today's "new york daily news." the tabloidses don't miss around. a little subtle but you'll get the gist. lady liberty is having a bird issue. campaign carl cameron is live in washington. what else are we learning about the legal battle over cruz0qazbd eligibility. is this a real issue or did somebody make this up. >> you can get into court, whether it's true or not. anybody can sue. and a lot of legal scholars say this is unresolved issue and others say cruz qualifies. but this week, while all of this fire storm has been going on, an 8 8 -year-old galveston texas trial lawyer has now filed a lawsuit in federal court in houston, texas, challenging that state's junior senator, ted cruz, on his citizenship. the lawsuit is 73 pages long and argues that the definition of

"natural born citizen" has never been settle bid the supreme court so it's not clear, as in his view, as in trump residents view not clear, whether or not cruz, who was born in calgary, canada, is a citizen. his mom was an american-born citizen. his father was a cuban, and whether or not he is eligible nor the presidency, trump likes to say the harvard law professor lawrence tribe says it's up for grabs. trump has been predicting this, fanning doubts before the citizenship, predicting there would be a lawsuit, and now there is one. cruz said at the debate that trump evenlñç acknowledged havig his lawyers look into it in september of last year, and trump said that cruz is fine now. cruz is looking at litigation. trump was in iowa today ripping on the debate. he did not talk about any mention of the lawsuit but has been predicting one just about twice a day for the last couple of weeks. here's a little trump this morning. essentially being pretty hump bell about -- humble about his

into a plus for him saying i share a lot of people's anger about the condition of the country. >> on the big stage, did you get the sense or the pundits suggesting that anybody hurt himself real badly? >> well, to the degree anybody did, according to the so-called pundits -- what do we know -- ben carson didn't have a very good nightful did nothing to stop the slide. he was a front-runner in iowa, and one of the two front-runners nationally a month ago, and now he is in single digits and i don't think he did anything to slow that down. everybody else did pretty well. kashich kind of a bumpy night, but christie, and rubio, did just fine. people say today, if bush had done as well in the first debate we did on fox back in august, as he did last night, he would be in a very different spot in the race. the question is, is it too late for him to make a first

impression? >> before we go, dr. carson -- least disarray. people dropping like flies. do you have a sensenzç he is in this for the long haul or might we hear something? >> i think he will be in it through iowa. i haven't heard anything that said he is going to drop out. you have to figure, though, after iowa, some of the social conservatives, obviously a state that favors them -- people that finish up the track and possible names would be carson and santorum and huckabee. you are going to wonder are they going to stay in? and meanwhile, more moderate primary field when you get to new hampshire and you wonder if establishment candidates are going to stay in i think the field is going to winow. getting to south carolina the dozen will be more like five or six. >> chris wallace, host of "fox news sunday." he'll get a chance to talk to ted cruz about the legal battle

loss for the year. oil has plunged as well. look at all the major indexes today. everything in the red, from home depot to intel. everything is down. and largely that's because of oil, of course. oil at least leading the way. the dow was down almost 1600 points for 2016 earlier in the day. over on the wall you seek how the dow has done this year. down 8%. the price of oil went below $30 today and kept going. the lowest level in more than a decade. and adam shapiro is working+1/#t for us and is live in the fox business news room in mid up to, manhattan, wow. >> at one point we were down 537 points, and we're accelerating to the downside now. dow down 413 points. the last half hour of this hour, the last half hour of trading we could accelerate again to the down side because of twoeñy@v[ . one, no market trading on monday, and investor does not

whatnot to be held over a three-day weekend in long positions with oil trading down below $30 and with china selling off. you could see a big selloff in the last half hour of trading today. >> analysts say a lot of this is about oil prices. >> they are correct. the fact is that oil is low for two reasons. you have a china slowup. they are not buying oil. they're the world's largest consumer of oil and23=joñ yet te world continues to produce oil at huge quantities with iran about to start selling oil. this weekend we are going to free up the money for iran and they will start selling oil again it's going to depress oil prices with no one to buy it sinking. >> adam shapiro in the fox business network newsroom. thank you. the world's largest retailer has announced it will be shutting down nearly 270 stores. the majority of them are here at home. by that i mean in the united states.

so, a couple hundred miles before earth today nasa cut short an historic space walk when a water bubble appeared inside an astronaut's helmet. a water bubble. 15-centimeters square or something. happened during an already-risky space walk. two astronauts had just 21 minutes to repair the station's electrical system in complete darkness. if they took too long and the sun rows it would have charged the station's solar panels and shocked them. and not in a good way. more in today's slide show. the two astronauts are nasa's

timothy copra and britton's timothy peak. he became the first space walker to wear the union jack on the shoulder of his suit. you can see that right there. this is animation from nasa. nasa is often good at animation. i wouldn't give this an f, but it is not an a-plus. nasa sent the two to fix a broken electrical unit the size of a 30-gallon aquarium. it failed and they needed to replace it to restore full power. nasa says that -- nasa's reps say the space walkers successfully replaced with a spare that had been inside the space station since 1999. they replaced in it ten minutes before the deadline. the astronauts were working 200 feet from the airlock. what is interesting, we tease

