think vascular we've got that takes time but the evidentiary hearing itself, i don't think should take very long to start. and if anything, you might find trump's team trying to delay because they're not ready, or maybe they need more time to prepare but i don't really see those arguments carrying the day because this case has been put on pause since march or even earlier than march since december of last year. and so i would expect that before september, october, we're having a full evidentiary hearing that could last a week's honestly because the special counsel's office has a

very high hurdle to clear to show that there isn't presumptive immunity for certain actions and that there is no immunity for certain actions and so do so they have to put for fall all the evidence that they leaves no doubt and the lower courts mine when it goes up on appeal that this is an an official act and not an official presidential act that deserves immunity. >> can i ask you also about the january or the excuse me, the note the new york hush money case because the trump team's already asked to delay sentencing the question at hand seems to be whether they can use things that were official acts as evidenced in the case. >> yeah, that's going to be the question. all the cases for president former president trump moving forward, is there going to apply? either the standard from yesterday and try to argue that facts that were entered into evidence, whether it'd be in the documents case or new york or any election interference case, they're going to argue that it was official now until they they make their filing and we can see exactly what facts they're alleging are official. it's kind of tough to read their arguments, but i imagined that in every case involving former president trump or even folks who are acting at the direction

you. always wonderful to see you. bring us up to speed on how what's the fallout from this debate among western allies in your neck of the woods? >> well, we obviously don't get to vote in these elections, but so were much more focused on the policy. and i think what was lost here a bit was the policy because it got so overwhelmed by all of the personality here and it was the surprise was obviously that it was biden. people were focusing on rather than trump. we used to seeing trump hold the stage as he does. this was biden really confusing people about exactly where he was going. and i think there if you look at what the love of foreign policy elements of what trump was saying people saw a lot of inaccuracy there and they work quite surprised that biden didn't call him out on those elements. so i think it does, of course, depend on what political leaning you're on. if you're in the center ground, you've got more sympathetic to president biden.

i've probably argue if you're moving to the right, which is increasingly happening here in europe, then you're looking to trump and you probably supported his role in that debate. i think it was difficult for foreign leaders because they basically have to accept with whoever comes out of this now, trying to look for the policy options worth work best for their countries, but it just wasn't clear from the debate because it became so much about personality so max the wall street journal, put it this way under the headline, the world saw biden deteriorating and democrats ignored the warnings that quote european officials had already been expressing worries and private about biden's focus and stamina before thursday's debate with some senior diplomat saying they attract a noticeable deterioration in the presidents faculties in meetings since last summer, there were real doubts about how biden could successfully manage a second term. >> then there was this european diplomat who talked to cnn and they said, quote, it was obvious that he was old. we aren't worried about his policies. if you have a president who works three hours a day with a good team and makes good decisions that's

okay. so that's kinda what you're what you're talking about there. i think my question is a little bit about the optics and i know this is something that you think a lot about because one of the big arguments donald trump's making against president biden is the president biden is week on the world stage. and there is the reality that the presentation of strength from the united states is something that has an impact on how both american and european adversaries act on the world stage, what impact do you think that has been want it depends whether you want america to be the global statesman. there are countries like france the uk, germany lots of european allies that cbo, big advantage of having the u.s. president really leading on democracy around the world. if you don't want that, then you look to present biden. you probably think you're in a better position now. you want if you want the american presence, be your world leader. of course you want their faculties to be about them.

