watching. i'm paul gigot. we hope to see you right here next week. arthel: as the impeachment battle rages on in washington, house democrats issuing a subpoena to the white house for documents as part of their inquiry into president trump's dealings with ukraine. amid the widening scope, some information is also being requested from vice president mike pence's office, and the clock is ticking with democrats giving the white house until october 18th to produce the material. hello, everyone, welcome to america's news headquarters. i'm arthel neville. eric: hello everyone thank you for joining us. i'm eric shawn. mike pompeo missed a deadline of yesterday to turn over ukraine documents to law makers but fox news has told that the state department is in touch with those house panels that made the request.

meanwhile the "new york times" now reporting that a second whistle-blower with quote more direct information could be coming forward soon regarding the president's dealings with ukraine. ellison barber live at the north lawn of the white house with more on reaction there. hi, ellison. >> hi, eric. the impeachment inquiry directly reached the white house yesterday evening, when three democratic committee chairman subpoenaed the white house for documents, related to communications between president trump and the president of ukraine. the chairman says that president trump forced their hand here after ignoring repeated requests from documents, requests that they initially sent in early september. white house press secretary previously said this, quote, this is nothing but more document requests, wasted time and taxpayer dollars that will ultimately show the president did nothing wrong. the dems can continue with their kangaroo court. the president will continue to work on behalf of this country. president trump is trying to hammer that point home in tweets this morning. vice president mike pence tried to make that point in louisiana this afternoon.

listen here. >> after two years of investigations that found no collusion, no obstruction. last week you all saw it in the news. the do nothing democrats launched a partisan impeachment inquiry, in a blatant attempt to overturn the will of the american people >> sources tell fox news president trump is going to send a letter to house speaker pelosi next week, most likely on monday telling her the white house will not hand over any documents until a full house vote is held on the impeachment inquiry. the subpoena democrats sent to the white house yesterday seems to address that possibility. it says that a vote is not necessary to conduct the investigation and that that sort of demand is outside of modern precedent. all of this as bloomberg news reports president trump has ordered substantial staff cuts to its national security team. bloomberg news says two of their five sources said the decision to shrink it is largely related to efficiency and leadership

change. the whistle-blower complaint does mention the national security council and there are also reports that the whistle-blower was detailed to nsc at some point in time. eric? eric: thank you. lots more to come. arthel: the growing political drama is sweeping across the nation's capitol with republicans and democrats sparring over the ukraine whistle-blower complaint. the very basis of the impeachment inquiry. garrett den tenney has more on that. >> it looks like this fight over documents is likely going to end up in the courts. so far the white house is refusing to cooperate with the inquiry. last night a trio of top democrats responded by issuing a new s&p -- new subpoena in that effort. they have given the white house till october 18th to release documents related that offer. the democratic lawmakers warned failure or refusal to comply with the subpoena shall constitute evidence of or

instruction in the house's impeachment inquiry and may be used as an adverse inference against you and the president. the same committees have requested documents from vice president mike pence regarding reports that he was involved in efforts to pressure ukraine to investigate the bidens. this all comes on the same day that secretary of state pompeo missed the deadline to comply with a separate subpoena for documents related to his department's interactions with ukraine and president trump's personal attorney rudy giuliani. today in athens, greece, pompeo criticized the democratic-led committees. >> sadly, there have been a congressional inquiries that have harassed and abused state department employees by contacting them directly and seeking to have them provide documents, documents that belong to the state department, that are official u.s. government records and asking them to do so without saying hey don't bother calling the state department lawyers. just talk to us directly. >> last night in south carolina, speaker pelosi defenned the impeachment inquiry and said it is a very sad and somber time for the country.
