"america's election headquarters "starts right now. good afternoon. starting out with a flash alert from the fbi. after foreign hackers break into state election systems right here at home. hello, everyone, i'm heather nauert. the fbi cyber division now warning election officials nationwide after discovering that hackers penetrated election databases in two states. the urgent bulletin asking for help from cybersecurity professionals and system administrators, stating the information in this product is only for members of their own organization and those with direct need to know. our chief intelligence correspondent catherine herridge is dialed in on this one, she has more from washington. catherine, tell us what hackers were able to get. >> reporter: thanks, heather.

this four-page fbi flash alert first obtained by yahoo! news and independently confirmed by fox was sent to election officials after foreign hackers targeted welcomes databases in two states. the fbi reports eight i.p. addresses used available software to scan for vulnerabilities and voter data was stolen. at least one i.p. address was used, suggesting coordination. the fbi alert asks that states contact their board of elections and determine if any similar activities to their logs, both inbound and outbound, has been detected. homeland security secretary jeh johnson offered federal experts to scan for additional weaknesses and to shore up the voting system. homeland security is responsible for protecting critical infrastructure like the power

actual count. they could have registered people be unregistered, and that's a dangerous space to be in. even if they can't pull that off, if these foreign entities are able to decrease further american confidence in the sanctity and good conduct of our elections, they may have done something just as damaging as actually affecting the outcomes themselves. >> this certainly plays right into what donald trump has been saying, this is a rigged election. and one of those states that may have been targeted is arizona, where he will be giving a speech on immigration on wednesday. >> mm-hmm. we have a long history of losing candidates or candidates who are behind complaining about the electoral process. we remember that when the democrats lost in 2000, certainly democrats have made a lot about what they say is voter suppression through voter identification laws passed in several states, saying it's a deliberate attempt by republicans to suppress turnout. so we have a long history of the

sour grapes side of the aisle saying this was rigged. but if we have foreign powers playing on those fears, playing on those anxieties, you could have a problem in an election process that actually works well. >> remember those old hanging chads from the good old days? those seemed like such a brilliant idea by comparison when you start to talk about russians potentially hacking our election system. gosh, remember the hanging chads? >> i bet paper ballots are coming back into vogue over time. >> meantime, chris, you know our interns are, a hanging who, what did chad do, what's he hanging from? chris, i want to ask you about this, because donald trump is now spending $10 million in nine battleground states, ads targeting ohio, pennsylvania,

florida, that's where the campaign has already been on the air along with first time air buys in arizona, colorado, iowa. by comparison, clinton is spending $68.2 million. he's spending 4 $4.3 million. >> the technical term for that is "more." look, trump is playing catch-up here, but he's playing. the money is coming out, the ad is quite good. the economy continues to be one of his stronger issues, when we look at how voters perceive the two candidates. he's coming out and saying she's bad with the economy, your taxes are going to go up, i'm good with the economy, i'm going to make america rich, and that's a good message for him. >> it's still the top issue for voters. but this is a week where he's supposed to be talking about

immigration, giving a big speech on wednesday. usually campaigns like to have a consistent theme. this one seems less sure-footed. why not consolidate the message and just have one this week? >> to do this turn-about on immigration, and sounds like he's setting himself up, based on what we've heard from his campaign advisers, for something of an about-face on what critics would call amnesty, or some means by which people who have entered the united states illegally can stay or return home and then come back and stay. he's got to offload that inventory before it gets later in the election. he's got to get it done now, regardless of the ad campaign. >> he talked about a softening of his position on immigration, then talked about a hardening, over the weekend there was different talk about it. how is that overall confusion, i think it's fair to call it, how is that playing with voters right now? >> we don't know yet. he's got a minute to try to sort this out. i think where you have to end up

if you're donald trump is he's got to build the wall or say he's going to build the wall, 40 feet tall, tunnel technology, all this stuff. he's got to emphasize border security, so that as he pushes hard on that, he can then turn and say but we are going to do this a little different internally so we won't have a mass deportation force taking people out of the country. new pew numbers are out which say while they agree with trump on immigrants, they don't agree with his policies, so we have to, as we say, true that up. >> thanks, chris, we'll see you again. hillary clinton's top aide huma abed bebedin announcing te has decided to separate from her husband anthony weiner, the disgraced congressman, over reports that he's sent messages

to a woman on social media. rob schmitt has more. >> reporter: abedin released a statement saying, "i have made the decision to separate from my husband. anthony and i remain devoted to doing best for our son who is the light of our life. during this difficult time of i ask for respect and for privacy," after "the new york post" publishes a story saying that he was in contact with a woman for 19 months. she says they never met in person. the most jarring photo is the small picture on the cover, showing weiner a house-husband in his underwear, laying in bed next to his toddler son, taking that photo. the woman, who is remaining anonymous, responded to the photo, according to "the new york post," you realize you can see your blank in that pic."

welcome back. a fox news alert coming out of louisiana at this hour where there is a manhunt under way for three escaped prisoners, one a convicted murder. police warn folks in the area to be careful because these guys are considered dangerous. trace gallagher is tracking this for us in our newsroom. trace, good afternoon and what can you tell us about these guys?

