support of president trump. hundreds of thousands of law ar abiding americans from across the country. on the senate floor senator ted cruz was leading an effort to force a 10 day emergency audit of the election results to address the concerns -- 83% of republicans and 30% of independence and millions of democrats that saw irregularities and their strong belief the election was fraudulent. following a planned march to the capital chaos ensighed. -- ensued. some capitol police were hurt and the capitol was breached. vice-president pence and all members of congress were forced

to evacuate. some made their way to the senate floor and others broke into speaker pelosi's office and posed for pictures. one woman was shot and later died. she was killed. possible explosive device were discovered and safely removed at the headquarters of the rnc and two other locations. let me stop here and be crystal clear: those who support president trump and believe they are part of the conservative movement in this country, we do not support those who commit act of violence. people we don't believe should be vandalizing our nation's capitol and attacking the brave men and women who keep us safe in law enforcement and don't place pipe bombs at the rnc. all of today's perpetrators must

michigan. we had a powerful dissent in the 3-4 decision. the chief justice of the wisconsin supreme court said 4 members of this court threw a cloaks over problems that will be repeated again and again until the court has the courage to correct them. another justice said the states ruling against the trump campaign will: state law was changed by the legislature in violation of what the direct language is in the pennsylvania constitution. that relates to mail-in ballots. and the artificial mail-in ballots deadline extension. that was pushed back without lawmaker approval either. if you have a state constitution and want to change it, you have to go through the process.

look at what the state constitution of pennsylvania says: article 2 of our constitution articulates the following: in other words it's up to state legislatures to decide the election, but it has to be constitutional based on their state. not the governor, not the secretary of state, not the democratic party. the highest court in the land refused to hear that case. i think they should have. the courts refused to hear a serious case out of texas backed by 17 attorney generals and sought a decision on election irregularities. democrats and republicans that

tough day inside and outside and indeed for the country. >> sean: kevin, thank you. we go to mike tobin -- before we get to mike. we will go to the senate floor. they reconvened. senator josh hawley is speaking. >> when pennsylvania citizens try to be heard before the pennsylvania supreme court they were dismissed on grounds of procedure in violation of that supreme court's own precedent. i am not aware of anybody that defended the constitutionality. this statute governed this last election with 2.5 mail-in ballots in pennsylvania. this is my point. this is the forum. the pennsylvania supreme court hasn't heard the case there. is no other court to go to in the state. this is the appropriate place

started earlier today. mike tobin on the ground and has been there all day. what shocked me and america is how quickly that breach took place. did they not know that hundreds of thousands of people have a planned march from the washington monument to capitol hill? >> there was a strong indication of it. when you heard the president speak you wondered how this would develop. they went to the capitol and overwhelmed it. parts of the capitol were ransacked. when i was on the east side i could see damage to the windows and the doors. when they got inside there was gunfire and ashley babbit a 14 year veteran of the air force was shot and killed.

some of the police were injured. we saw one police officers taken out with bandages on his head. as things progressed, around 4 o'clock, we smelled the tear gas. that was after seeing police head around the west side with riot gear. we could see there was a big crowd on this side of the capitol. they used flash bangs and stood in force and moved forcefully through the crowd and cleared them off the capitol grounds. you saw a lot of pushing and shoving and heckling of the police officers who were working to clear the capitol grounds. over a period of hours they would advance that line and stay and advance that line again. the crowd control effort at the capitol largely appeared to be

senate per each state they object to. they were on arizona. you have to have an actual roll call vote. whether to certify arizona or not. mitch mcconnell said the u.s. won't bow to thugs and they will finish tonight. the republican senator from montana and the republican from oklahoma indicated they were for not certifying these electoral votes. they have switched their position. they said we must stand together as americans and defend the constitution. kelly loeffler from georgia switched her position as well.

and hoyer the house majority leader said the following: little did we know we would be facing the enemy from within. we need to work together and tame and reduce the hate that some stoke. this breach here at the capitol was significant. i can think of only two instances with a breach like this. in 1954 when puerto rico nationals shot up the third floor of the capitol and when the pressure stormed and burned the capitol in 1814. that's how significant today was with that breach here at the capitol. >> sean: i know you were in the basement if i am not mistaken, in your office studio down there, they did know there was

you gave a powerful speech. you yourself were a victim of violence on that ballfield. you nearly died that day. we saw the heroism of the capitol police officers that walked into an open field against a guy with a rifle that hid in camouflage. i watch what happened today. we saw so many americans, hundreds of thousands of them, come from across the country. most of them peaceful expressing what they believe are significant and i agree with them issues involving our election process. then you have other people who were able to breach the capitol within minutes. i am stunned that could happen and we have to hold those people responsible. >> absolutely, sean. there is no place for what happened today. police that stormed the capitol

and attacked the capitol police. there were assaults on police officers as they were breaching and getting into the house and senate chamber, but into the capitol itself and ensuing violence. there is no place for violence in america. you and i were against it during the summer. we are equally disgusted by what happened at the capitol tonight. i wish my friends on the other side of the aisle expressed that same indignation over the summer. it should not have happened when they burned cities down. the message ought to be clear that america won't be run by mobs. we are a nation where we celebrate our differences. we allow a discourse to share a disagreement. violence is never the answer to disagreements. it should not have happened in the capitol today.