1:05 pm
>> some people say why are you doing this? he's not worth it. to divide the country this way. i say he may not be, but our constitution is worth it. our democracy is worth it. [applause] >> fox news has told the state department is in touch with committees which are trying to work something out to have officials testify. in washington, garrett tenney, fox news. eric: overseas now there have been some dramatic images coming out of hong kong as protester continue to react to the new law now banning the use of face masks. widespread violence is breaking out with protesters setting some fires. an off-duty police officer we're told shot and injured a protester. authorities claim that was in self-defense. the protester was a teenager. that would be the second demonstrator cut down by live fire. the protests have led to the city shutting down banks, shops, and closing its entire subway system. greg palkot has been on the ground there for the past weeks covering these disturbances that
1:06 pm
continue with democracy very much on the line. greg? >> absolutely, eric. actually early sunday morning here in hong kong. guess what? we're going to have a few more protests on sunday, more clashes. saturday, eric, was relatively peaceful as the pro democracy demonstrators tested out this new face mask ban. but it was a little bit rough where we were. take a look, what we saw. we are looking at possibly what is the first enactment of this face mask law, pretty peaceful scene here. protests in the center of hong kong. a moment later, these riot police came in and they are pinning down, possibly arresting some young people with face masks. again, after a calm march through the city, the protesters had gathered again out of nowhere, the riot police, we were totally surprised came charging into the park. the young couple detained were in fact later released. we spoke to them, a 20-year-old
1:07 pm
man, an 18-year-old woman, they were both shaken up. that's where a whole lot of people that we were talking to in that park. take a listen to what they said. >> i'm so angry. >> you're so angry. >> so angry. [inaudible]. >> i think it is a way to protect yourselves when we wear the max. >> to protect yourselves? >> yeah. >> friday night really was one of the worst nights of violence in weeks here, eric. one activist counted 24 different clashes. the businesses were hit as well as banks as well as subway stations and so on saturday, almost everything in this huge metropolis was shut down, including the subway system, eric, the subway system on an average day carries 5 million people. that's how much these protests are affecting the very functioning of this city, the
1:08 pm
hong kong chief executive carrie lam issued a video statement on saturday, again, denouncing the violence, but it seems like desperation right now. we are about to enter believe it or not the fifth month of unrest here. incredible stuff. back to you. eric: it is incredible. earlier gordon chang asian analyst was with arthel and said that these are young people willing to die for what they believe in and democracy in hong kong. amazing. thank you. >> that's what we hear, eric. arthel: here at home a brutal and shocking attack in new york city. the police saying four homeless men were beaten to death overnight as they slept on the street. a fifth man who was injured is in critical condition, and now a custody -- or a suspect is in custody. jackie heinrich has more. jackie? >> well, arthel, police say all of the victims were sleeping when they were attacked, and because the only surviving victim's in critical condition, police haven't been able to talk to that man or get a handle on how all of this started.
1:09 pm
someone called 911 around 2:00 a.m. to report a man being assaulted. when police got there, they found one man unconscious, his head beaten in and another badly injure. that second man was able to describe the suspect to police saying he saw that man running toward the west wearing all black. police headed that way and found the suspect, 24-year-old man, they say he was carrying a 3 foot long pipe from a nearby construction area which they believe is the murder weapon. shortly after they took that man into custody, police found three more victims, all homeless men beaten to death. today local business employees reacting to both the crime and the problem of homelessness, had to clean up remnants of the crime scene with those men killed in two store front doorways. >> i'm saddened by the fact that, you know, four people were murdered. besides that, i guess for me it comes with a job, it is a shame, it is a problem. it is not only here in new york city. it is also nationwide. >> police assured the community
1:10 pm
today it does not appear there's any ongoing threat and the attacks were random homeless on homeless crime. police say four of the five men who were beaten died of their injuries right there on the street. the fifth is still in the hospital and may not make it. police would not confirm any of their identity just yet. more than 63,000 people in new york city are homeless with about 4,000 of them sleeping on the streets every night. arthel? arthel: very sad. jackie heinrich, thank you. eric: the white house refusing to turn over the documents until the house takes a full vote on that impeachment inquiry. this as the second potential whistle-blower we're told contemplates coming forward. up next, we will talk to a former fbi deputy assistant director on what we can expect next. yeah, that's half the fun of a new house. seeing what people left behind in the attic. well, saving on homeowners insurance with geico's help was pretty fun too. ahhhh, it's a tiny dancer. they left a ton of stuff up here.