>> heather, it happened in natchitoches parish in louisiana. the sheriff says the three inmates escaped saturday night. it's unclear how they know the exact time of the escape yet apparently they were not aware the inmates were gone for some time. no word on how the men escaped. but to get outside the prison, the inmates had to scale two fences, both with rolls of razor wire at the top. the felons have been identified as 24-year-old michael elliot, 35-year-old wall shea mitchell, serving time for amendment robbery, and 34-year-old willie ethridge, convicted of attempted murder. two of the men were wearing black sweatpants and sweatshirts. their clothing may have helped them scale the razor wire. none of the inmates was armed at the time of the escape. but clearly that could change. either way, police say they should be considered very dangerous. the sheriff's department continues following up new leads. they believe the escapees are still in north west louisiana,

although they won't say why they believe that. if you spot the men, they say, do not confront them, simply call 911. the natchitoches prison has 550 inmates and they did have another escape back in january, but that inmate was quickly apprehended. updates on the search as they come in. >> considered armed and dangerous. trace, thank you. a fox extreme weather alert. we're tracking two storm systems, both gaining strength. one moving into the gulf of mexico, the other passing close to the outer banks of north carolina. our senior meteorologist janice dean is live for us at the fox weather center. janice, good afternoon to you. tell us how this could potentially impact folks here at home. >> we are watching two storms, as you mentioned. also in the pacific, a couple of storms that could hawaii. we'll also mention that. we've got hurricane gaston. the good news is this is not going to affect land.

tropical depressions 8 and 9 will move into the gulf of mexico in 12 to 24 hours. depression number 8 off the coast of the carolinas here, we think brushing the outer banks sometime tuesday into wednesday. we think as a minimal tropical storm, but it's not getting its act together. could see rain bands from the storm and gusty winds from that system, we'll watch that. this one is more pressing, because we think it has more time over open water to organize. and we do potentially think there is going to be landfall within the next couple of days. whether it's a storm or a minimal hurricane, we'll see the same effects. we think the computer models are coming into agreement across north florida into central florida. here is one of our forecast models. the future radar will show you certainly going downhill in terms of weather across the sunshine state tuesday. wednesday, we could potentially see an eye feature here. the upper level winds are we

that's a group of pollsters and experts, recently looked at all of the data and moved georgia from leaning gop to a toss-upstate. the last time georgia went for a democrat was back in 1992, when bill clinton narrowly beat out george h.w. bush. we'll continue to monitor mike pence down there in georgia and bring you any news. two people killed in a bus crash on a louisiana highway and at least 36 others were hurt. and now the driver and that bus company could both face charges. the bus was carrying some 40 construction workers on the way to start rebuilding root in-ravaged areas near baton rouge, louisiana. but according to police, this man, who was behind the wheel of that bus, was an illegal immigrant from honduras and he did not have a driver's license. our legal panel is here to weigh

in. phil segal and lou smith are here. so this guy, if that report is accurate, has broken two laws, onehere illegally, two, driving without a license. why wasn't he without bars? >> he should have been behind bars. the company that owned the bus certainly had noticed that this guy did not have a driver's license and had already been pulled over. why did this company let this guy, he wasn't an employee of the company, let's give the company that, let's say they didn't employ him, why did they let him have access to driving this bus? they're going to be on the hook for negligent homicide, which is a criminal act. that means the president of this company could be looking at jail time. >> phil, not just negligent

homicide but also negligent injury, reckless operation, and driving without a license. what could happen to the guy and the company? >> i suspect the company could be finished. you've got wrongful death suits on the civil sight. it's not so much the criminal action against the company that i would be worried about. it would be the wrongful death suit. as lis said, they were on notice that this person, if it's true, didn't have a driver's license. even without notice, you have a responsibility when you employ somebody to drive people in a commercial setting, to make sure they have a license. >> to run down that driver's license and make sure there is in fact a driver's license. >> if he had a fake driver's license and they took the trouble to ask where it was and they have a photo cop copy of w they thought was a real driver's license, they could have some good faith defense. but if they can't produce a driver's license that he showed them, then the company and the person, never mind the criminal penalties, is looking at

