but the fbi has not stopped looking into the links between the clinton foundation and the state department during hillary clinton's years as secretary of state. we did not know this was happening. hillary clinton denied it a year ago this was taking place. my man, it's taking place. >> james comey on friday when he dropped his october surprise, he had few details, but last night at the very beginning of bret beier's special program, he outlined five things he was told. the fbi investigation into hillary clinton has been a high priority for more than a year. and apparently it's being instigated and followed up by the fbi's white collar crime division. >> that's exactly right. also the laptop that clinton aides cheryl mills and heather samuelson have not been destroyed. remember we were told you could not get the information.

turns out they have the laptop. >> yes, they said we'll take a look at these. after we look at them, we'll agree to get rid of them. we thought on the outside, why would you do that? why would you destroy them? it turns out they have them. there's a backstory there. >> they have limited immunity. they would destroy them, but the caveat is if anybody told a lie during their testimony, then the immunity is dead and that is what is going on. >> e-mails were found on former congressman wiener's laptop believed to be original nighted on hillary clinton's secret server. that backs up the report that we heard earlier this week that the reason why we knew the 650,000 number was correct is they got multiple hits on the meta data search of dot gov and clinton

e-mails. >> these could be classified in nature. >> this is number four, the jaw-dropper, the indictment is likely in a pay-for-play scheme at the clinton foundation. the indictment is likely, barring some obstruction in some way from somebody at the department of justice. >> well, they said the indictment was possible. we'll back the likely word. finally, this is something that people have said, well, you know, if she didn't really have much security, she's easily hackable, right? given what comey said, we really don't know. turns out the fbi sources say with 99% certainty that hillary clinton's server has been hacked by at least five foreign governments, which means when you think about it, maybe that's why her particular e-mails have not been leaked by wikileaks. five other countries actually have them. they're waiting for her to be president of the united states so they can blackmail her. that is a brilliant intel if

true. >> or if these are state actors, this could be -- >> a guy in a basement somewhere. >> exactly. or a woman, just so you know. to be fair and balanced on that. there's a bit of a war and you heard about this. the scary thing for our country is the politization of this whole thing. there's ongoing friction between the fbi and the justice department. and it is playing out right before our eyes. >> it is. apparently what's happening, and this is a detailed page in "the wall street journal" today, the fbi was looking into a public corruption case and they were listening to an informant secretly recorded, and he started to talk about the clinton foundation. the agents thought there was enough information to go there, however the prosecutors at the fbi and the department of justice said, it's hearsay, we don't have enough there.

so we're not going forward with that particular case, even though on the recordings this guy is talking about what was happening behind the scenes to the clinton foundation. and it was completely illegal. >> well, there is that battle between the fbi and the doj. and rudy giuliani was on fox last night saying that folks inside the fbi, these agents are so furious. listen to this. >> we have outraged fbi agents that are outraged at the injustice. they are outraged by the justice being turned down to open a grand jury. they are outraged that loretta lynch has corrupted the justice department. you have people who are defense lawyers for clinton people. i mean, this is about as outrageous a corruption of the justice department you have ever seen. >> and you're hearing that judge pirro and rudy giuliani say this should have gone to a grand jury a long time ago.

we have former fbi investigator terry turchey. terry, does it surprise you that this investigation was going on eight months ago and hillary clinton said, i don't know anything about it? >> good morning, brian. no, it doesn't surprise me. when you look at all this, it is reminiscent of the first time around with president clinton and the eight years he spent in office. the white house itself became a revolving door of the fbi investigations. and i think we can expect more of the same if clinton is elected president. >> why is this something that the voters didn't know about eight months ago? maybe it was the primary process and they could have picked somebody else. >> well, depending on who you talk to, you get all kinds of theories. but what this really looks like is a lot of attempts and steps by people in doj to slow down or -- i don't way obstruct, but to slow down and prevent fbi agents in the street and the field from really getting into

the truth of what is going on. and you see all kinds of indications here, when you see all of these attempts to go out to collect money and in all types and fashions. going back to what i mentioned earlier the first time around with president clinton, one of the biggest things that was going on at that time was an fbi investigation called campcon which stood for campaign contributions. interestingly, the whole thing centered on the fbi investigation looking into foreign influence. then we were concerned about chinese intelligence agents providing money to the dnc and to the clintons. and also the criminal side of doing things you're not supposed to do when you're a politician collecting money. >> terry, it's like a kid, if you don't stop the act, they get away with it in the '90s, why wouldn't they try it 20 years later and think they'll get away with it. now that they have accumulated more power. that's what you point us to in the book, details that in the pre-interview you gave.

we really have three tracks. we have james comey. and then the fbi agents who are very frustrated over the summer that james comey dismissed any type of indictment opportunity and didn't empanel a grand jury. then you have the justice department working with the fbi agents much to the dismay of the justice department. where does this leave us? >> well, this leaves us feeling very, very sad is where it leaves us. and you have heard a lot of former agents talking about this. i've heard a lot of my colleagues talk about it, to be truthful, i haven't talked to anybody inside the fbi to get the firsthand knowledge, but this looks like the fbi that i knew. even if the first line of defense fails when you have something really major with politicians, you can always count on the people that are in the trenches doing the work to come through. and i think that's what they kept doing, they kept working hard and they kept taking their case to the people that they have to report to.