eric: the president and several republican law makers have been seizing on the "new york times" report that the ukraine phone call whistle-blower was in touch with the house senate intelligence committee aide before filing that complaint. well, that aide later shared parts of the conversation we're told with the panel's chairman, democratic congressman adam schiff. the president and the g.o.p. claim that that tip-off undermines the house democrats impeachment inquiry but have the
1:15 pm
whistle-blowers followed the proper procedures? their supporters say yes. former fbi deputy assistant director is joining us from dallas. good to see you. >> good to see you too. eric: you have known this for many years in decades of government service, there is a fairly standard set of guidelines if you are a whistle-blower. you know, what do you do first? >> well, the first thing you do is go to the proper authority. i'm not really bent out of shape that much about the fact that he talked to somebody on the committee of the staff, as long as they referred him to the proper authority and told him to get a lawyer, but the issue is, who generated this? did this come from a staff member to the whistle-blower? the whistle blow tore the staff member -- whistle blow tore the staff member? -- blower to the staff member? that's going to be key. >> they said he had nothing to do with the report, that he only knew about vague parts of it. that in fact the whistle-blower had a colleague go to the cia general counsel.
1:16 pm
when the whistle-blower supposedly became nervous because it went up to the white house, that's when he or she went to the aide at the intelligence committee that told them the procedure, you have to file a complaint with the ig and get a lawyer. that's exactly apparently what he did. >> i think that's fine. as it stands right now, this is her -- this is hearsay upon hearsay. that bothers me a little bit. we are talking about overturning the election of the president on hearsay evidence. the way they are looking at this thing, you and i could be whistle-blowers. that bothers me. eric: the critics would say it is not hearsay. it is in the president's own words. it is against the law to try to get a foreign power to interfere in an election by seeking the investigation of joe biden. i mean that's against the law and against the federal election commission, the commissioner this past week made it very clear you can't do that. you can't go to a foreign power
1:17 pm
and ask them to investigate a political opponent. >> well, was he a political opponent at the time? that's a question. i'm not sure he had declared or not, but i think he had not. eric: july 25th. he's out and running. the phone call was on july 25th so of course he's a political opponent. >> well, i don't have a problem with asking another government to conduct a lawful act. certainly there was an investigation on mr. biden and his son. i don't have a problem with that. but you know what, eric? what we say doesn't matter. what matters is votes. we can debate back and forth as friends whether or not this was legal or illegal. what matters here is what's in the eyes of the beholder, which is the congress? if they think it is a high crime or misdemeanor, not a misdemeanor, high crime, then they can vote for impeachment. we have a difference of opinion a little bit here, but it doesn't matter what we think. it only matters what the votes are. you and i are used to working
1:18 pm
within the framework of the criminal justice system where you collect evidence and you go to a court and there's monitoring and everybody is treated fairly. that doesn't happen in impeachment hearing, as you know. it is just do you have the votes and do you have the courage to take the votes to impeach or not? that's what we're talking about here. eric: now the republicans are complaining that there was not a full house vote, and the president is complaining about this. >> yes. eric: and that basically they say handcuffs the republicans from being able to have a subpoena power themselves. here's andy biggs, republican congressman talking about this issue. >> that schiff didn't know anything about -- or didn't have any input on the writing of the complaint doesn't mean that schiff didn't know about the complaint, doesn't mean that schiff didn't know what was going on, doesn't tell how many members of the staff actually were there, doesn't tell how many -- whether how many of these staffers actually participated in writing that. when you read that whistle-blower complaint, you get 17 references to media
1:19 pm
stories. that doesn't read like a normal whistle-blower complaint. eric: that's interesting because we've heard that before. i mean, what is a normal whistle-blower complaint? >> well, normally it is first-hand information or should be. it's information that allows a duly authorized agency, primarily the executive branch to look at it and then report to congress. one thing i think we need to remember here is that there's a demand here for information. well, eric, we're still waiting for the fast and furious documents, and the ag was held in contempt of congress. so this is a stalemate. eric: why can't they do anything about that? i filed a freedom of information act request like 12 years ago, and seriously i haven't even heard. they will just stone wall you. >> i think here that we probably need a vote so that everybody's treated fairly here. but, you know, that may not ever occur. what we may have here is
1:20 pm