they have immense military power and immense economic power but i think that that comment that you saw there in the cnn piece about in terms of policy, there's lots of very strong people around the president who foreign leaders deal with. and they were, was pretty strong from it's just a question of now seeing a situation where donald trump look stronger against biden making him more of a likely candidate to be the world leader and can you work with him? i think there are countries i was in france yesterday and if the far right does. well next weekend as we expect, they would probably prefer to see donald trump type figure running the world where you can focus more on your national economy. you're not so focused on the global economy. so just depends where you're coming from and it is moving further right here. so in the past they would have that europe would want biden and the centrist as they would see it it's just not the case so much now, so they're really

hurricane beryl is making history for all the wrong reasons in the southern caribbean. overnight, beryl reached category five status, becoming the earliest cat five storm on record in the atlantic. the major hurricane swept across grenada on monday, knocking out power for 95% of the country the prime minister there says one island was flattened by the storm in half an hour. the storm also forced hundreds of evacuations as it's swamped nearby barbados, knocking down trees and piling up fishing boats on the shoreline i'm washing fisherman, friends, the boats destroyed i still being destroyed was a sinking talking their boat sinking son and its total devastation beryl remains an extremely dangerous storm with jamaica now facing a hurricane warning. >> let's get to where meteorologists, elisa rafah

with more on this, at least good morning. >> good morning. i mean, just seeing some of these images from the windward islands yesterday, boats rocked in barbados, wind damage just all over the place, even storm surge, flooding, rushing into these islands as that ocean just came in with those incredibly intense winds the satellite image this morning, it almost gives you chills. i mean, look at that. i just how perfectly circular and huge it is still an incredibly strong category five hurricane, at least thankfully right now, exiting some of these windward islands and then getting into the open caribbean sea there. it's got 165 mile per hour winds but a strong category five storm sitting about 700 miles away from jamaica and headed that way as we go through the nectar day or so, it rapidly intensified again yesterday, it did over the weekend and went from tropical storm two major hurricane in just a couple of out 24, 48 hours. and then yesterday, it rapidly intensified again from

pardon immune, immune, immune immune. let's bring in cnn legal analyst joey jackson to help us understand this decision. joey good morning to you wonderful to see you as always, i actually want to start in new york because this sentencing is set for july 11. they have asked that to be moved how much how much do you think that this immunity ruling really affects? the nitty-gritty facts details, et cetera, of the new york trial case. he good morning to you. so there's various schools of thought, right? the one school is that certainly this was private conduct as it relates to its conic with a porch saw no official act to be seen there. and as a result, what are we doing? keep moving forward. the other schools both thought though is if there's any official acts such as the introduction of his twitter account, he was president, he tweeted, should that have been introduced into evidence, should an ethics form that was signed off in 2018? meanwhile, he was president be admitted into evidence should any other acts that he engaged in as a

including hope hicks compensation to be admitted into evidence. so the critical question will be, what, if any the influence they had on the jury does a doctrine of law, casey, it's called harmless error. and what that means is that there's other evidence that so overwhelming, even if there was the entrance production of evidence to a trial that shouldn't have been that the conviction would still stand, but we might see at a minimum is a delay in a sentence for the judge to ferret out these legal issues before the sentencing. and so would delay in that is certainly awesome. >> yeah. i mean, do you think that if you're judge merchan like how does he look at this? does he have to be fair delay the sentencing i think you should i think a delay would be appropriate. >> i mean, judges casey do what they do, but i think a delay to determine whether you got it right. remember with judge mug shot, did though he said that the presidential immunity arguments will objected as untimely, meaning he gave the lawyers a time in which to move forward with all of them motions and all their issues. they did not do it by that time

frame. however, since it's a supreme court has made a pronouncement here, it might be appropriate just two examine it, look at the motion of the attorneys. answered. have a hearing, if necessary. the latest sentencing considerate issuer, written decision, and then move forward. that of course, will be litigated. no what judge merchan does we have of course, a vibrant court system, the court of appeals, that could certainly look at this issue, but i think it leads to a delay and a very minimum with respect to the analogy of the new york case. >> so joey, on the january 6 case, it seems clear we're not going to get a trial, a full trial before the election. we could see some of this additional evidence come to light if the judge in the case, tanya chutkan moves ahead with an evidentiary hearing, how quickly do you think something like that might be able to happen yeah. >> casey, i don't think quickly at all. i mean, certainly you can get started on it immediately. i just don't see it moving forward and even if it does remember what happens because now she

