in this filing donald trump's lawyers say, well, look, tish james says, the attorney general for new york, that the appellate court does not have the authority under the authority and the law of new york state to stay the execution of him, either having him pay out the judgment or filing a bond to secure the full amount of the judgment. donald trump says, oh, she's dead wrong. they actually do have the authority, but when you actually read through the brief, donald trump engages in a little bait and switch. he cites all federal cases standing for the proposition that the new york appellate court has the authority. the problem is this is a new york state court proceeding. he cites no cases in the new york state law. to answer your question, i don't think he's going to win on trying to convince the appellate court to somehow modify the requirement that he either put up a bond or execute the judgment in full. he will still be able to appeal, but tish james will be able to move to the next stage which will be seizing his assets in the event he can't pay in full or put up a bond to secure

tish james, them has at his properties. that's what i think will not happen, but yeah, it's it's an awkward one of many awkward positions that he's put his lawyers in. any way you look at this bores he is in a world of hurt. the question is what's the least hurt that he could emerge? from this situation with her, you brought up the possibility of an angel, i believe was the word that you use there had guardian angel, there had been some speculation about whether there could be perhaps a foreign guardian angel and concerns as you rightly pointed out, about national security especially if he were to be reelected his attorney, chris guys also pushing back on that notion, saying it is categorically absolutely not true that there will be no russian or saudi money or any foreign money under consideration. is that something that the courts would monitor? >> the short answer is they would know about it. and in general, he's there's a lot of monitor ship going on, but that doesn't mean it would be illegal. it would be a huge concern

the other thing he doesn't want to do is having tish james decide what she's going to go after. first, i just want to say, the clock is ticking, but these contests have a way sometimes of going into overtime. and there may still be some maneuvers left, for starters, the appellate court might reduce the amount. he might ask james for a bit more time. but i think if push really really really comes to shove, for political reasons, he'll want to avoid bankruptcy, and for financial and sort of pride reasons, he won't want james to have her pick of his crown jewels so he'll wind up selling things, not 40 wall street, not bedminster before the grim reaper literally comes down. but even if she moves on properties, he still has legal maneuvers to do, but that, i think, will be his two kind of guide posts, don't declare bankruptcy, and don't let her choose what she's going after first. >> tim, do you agree? >> well, i think we should get kind of clear on the various time frames here, because it's not like he can just push a bankruptcy button. >> sure. >> you know, or just sell some assets

but tish james and her team points out they could they could add them together. they could seek a series of hundred million dollars bonds, for example, to satisfy the judgment. so there's still probably things they can do. i don't know if they're considering that. i do think the court is going to have to delve into this a little bit to see what might be able to happen, what sort of compromise can be reached, because he really should be able to to appeal and the seizure of his properties in the sale of his properties while that's pending would be unusual and really would be a hardship for him. so i think the court will likely try to step in and do something. >> we shall see caitlin y his trump's soap about the optics of failing to secure a bond well trump is long someone who has tied his identity to his wealth and to his assets. well, if i mean, that is kind of also what's at the heart of this case, what tish james and her team had accused trump of, which was over inflating his assets to get better terms when it came when it came to those loan agreements. and now

is this formal procedure for tish james to register it? >> referee: think what you would like to see if you were in her position, it is an assurety bond. that the easiest path forward is the district attorney. but since it is likely she is not going to have that easy path, she has to go after the most accessible assets. some of those are properties in nearby west chester county. it is a little bit easier for her to go after items in new york. there is the trump national golf course sitting there. and other assets she could use if there is no bond in place by the close of business on monday. >> all right, new but related topic. >>> donald trump's campaign fund raising is taking a serious hit as his legal bills are climbing. now there is this new deal with the rnc to get more cash for guess what? paying his legal expenses. what's the deal with that? >> well so much for the rnc not paying for donald trump's legal bills. that might be true. there is kind of a catch here now. so there is a joint fund raising operation that allows efforts to go

this is how tish james responded to the bond being lowered today in her statement she said donald trumpill facing accountability for staggering fraud 464 million judgment plus interest against donald trump in the other defendants that still stand. is the judge signaling something here? what's your got? >> i think the court did -- took a big step in the right direction. i don't think there should have been any bond for the appeal in this case. and the court certainly had that discretion. he has the assets. you know where he is i think the underlying conviction is going to be reversed. certainly by the time it reaches the new york court of appeals if it has to go that far. as you have said, no loss, no victim, the banks were more than happy to do -- to make the loans, they wanted more business. he is an international brand, and so on. this is a very different definition of frauds than we have ever seen before. no jury trial there should have been a jury trial. as we have said before, 2011 case that says no george bush trial says because damages are intercontinental to the relief generally

. >> we mentioned before that tish james officially registered this with officials. what else do we need to know about this? >> she is likely to first go after his bank accounts, he gets a lot of money from licensing his name. there are buildings with his name on them in india, the middle east, and elsewhere, for which he gets a cash log. she is now going to seize all of that cash from him. he will continue to retain businesses, you know, when the beer company delivers peer to his golf course in westchester county, they will pay that bill. but there will be no money movements outside of the ordinary unless they are approved by the monitor. and the judge significantly expanded her duties and responsibility's today, including saying, in a fact do not take a look at who is behind the child bond in the carroll case. any bond that donald produces in this case, if you need more powers, him to me and i will give them to you. >> joyce, what sticks out to you in this bloomberg reporting, his is normal for tish james to register it? >> i think what you would really like to see

in both of those cases with the tish james case in particular that started in 2019 when donald trump was still president and well before he announced he was going to run for president in 2024. and both of these prosecutors it's worth noting are not part of the federal apparatus. they were elected by the people of their state to do what the law requires in their state which is pursue justice without fear of fraud or favor. >> pretty remarkable deduction in the bond trump had to pay. what does it tell you about the larger case? >> certainly a last minute reprieve here. but let's go back to basics. a bond is a promise by a third party to pay a full judgment if a defendant is not successful on appeal. trump's lawyers here suggest that they just didn't have the money to do that. now they were under court in those official filings by donald trump himself -- you just put this on-screen. and that's the problem here, jonathan. if you or i had made public statements where we undercut the official filings of our lawyers we would have been hauled into court to explain ourselves. that's not what

he has a $175 million bond in the new york ag's case, tish james's case, the civil fraud case. on that case, what is your expectation in terms of trumps ability to pay that without someone else putting a bond out for him? >> he asked for, when he filed his brief with the new york court of appeals, he said i want $100 million and so they have now given him $175 million bond so figure he's close and $75 million more, i would assume that he would probably be able to find a source of it. it can't be his campaign. his campaign cannot pay for that civil judgment because that was purely personal conduct. they can pay for campaign finances that are related to his conduct in the campaign or as an officeholder. his campaign can't pay for this, so i think he really is going to have to find other forces to be able to pay for that, which it's just insane to me, just that the bond was reduced for him to be able to do this, to go forward with his appeal, because at the end of the day this was a defendant who went in court and said his whole defense was i'm too rich to defraud because the bank