theater, and that's what this is about, going back and forth, my view, your view. we go back and forth wit and nothing ever happens -- we go back and forth with it and nothing ever happens. that's kind of the way congress works. and that's a shame. eric: they have more than enough votes to impeach the president if indeed they do have on the democratic side they go to impeachment, so something will happen, the question is, will it happen, you know, in the senate so they are taking action, and the critics are saying that the president undermined our democracy, violated his oath of office by seeking foreign help, not just from ukraine but also by seeking foreign help publicly on television to china which is basically not just a rival of us but is aggressive and take advantage of us in the president's own words any way he can. >> they clearly are. i totally agree with your characterization of both accounts. however, let's do an investigation in the open with
1:21 pm
transparency, give everybody equal opportunity, with regards to subpoenas and interviewing people and the ground rules, and i think think would be comfortable with that -- i think i would be comfortable with that, however it plays out. i love investigations but i like them to be done fairly where everybody is on equal ground here. so far they are not. eric: because the way it's been structured by the speaker you feel this is not equal ground because the republicans don't have equal footing. >> definitely not. let's do it fairly. i come from equity, the criminal justice system where the defendant and prosecutor are on equal footing. that's not what we have here. i think that's a shame. i would like to know what happened. eric: always good to see you. thank you for your service to our country and the fbi, down if dallas today where it is nice weather this weekend. danny, good to see you. >> it is beautiful, thanks, eric. arthel: well, the white house unveiling a new immigration policy that would deny visas to immigrants who lack health

candidate. >> the physical fitness and health matter for a presidential candidate? >> yes, it does. i have no fears about bernie sanders. >> sanders was supposed to show up here to talk at the union for all summit hosted by the powerful union group the sciu, but he is headed home after being hospitalized in vegas for three days after suffering a heart attack. >> hello, everybody. we're in las vegas. i just got out of the hospital a few hours ago. i'm feeling so much better. i just want to thank all of you for the love and warm wishes that you sent me. see you soon on the campaign trail. >> joe biden continues to face questions about his son's overseas business dealings in ukraine and this photo shows biden golfing with his son hunter and his son hunter's business partner. i asked biden about the photo, but he insists he never talked
1:30 pm
to hunter about his overseas business deals. >> yes, i stand by that statement. it's not a conflict of interest. there's been no indication of any conflict of interest from ukraine or anywhere else, period. i'm not going to respond to that. let's focus on the problem, focus on this man. >> and biden is busy doing just that. he tweeted this afternoon about donald trump, quote, donald trump is the definition of corruption and other 2020 democrats agree that the focus should not be on biden but the president. kamala harris said yesterday that she wants the press to leave biden alone. eric? eric: hillary, thank you very much. arthel? >> so the whistle-blower, they didn't think meaning shifty schiff and that whole group they didn't think i would put out my telephone conversation which was done by professional stenographers. they didn't think it would be put out. when i saw what the whistle-blower said and heard
1:31 pm
rumors i said we're going to put it out. we got approval from ukraine and we put it out and everyone now is panicking. arthel: president trump claiming to be transparent about his phone call with ukrainian president zelensky. as house democrats ramp up their impeachment inquiry. the president controlling his antiimpeachment message with republicans taking a backseat. josh holmes says quote at this point the president can hold his own but he needs to persuade republicans in the house and in the senate of a bunch of really good arguments to have the party wide installation the president is going to refer going into this fight. joining me now is washington examer if news editor dave marks -- examiner news editor dave marks. president trump is a master at marketing and messaging. will that be enough to convince the court of public opinion? >> that's how we got to the presidency in the first place, since he took office nearly
1:32 pm
three years ago he's run his communication shop basically by twitter. that's whae he's doing now -- that's what he's doing now. so far he has most congressional republicans in line with him. they are not going wayward. that's what he absolutely needs to prevent removal from office after the almost certain impeachment in the house that's coming at some point in the near future. arthel: what about the court of public opinion? >> well, it's about 20 senators on the republican side he really cares about and of course they reflect public opinion in their own states. he's trying to nail down that republican base in a number of states represented by republican senators and congressmen and making sure that they don't go wayward. arthel: the president is saying that, you know, he doesn't want to assemble a lot of attorneys as it might get the impression that he's in trouble. would that be the implication, and is this at all a dicey defense approach in >> well, in other impeachment scenarios, bill clinton, richard
1:33 pm
