the convicted mastermind 18 sensational murder for hire case is back in court. stephanie chuang is live outside the courthouse with the latest developments for us. good morning. >> reporter: good morning. this is a huge case in the south bay. murder for hire mystery that appears to involve a love triangle. a jury has convicted paul garcia of first-degree murder but there could be new developments in the courtroom this morning. to refresh your memory garcia bought two popular bars in 2007. the d.a. was able to convince a jury that garcia became obsessed with the bar tend here was apparently in love with achilli. during the 2010 trial garcia's attorney argued he was framed. garcia has a new attorney who says there needs to be a new

trial. he thinks the previous attorney did a lousy job, failing to interview key witness and alleged get away driver. the defense trying to review footage at the bars. the hit man was sentenced to life without the possibility of parole. the middle man got 25 years to life. the only one is paul garcia and we expect to learn more at 8:30. stephanie chuang, nbc bay area news. >> also this morning a man accused of abusing his ex-girlfriend's daughter will be sentenced today. george rodriguez pleaded guilty child entangerment and inflicting injury on a child. in may he accused his ex-girlfriend's 3-year-old daughter, rolled her in a carpet and left her in the garage. rodriguez's 15-year-old son found the girl. rold rod is set to be sentenced

at 8:30. >> police need help finding the man they think is responsible for a rash of burglaries. morgan hill police looking for 21-year-old jose torres. they think he is responsible for at least seven home robberies between december and early january in the area of san ramon drive. they saw torres in that area at the time of some of the dla burglaries. >> $38,000 missing from milpitas high and police think a school employee is behind the theft. this morning she is behind bars. police arresting 60-year-old may gardena. the district notifying police in september that a large amount of money was missing from a safe at milpitas high. she had access to the safe and information on the district's accounting practices. the missing money was for the

senior prom and transportation. the liability insurance will be covering the cost. >> bart is taking steps to make sure riders are safe. if a big one hits. b.a.r.t. directors approved a $7.7 million contract for the next phase of a major seismic retro feet. it's part of b.a.r.t.'s 10-year earthquake safety program. agency officials say the program is 85% complete. >> the governor will discuss the budget and pension reform on news and talk radio stations. governor brown is proposing a 401(k) type pension plan. so far he hasn't gone to any one in the legislature to sponsor it. he hopes to push the legislature to take up that issue. >> it's 5:05.

oakland back at it planning to take over a bacon building in oakland to step a new questioned quarters. it lools a new direction for the occupy movement. there will be a two-day party called the oakland rise up festival and will include speakers and music. manning to gather at noon, then march to the takeover location which remains a secret. if police and the city try to take action against them, they will block oakland international airports, occupy city hall and shut down the port of oakland. tomorrow vallejo remembering a fallen police officer. the event to honor jim kapu is a 29-mile walk. he was shot to death as he chased a robbery spt. that spt will be in court

tuesday. jim kapu walk is at 8:00. the cost is $30 per person and the proceeds go to the family trust. >> new developments in the italian cruise ship disaster. let's turn to marla tellez live in our newsroom with a look at a few of the international headlines. >> good morning. we'll begin in italy where the company that owns the capsized "costa concordia" has figured out how much it's going to pay the passengers who survived on that day. it's offering $14,640 to each passenger to compensate them for lost baggage and other damages. the company will reimburse the full cost of the cruise, travel expenses and medical expenses from the tragedy. about 3200 people survived so that means costa is paying out

47 million. the death toll stands at 15. more protests in egypt as thousands pour in again. but it's a different scene from earlier when thousands gathered to mark the one-year anniversary of last year's uprighting that brought down hosni mubarak. they gathered the mark what's called the day of wrath or the friday of rage. a year ago hundreds were killed in protests that caused the collapse of mubarak's security forces. in iraq at least 32 people are dead and the number continues to rise after a suicide bomber detonated a car full of explosives. this happened in southeastern baghdad for a person killed the day before. more than 60 people are hurt, it is the latest deadly attack since the u.s. troop withdrawal.