has to fair it out on remand all these questions sections is an official act, is it not his conversations with the vice president excluding department of justice conversations looking at tweets and other things. and so i think it's a process at least that's entitled to a hearing. lawyers need time to prepare for the hearing to convene in the court, to submit documents and motions after the hearing to buttress their arguments. and then of course, that's subject to appeal as well. and so it goes do another set of you go from the district court that's judge chutkan's core to the circuit court. that's the appellate court. and maybe back to the supreme court. so i think it relieves two in ordinate delay. no what happens in terms of whether the case gets to move forward in a modified or gutted way or not, we're not going to see it happen anytime soon all right. >> joey jackson for it joey. always appreciate your expertise. thank you so much for being with us thank all right. this of course. the other major story of the 2020 presidential camp 2024, excuse me, presidential campaign right now the biden campaign, doing

everything they can to try to calm the nerves. a fellow democrats after last week's dismal debate performance within the last hour, the campaign putting out new fundraising totals for the month of june, they say that they raised 127 million a quarter of that they claim was raised since thursday the campaign co-chair, jen o'malley, dillon, held multiple calls yesterday trying to reassure party leaders on staff. the campaign. did ruffle some feathers. however, labeling those suggesting that the president bow out as the bed wedding brigade in an email blast and senior democratic official tells cnn that that was quote disrespectful. another called it disgusting. even as some democrats began to consider who else could top the ticket. others, of course publicly voicing their support. here was kennedy's excuse me, kentucky's democratic governor or andy beshear only the president can determine his future as a candidate. >> he is the candidates and as

long as he is, i'm supporting him joining me now, discuss two michel washington correspondent for the atlanta journal constitution and catherine lucy white house reporter for the wall street journal. welcome to you both. so i have to say catherine, that quote there from andy beshear was a short version. he i have to say it was one of the people that was seemed most entertaining of this idea that biden might step down, right? i mean, he gave credence to that idea in that quote that we did hear from him. he is of course, one of the people that is named as a possible person who might top the ticket instead. however, we mostly have seen it mean gretchen whitmer has been very aggressive in trying to tamp down at least publicly talk about her being that person. how would you characterize i know you talked to sources all the time and this is one of those things that has an ebb and flow the panic was very high rate after biden took the stage how would you say democrats are feeling right now? and where do you see this going next? the panic was very, very high. >> i don't think the overstated how high it was after the debate the campaign has worked

very hard and last couple of days to come those folks down. and what we haven't seen is some huge public declaration from donors or democrats saying he needs to go, that he needs to move along. and so in that sense, they have kind of kept thing contained. but certainly privately, a lot of democrats are still very, very worried. i talked to folks who are on one of these calls with donors with jen o'malley, dillon yesterday, the campaign tries to argue that the contours of the race haven't changed the issues remain the same. trump remains on popular they're going to keep moving forward. but the donors i talked to said they weren't terribly reassure. they felt like they didn't hear clear answers on how the president will handle another debate how they're going to move forward. if some polling comes in where he sees a real dip so i think that is one thing to watch for another point moving forward is what happens when we see more polling, particularly in battleground states. and if

that shows a real fall off for him, yeah. >> yeah. i think that the truth of the matter is if democrats thought they had a consensus right now for a path forward they would take it, but there isn't that consensus because there's so much division on whether to let biden make the decision a. and then there's not consensus on how to move forward, even if biden we're to decide he was ready to step aside and with all these factors in unknowns, there, their safer a lot of democrats think the status quo is safer, even as kind of the biden team hasn't done a whole lot really to convince people that there that he's gonna be able to address the concerns that were raised in the debate that again, there's just there so much unknown. the only thing that democrats are unified on