nixon, we've seen them have a lot of defenders out there, using talking points, etc. they didn't really bring up the specifics of the arguments. trump here for better or worse is going directly at it, even suggesting other countries like china essentially looking to joe biden and his son -- arthel: that's yet another violation of federal law. >> well, that very well may be, but he's leaning into it. that's part of his defense, and so far not many republicans in congress are really pushing back against it. arthel: are there more preparations perhaps taking inside the white house than what's being publicly revealed? >> no doubt trump's lawyers are talking about this day and night, whether it's the white house counsel, which essentially defends the institution of the presidency or any personal lawyers he has, they are talking about what he should say and what he should not say, but
1:34 pm
right now it seems like the president is listening to rudy giuliani, the former new york city mayor who is acting it seems as his personal attorney who is going out even further out than trump. i'm not sure what kind of legal advice he's taking right now. arthel: i read reports and i'm not sure you reported the same thing but i read reports that jared kushner advisor and son-in-law to the president and perhaps acting white house chief of staff mulvaney will make up the president's war room staff. what expertise and guidance will either provide president trump in his first ever fight with congress over an impeachment inquiry or more should it come to that? >> they can try. they can say mr. president, you should say this. you shouldn't say that. you should emphasize this one thing over another, but there's not really much history to suggest that he's going to listen to them very much. they are looking at it from a conventional political point of view, what you would do if you are trying to pass a bill through congress or something of that nature. he goes by gut instinct. so you can call it a war room.
1:35 pm
advisor counsel, whatever, he's going to do what he wants, and we will see how far that gets him, if it keeps anymore in office. arthel: ultimately are the republican lawmakers president trump's best defense team i mean if it does come down to a senate trial and if republican senators don't convict the president of impeachment allegations or charges, the president walks away unscathed; right? >> absolutely. that's why we see the president so often tweeting about the high ratio support he has among republicans. he says it is 90, 91 percent and it probably is something close to. that it is also why he's going after anyone who even speaks up a bit like senator romney of utah who the president has been targeting on twitter all day he wants to make the republican congressional support is locked down. arthel: coming at anybody, lashing out at anybody and everybody who wants to get to the truth of this, and maybe we don't know what the truth is but people who want to get to the truth, the president is lashing
1:36 pm
out at all of them, doesn't that make him look bad and that he's trying to hide something? >> it makes him look really bad to much of the country and the electorate assuming he's still in office in november 2020 may vote against him for that reason, but it may just be enough to protect him from removal in a senate trial if and when it comes to that. arthel: we will leave it there, dave marks, thank you very much. >> thank you. eric: a new round of protests in iraq have turned deadly yet again. at least 70 people have been killed there over the past five days. what is behind the demonstrations? we will have that and a lot more news straight ahead. cologuard: colon cancer screening for people 50 and older at average risk. i took your advice and asked my doctor to order cologuard, that noninvasive colon cancer screening test. the delivery guy just dropped it off. our doctor says it uses advanced science. it's actually stool dna technology that finds 92 percent of colon cancers. no prep, and private.

the demonstrators defying curfews with no end in sight. kitty logan is live from london with more what do they want, kitty? >> hi, arthel. well the protesters want more jobs, an end to government corruption as they call it and today there was a very heavy security pre presence on the streets of baghdad to try and prevent more protests. as you heard, clashes broke out regardless. what we're seeing today is protesters setting tires on fire, during a very tense stand off with iraqi military. now, this latest violence after authorities lifted a curfew earlier in the day now the fifth day of protests. these demonstrators are angry about the lack of jobs, public services. people have arrested hundreds of people over the past few days and -- police have arrested hundreds of people over the past few days and authorities have blocked the internet in an effort to try to contain the protest movement. but demonstrations have spread to other cities in recent days too. we have seen angry crowds setting government buildings on

it's probably being set up as we speak, but we will let you know. but north korea would like to do something. iran would like to do something. we have a lot of countries in a very good position right now. eric: the hopes of jump-starting nuclear talks between the u.s. and north korea, well they are dashed at least for now. south korea media report says that the talks between the two countries' diplomats that was occurring in sweden have broken down, indicating that the top north korea negotiator accused us of coming to the table, quote, empty handed. well, that's a characterization the state department denies and of course this comes just three days after kim jong-un test fired a missile at sea. first reports suggests it could have come from a submarine but confirmation later said it was from an undersea barge. let's bring in retired lieutenant james carafano vice president for national security and foreign policy tat heritage foundation. -- at the heritage foundation. good to see you, colonel.