gigantic civil penalties. and there would be no insurance coverage. >> if they can't do such a basic thing, check to make sure the driver's license is accurate, what other basic things aren't they doing? are they hiring convicted felons or people with multiple duis? what other basic things is this company not doing? >> reports are that he was carrying day laborers, people lined up on the street to get a job somewhere, good pickin's there if you're going to louisiana where folks need a lot of help. >> exactly. it doesn't really matter to me who was in the bus. i mean, they were thinking these were people, whether they're illegal or not, they were all injured, by the way, so their lives are still just as important, and they're going to have lawsuits as well. the people that were injured, were killed, were another driver in a completely other car. and a firefighter who was there trying to help people in another

watch, senior political correspondent mike emanuel is live for us in washington. mike, is there evidence that the clinton foundation controversy has hurt clinton in the poll numbers so far? >> reporter: heather, that's not clear at this point. the pollster handling the monmouth poll notes the margin has narrowed since hillary clinton's post-convention bounce. but she is holding on to an edge over donald trump among key voting blocs. it shows her with 46% of likely voters, 39% supporting donald trump, 7% for gary johnson and 2% for the green party's jill stein. yet the clinton foundation controversy is not going away, such as efforts to get tickets to a lunch with the chinese minister. huma abedin and doug band discuss possible guests at leveralunch with the chinese president, including with people who had

explosives, the other four were killed by security forces. isis is claiming responsibility. connor powell is live from our middle east bureau. >> reporter: heather, as isis is losing territory in iraq and syria, they're proving once again they're still capable of planning and carrying out attacks. sunday night's attack targeted a wedding party outside of baghdad, a part of the city that had not seen a big record of attacks. isis said in a statement online that the attackers were all iraqis and they battled security forces for several hours. iraqi officials offered a slightly different description of the events. all the attackers were killed. 54 people in yemen were killed by isis today, a car bomb exploded outside a government training example outside the port city of aden. yemen of course is in the middle

killing someone. 32-year-old anthony mcneill, suspected of killing his child's grandfather. north carolina police finding the body early on sunday around the same time that mcneill posted, quote, just killed someone, leaving nc, goodbye, everyone. and he continued to post on facebook as police were hunting for him, vowing that he would not be captured alive. a fox news alert. a pair of united airlines pilots accused of trying to fly drunk a plane, they are now out on bail after they appeared in court today. trace gallagher is live for us with the story, hi, trace. >> reporter: heather, the court appearance was very brief. both pilots got bail, as you say, and neither entered a plea. they were arrested at the airport saturday morning prior to their 9:00 a.m. flight from glasgow to new jersey. we still don't know if they had boarded the plane or if they were allegedly drinking

together. they were both 35 years old and have ties to the u.s. military. along with being an airline pilot, one has spent 28 years in military intelligence for u.s. air national guard. he has also been praised by the faa as being a, quote, positive influence. the other pilot joined american airlines last year after serving as an air force instructor pilot. the passengers scheduled to fly on the flight to newark say they could see some hubbub at the airport but didn't know exactly what. one tweeted, quote, what is going on with glasgow/newark flight 162? very little information, been here for hours. turns out their new jersey flight ended up being ten hours late. united airlines issued a statement saying, quote, the two pilots have been removed from service and their flying duties. we are cooperating with the authorities and will conduct our own investigation as well. the safety of our customers and

issued but did not stand up for the national anthem on in friday's preseason game during the packers and at one point a few years ago he was fine by the nfl for using a racial taunt on the field. basically nfl reporter noticed this the woke prior when was in street clothes and injured, waited for friday's game, noticed he didn't stand and that's when he played out. he says the protest was due to wrongdoing against african-americans and other minorities in the united states, and yesterday two days later, he continued his stand to sit. >> there's a lot of things that need to change, one specifically is police brutality. people being murdered and not been killed accountable. cops getting paid leave for killing people. that's not right. not right by anyone's standards. >> reporter: talked to some supreme with the team whoa would not go on record.

and stuff, it's different when you put that -- i understand his point of view but i don't think that was the right arena to do so, especially with the national anthem and how that means so much more to other people. >> absolutely has a right to sit down if he wants to, and certainly it's an issue that we have that needs to be addressed and in as many ways as possible, and our athletes have the venue to really broadcast that in a broad sense. >> reporter: i talked with somebody with close connections to the team this morning and made a good point saying when kaepernick was the starter and star a couple years ago when ferguson was happening he didn't do this. now he is the backup and now never want to have this kind of controversy from your backup. >> we'll be right back.