and if we operate on the assumption, which we should, that director comey is a man of integrity, then over time he's got to listen to these people and realize that there's only one direction to take this. and the direction to take it is until we run it all out. and when you start running it all out, you get into all kinds of tangled webs. >> terry, i have to talk to you again because we didn't touch the 650,000 e-mails, which i understand the fbi and the justice department is curiously going through to see if there's anything in the huma abedin e-mails some we'll have you back and will be live on sunday. maybe we'll discuss this as it moves forward because it's coming with five days until the election. terry turchie, thank you so much. >> you're welcome, brian. coming up, both sides of the aisle react to the deadly shooting of two cops in iowa, including bill clinton. you won't believe what he had to say, though. and the country music royalty came out for the music awards. abby was on the red carpet, what

why it was such a big deal. it should be in a protected environment, and it wasn't. it is vulnerable to a cyber attack and it was. the president of the united states is communicating with her under a pseudonym. they are not stupid. they can figure that out as well. this is a huge story. it's far bigger than the accusations against donald trump. this goes to the heart of fitness of character to serve as commander in chief. >> what about the president, the president is supposed to stay on the sidelines here but we're also learning from fbi sources that varyl jarrett is asking james comey to be fired.

he's campaigning for her saying it's an honest mistake. >> i don't think valerie jarrett has any credibility here. james comey, he always does what he thinks is the right thing to do. he's made republicans upset, but he's also made democrats upset. one thing i know about him is he will do the right thing in his mind. i think he believed that he had new evidence and he had an obligation to the congress to turn that evidence over and let the congress know and the american people before this critical decision that this case was not over as hillary clinton said i'm cleared, it's all over. james comey is the hero here coming in saying that's -- no, that's not the case. >> did you feel that way in july? >> the investigation is still going. >> did you feel that way in july? >> you know, the only criticism i had of jim in july was that he should have said, to say no reasonable prosecutor would take

evolution -- right now, they are dead each where he is versus a career politician who has been in the business for 35 years and here this guy who is brand-new at it who is tied with her? >> he's tied with her because he's not a politician and he has demonstrated and illustrated exactly what that means. it means that you can still talk about your success outside of politics. he's a builder. he's a fixer, he solves problems. he's a real inspiration for lots of americans and he's employed tens of thousands of people, including women and elevating them to the highest levels. i think when people look at that -- what have people said to poll sters said to decades, i would like somebody outside of politics to run for politics. i like somebody who doesn't know anybody anything in washington. he's not part of the insiders game. they never get their chance in the presidential level. when you look at the congressional level. it's never really happened at the presidential level.

the plan is. good morning to you, senator. >> good morning, ainsley. great to be on with you. >> great to see you. you know, the economy is the issue, why everyon to the polls, at least that's what the polls are telling us. this is a big issue for families because many people can't afford these high premiums. >> it's a huge issue, ainsley. president obama promised that obamacare would save the average family $2,500. just last week his own administration announced that premiums would go up by 25% and that's just the start of it. a lot of these plans have deductibles of $6,000 a year or more and more most working families for around country, they are paying and getting nothing in return. some people are paying what it would cost as much as what some

disgraced dnc chair donna brazile fired for leaking debate questions to hillary clinton while she was working drawing a paycheck from cnn, so why isn't cnn investigating this? joining us right now is fox news contributor and new york post columnist michael goodwin. good morning. >> good morning. >> are you surprised she was leaking questions to her pal, hillary clinton? >> recall, this was all going on in the primary season, and bernie sanders was complaining that the dnc had rigged the primary process against him. we found jut before the democratic convention through wikileaks that in fact they had been rigging it and we found out through wikileaks now about donna brazile asking questions. we also found out about other

reporters and columnists through the emails of john podesta basically helping the clinton campaign, advising the clinton campaign, sending stories to the clinton campaign for approval before they are published. so i think we've learned a lot about this confederacy between left wing media members and the democratic party. >> absolutely. and it's a huge embarrassment for the guy who runs cnn because his employee who he hired, donna brazile, look -- leaking the questions out there and cnn is not going to have a investigation. no investigation into figuring out who exactly leaked her the question. >> right. the whole idea that wikileaks has in effect done cnn's work for it. cnn doesn't want to to anymore. donna brazil es was not involved in the preparation of the debate questions so somebody who was gave them to donna brazile. there's no other way. donna brazile isn't a

testimony taking place 12 hours before? >> if i did this about a pleading we're about to file in court, a court document and giving them a heads-up ahead of time, i would have lost my jork but here's the assistant attorney general communicate winning podesta and somebody else communicating with the clinton campaign itself to tip them off that a court document is about to be filed about the state department emails and how long it was going to take to get them out in the public. it's extremely important information, and that's totally insider trading. to give them that heads up. >> here it is. here's the actual document and it's not been denied although it was hacked. there is an hjc oversight hearing today where the head of our civil division will testify. likely to get questions on state department emails. so other people are speculating, it's only a few hours heads up. what's the big deal.

the other side didn't have a heads up on this. >> that's about the congressional testimony and that's not as big of a deal as athe court document. lawyers have an ethical obligation, including justice department lawyers, to not disclose confidential information to third parties. when they called the clinton campaign and told them that a court document was qog to be filed that they needed to look at, they needed to use, respond to, integrate into their campaign, that's a violation of their ethical duties to tip them off about those court proceedings. >> jay, i should call you christian, tell me what you think is going on between the justice department, fbi as it relates to these emails, evidently, the tension has never been higher between them. is this surprising to you? >> what surprises me is the fight in the fbi agents who are really going to the mat to do justice. it's the justice department lawyers who have turned the justice department into a wing of the democratic national committee.

their job, they see it, is to stop prosecutions of politicians they like, like hillary clinton, to get in the way of justice, to stop criminal proceedings. >> but the reason why you are talking to me is because that wasn't okay with you. i understand there's also other people in the justice department who aren't okay with this? >> yeah. thank gevens we still have people who have principles despite the last seven years. this is a situation where lawyers view themselves as political operatives at the doj from top to bottom. this is why we can't get justice when it comes to hillary. >> meanwhile, more "fox & friends" in just a memo as we wrap up three hours of fun.