since his controversial "rolling stone" article. he told cbs news he does not fear for his life, but that he does believe mexican officials have tried to put him in the cartels cross-hairs by claiming he was essential to "el chapo's" capture. >> there's this myth about the visit we made, my colleaguesq?ad i, with ale chap o', that -- "el chapo," it was, as the attorney general of mexico quoted, essential to his capture. we have -- had met with him on october 2nd, many weeks earlier in place nowhere near where he was captured. i know i shook his hand. isn't that impressive? wow. the actor says he believes the notion that he found "el chapo" first, quote, humiliated mexican officials. he also says his article in "rolling stone" has failed. penn says that's because the purpose of the story was to start a conversation about the war on drugs and he says that

didn't happen. penn's "rolling stone" article came out the day after mexican marines caught the cartel leader. he described "el chapo" as a simple map from aá simple place. and claims he did not strike him as a, quote, big bad wolf of lore. all kinds of disgusting. >> would i say i'm disappointed in sean penn but it was low bar. he is so naive. so narcissistic, and is so ignorant to the way mass surveillance works. in this country, which was washing hand in hand with mexico to recapture "el chapo." and the reason sean penn was having dialogue with him is because of "el chapo's" lady crush, the mexican actress, and awful they had to do was put their phones under surveillance and they did, and sean penn is so -- i don't want to use the word stupid but i can't think of

anything else. he thinks that because they had their conversation in another part of mexico than where el chap pour was -- "el chapo" was captured. this penn's communications and the act tress' communications and they kept iming and texting each other ask led the mexican authorities to "el chapo." but sean penn cannot see that because he thinks he is such a special snowflake that the government could never find him because his shrouded in this protective orb of celebrity that means it's impervious to the spying eyes of two international governments. >> i want want to hang out with "el chapo." he has murdered a lot of people and ruins livesif he hadn't been there, somebody else would do it burk it he did do it. >> he is the guy, the biggest guy. i understand penn's

a dozen u.s. marines now missing after two helicopters collided during a nighttime training mission near hawai'i. according to military officials there. rescue crews say they spotted a debris field about two miles off the coast of a beach there on the island of oahu. witnessed heard a loud boom and then saw a big flare in the sky. no word yet on what caused the crash. jennifer griffin is at the pentagon. what do we know about the choppers. >> we don't know a lot. it appears as though hey may have collided in mid-air. we.]3ç know that they found a s field and that fires were seen in the sky, but no evidence of survivors at this point. we know that two marine corps super stallion helicopters were flying in the air, collided off of oahu. shortly after midnight during a nighttime training mission. two and a half miles from the shore. there were 12 marines on. they are missing. a search and rescue effort led

by the coast guard is underway right now. so far there is no sign that anyone survived this. the ch53-e is a heavy lift transport helicopter used by the u.s. marine corps. each helicopter had six people onboard. there will scattered showers at the time of the crash and the two marine corps helicopters are based at the first marine air wing in hawai'i. the cause of the crash is under investigation. >> thank you. wall street needs a time-out. maybe just an afternoon of sitting on the stairs because it's been bad. they're down over there like 378 points at the moment. as bad as 500 points on the day. it's like 1500 points on the year, but it is up more than 7,000 since the president took office, up 92%. doesn't help me today. busse is here. i oil, what else? >> all themes you have been talking about for weeks affecting the market, on the upside and the downside. so it's china, slowing down. and how important it is as a

consumer of commodities. all the commodity companies are down. and the countries that have big stakes in commodity production, they're down. oil is dropping. how much of that is going to stimulate industry? because prices are down? how much is really a proxy for the market saying, you know something, their whole global economy is slowing down, so a lot of supply because of saudi arabia pumping a lot and slowdown in consumption globally. the market says it's going to happen even more in the coming months. and you have china devaluing its currency, which creates instability in the currency market. >> i was watching fox business earlier and two points struck me they were making often. one, thaxethe analysts,p markets don't trust the numbers coming out of china, and, two, they were hoping that more oil rigs would go offline and just got a report today showing one oil rig came offline so the production is still way high. >> yes. production is way high but a lot

of oil rigs have come on -- offline over the last several months you. can't trust the numbers of china but you know things are slowing down and china has been signaling that. the question now is what is happening in the u.s. market is? the u.s. which, has been growing, albeit slowly but growing consistently, the jobs numbers have been pretty good. is that going to be affected by the fact that the global economy is slowing down and the dollar is strong because people have rushed into u.s. assets and bought up dollars and that's hurting u.s. exporters. are we on the counties of a -- the cusp of a recession or in a time-out on the stairs? we have had an overvalued market. this is a regression to the mean. markets go up and go down and they'll eventually find they're equilibrium again. those two camps right now, recession versus this is normal for the market, they're battling and you're seeing that battle take place in the pricing. >> the volume is really high. is there -- is that because everybody is in and making plays? 8y÷ prone for that?

>> the volume being high, some market strategists say that's a signal that maybe your getting a purging of the market. everybody is getting worried and selling into the market and that's the kind of catharsis you need before the market finds its bottom and begins to go up, or it might just be people selling wju level. but we have to kind of look at what has happened since march 2009. the market then was at 6600. we have to remember that. it's at 16,000 now. so there's been a very big runup,u("íq and there has been overvaluation in some prices and that's been discussed extensively. now maybe what you're seeing is some of that work out. >> well, all we can do is watch it. >> that's true. >> can't change it. >> that's true. and jason swag, our personal finance editor says make sure you have a pot of money on the side that for a couple of years will keep you out of the market and your safety bucket while you watch the rest of your assets