is that they don't want trump to be elected in november, but they're not unified on how to get there. yeah. so donald trump of course, was out there talking about all this and he to your point about if they knew exactly where they were going to go democrats, they might take that path trump was out they're criticizing commonly harris, who of course, privately democrats will say is a big part of this challenge that we're talking about. let's listen to what trump had to say shai, the only way they could choose his karbala because of the, you know, well, what that would represent to the black population that they would be extremely upset if that didn't happen. >> i don't know. but, i i don't think she improves their numbers very much. >> so of course, this is trump, the political pundit, but he does seem to be saying, well, running against her would be fine with me you seem to be saying that he's long been very critical of kamala harris. certainly i mean, i think to t is point part of what's going on right now is there's a lot of private dream casting about

what about this combination of people? what about that person? there is a reality that there is a sitting vice president who should the president step aside for some reason would be in a very strong position. obviously, she is on the ticket. she has support from key democrats she would likely take over any if fundraising. so she she is likely path forward if something were to happen, which at this point we have no evidence that the president is going to step aside. >> i mean, i think what one of the things president trump was kinda nodding to is that in current polling a head-to-head matchup with biden with harris versus trump she does worse than biden, but i do think part of that is because voters consider that a hypothetical they consider that a plan b, they're really hasn't been energy around oh, true. trump harris matchup. but again, there's still this risk there too, because there are some democrats that would get behind her. but now especially after all the primaries, there's risk

should the american people dissent i dissent all right, let's bring in just brave and he covers the supreme court for the wall street journal. >> jessica morning, wonderful to see you so this is how you framed it in your piece for the journal this morning, quote the majority and dissenting opinions saw the issue in starkly different terms. each highlighting what they say we're the dire consequences of the others position where roberts feared the specter of future bad-faith prosecutors would hobble the presidency. sotomayor wrote that the majority created price precisely the unaccountable power that sparked the american revolution. and she said, the president is now a king above the law very starkly different views here from this divided court. how did they come how did this split evolve behind the scenes? >> well, the split was quite evident in front of the scenes because at the oral arguments we saw in april, the questions that indicated very clearly where the justices ended up in

monday's decision so from the beginning, the majority of the court really spent almost no time talking about the allegations against donald trump, didn't really see what he allegedly did as a major threat to the country. they were thinking far ahead into the future to some sort of hypothetical future president who has bedeviled by potential bad faith prosecution's going forward but they saw a kind of structural threat to the country that was totally unrelated to the particular allegations against against donald trump and they also made a point of the fact that no president has been prosecuted before after leaving office so that was for them the important points. so this prosecution was anomalous and dangerous and a threat for the dissenters. what they said was, no president has been prosecuted before because no president allegedly did these things before there. outside the norm of people peaceful transfer of power that it's never occurred anyone to prosecute a former president. and so they really saw what the

threat to democracy was in this case as from a total mirror image, jack smith was the threatened according to the majority. not donald trump? >> so the thing that i keep tripping over is the mean they want the lower courts to distinguish between official and unofficial acts. but in some cases they were pretty explicit about what does fall into the category of official acts. for example, the conversations that donald trump had with his then vice president mike pence, who he was basically urging to not certify the election that seems like a tricky spot to me because yes, he's president, but on the other hand, he's been told he has has lost the election, needs to leave and he's trying to screw around with the system that is written to protect the peaceful transfer of power. why did they see this distinction this way? >> well, because of the very strange role the vice presidency has in our constitutional structure the vice president is it's

elected, although also has stuck to the president on the same ticket the vice president is in the executive branch. and so, in a sense, he is subordinate to the president, but he's also in the congress because he's president of the united states senate. so the role of the vice president is somewhat unclear. and because congress has assigned to vice president the job of overseeing the counting of electoral votes that he's not fully functioning as an executive branch members. so this very opaque sort of confusing structure is what the the supreme court said. the lower court has to resolve. and they say the trump would be presumptively immune, but the government can overcome it if it can make certain showings evidentiary showings, how it's going to do that greene court didn't say all right. >> just proven in the wall street journal. i thank you very much for being here. i'm sure going to have lots more to talk about, though he's sick. you back to you. >> all right. i'm never sports supposed to be coming out party for the u.s. men's soccer team, but instead, they were sent packing as the home team in the