1:44 pm
what's an undersea barge? was it to see if they could fire something from a submarine? >> you have never been on a submarine before. you don't want to fire a missile from a submarine under water unless you know it is going to work because if it doesn't work, everybody dies. so you test it in a surrogate, in a barge until you absolutely have it 100% safe before you try it on your submarine because not only do you kill the thing, you lose the submarine. north korea doesn't have that many. eric: that makes sense. that shows something else that they incrementally bit by bit by bit do these little tests and they get more proficient and the missile goes further and then think try something else again and -- and then they try something else again and it goes further than that. this is how they do it. >> that's true. they are continuing their capabilities. no question about that. what are our interests? if there's not a war in the region, and they can't directly threaten the united states, and the umbrella that the united states has in place, nuclear deterrents, missile defense, the
1:45 pm
conventional deterrents and heavy sanctioning, north korea can take these baby steps but they can't threaten u.s. vital interests and that's just the status quo that will continue for some time. eric: in terms of the status quo, it looks like it is back to the drawing board over in sweden for now. those talks breaking off. our state department says no, that we came with, quote, creative ideas, and we had good discussions with our north korean counterparts and we thank the swedish foreign ministry and they will prepare to meet again in two weeks but the north koreans apparently walked out. what is up with that? >> i think it is always a mistake to kind of say this is what the north koreans are doing because the honest answer is we don't know. we know they did switch out their negotiating teams. that doesn't tell us very much because they have done that before and that doesn't really seem to make much of a difference. it is noteworthy that they didn't say the talks are done. they just said they are broken off even though the north koreans are saying they're coming back. i think in hanoi the president

was very clear, i only want a big deal. that fundamental position hasn't changed with the president, and i think the north koreans are continuing to test that proposition. they have seen bolton leave. maybe they thought that would make a difference. they put a new negotiating team out there, maybe they thought that made a difference, but they are continuing to press to see if the u.s. is really serious about a big deal, but i got to tell you, as closely as i watch this president, i still think he is holding out for the big deal which means a deal that includes denuclearization, it may be phased, but there's a commitment up front to get rid of their nuclear weapons at the toechbd -- at the end of the process. eric: the north koreans keep poking at us and the president isn't responding. they're not used to that. they fire this missile and the president says so what. that's not the reaction they expect. >> the north koreans are buying time until they see the results of the election. even if kim at the end of the day would make the deal with the president, why would he make the
1:47 pm
deal unless he knew trump was coming back to enforce it? so, you know, i think still the betting is the north koreans want to see what happens next november. eric: so they are playing out the clock in a sense. >> that's just a guess. we will see. eric: do you think that in any realm of possibility that they would actually surrender their nuclear weapons? the president has certainly talked about this, or at least talked about economic benefits that he has shown. it's not in the realm many would say of that regime. it is all based on a militarized philosophy, the whole economy and the upper class is based on the fact that they have -- it's a military state. >> well, we have two unknowns that we have never had before in this decade-long confrontation with north korea. we have a different president and a different leader in north korea. we have a young leader who has kind of looked and thought out of the box. and we really don't know what he's really going to do at the end of the day, and we have in
1:48 pm
donald trump something that the north koreans have never had before, his grand father, his father, an american president never sat down with them and said look, trust me, if you do this, we will normalize and bring north korea into the world and we won't try to change your regime and you will remain in control and your country will prosper. that's never happened before. we will have to see, but it's really two people have to decide if they are going to walk down this path together. but i really think -- if i were the north koreans, i would want to wait and see if trump would come back. this impeachment thing has complicated their assessment of what's going on. i'm in the camp that they will wait for a little longer. eric: that's an amazing historic offer from the president of the united states to try and break the horrible bureaucracy and human rights record of that country, as well as the threat that it's posed to japan our allies and us.