>> thanks, marla. >> time to check your weather. meteorologist christina loren is in the nbc bay area weather center with all of the details for this beautiful friday. >> let me clear my throat. sorry you sought it out there. hey, it's friday and so we're letting things slide. as you get out the front door give yourself plenty of time. you don't want ta go rushing out because we have dense fog especially at the immediate coast and around your bodies of water. oakland showing up with some really low visibilities. less than 200 feet in spots. over all it's mild, starting out so wise we're going to see a comfortable afternoon. low clouds will make way to sunshine by mid morning. i'm forecasting clear skies over the greater bay area, even san francisco by about 11:00 a.m. throughout the second half, the winds will increase, 15 to 25

miles per hour. then this weekend we're going to get gorgeous weather. we kick off the first week of february we hold on to unseasonably warm temperatures. up to about 60 by noon today. right by the bay. 61 at 4:00 p.m. as you make your way home, getting ready to enjoy that comfortable weekend. we have changes on the way as that jet stream take as dip to the south. rain chances just about every day. i'll let you know when the rain is looking most likely for the greater bay area and looks overall cooler and cloudier. enjoy that sunshine while it lasts. >> out to the maze. a lot going on there. first the debris reported, this is eastbound 580 heading away from the maze. right around 980 or broadway t off ramp. a large chunk, something in the road, might be tough to make that out. it might be tough to see that christine has talked about.

>> welcome back on this friday. mother nature may be working in favor of the famous maverick surf competition. the big wave contest could happen soon. there were high surf warnings yesterday, swells up to 15 feet along the peninsula coast and breaking waves on the beaches, as high as 20 feet. the competition can happen at any time in a three-month window. surfers get a 24-hour notice to get the boards and hit the waves. the contest director says right now it's too soon to say whether it's a go because of that heavy fog. >> so amazing to see those waves

they tackle. >> mind blowing. >> and what they pass on. they will have a high surf advisory. not enough for us. >> amazing. >> their chance is going to diminish soon. we're going to see offshore flow so the winds courtesy of onshore flow, a thing of the past this weekend. that means we won't have to deal with the fog as we'll see a ridge of high pressure pushing our winds from land to sea and pushing the marine layer out into the pacific, this morning it's right over the coast so very low visibility as a result. all the way from santa cruz to santa rosa. and the fog is starting to drift over the bay, so oakland you're dropping off significantly. san jose, we're clear as a bell with 10 miles or better. as you can see now. high pressure is in control of our weather pattern. the storm track in the pacific northwest. things are going to start to

change. the jet will come back in the bay area. it's going to hover over the north bay so the best chance for rain looks like tuesday, wednesday and thursday. and the further north you live in the bay area, the better the chance will be. through the next 48 hours as high pressure sets up it's going to clear skies, push the marine layer but breezy as a result of the east bay hills and the north bay mountains. heading to southern california they are dealing with the santa ana winds. watch out as you head over the grapevine. mostly sunny as we head throughout day. slight warming. by saturday, mild, hazy sunshine, lots of sunshine for sunday. if you want to make outdoor plans we encourage you to do so with gorgeous conditions. for the final weekend of january. 65 degrees in san jose, 66 milpitas, 67 in concord. you'll hit about 65 in san rafael. your seven-day outlook tells the story. looks good. sunday, clouds increase, then we get the rain chance tuesday into

factory conditions in china including deadly accidents. cook in the e-mail to employees called the times article offensive and defended the company, but there are lots of indications in the e-mail that cook is making changes and takes the problem much more seriously than his predecessor did. every year he says we inspect more factories, raising the bar for our partners and adds we will continue to dig deeper and we will undoubtedly find more issues. last week apple issued its own self assessment of conditions, finding many workers were overworked but finding fewer child laborers than previous years. apple released a list of suppliers as well though it didn't say which were violating which rules. jackie spear among eight congress people to send a stern letter to going toing asking for information about its recent

then clearing down south through sunol into fremont. >> thank you, mike. >> it's 5:30. one of the south bay's sensational murder cases heading back to a courtroom. stephanie chuang is live outside the courthouse where the convicted mastermind behind a murder-for-hire plot will be in court. good morning. >> reporter: good morning. a jury convicted paul garcia of first-degree murder but there have been new twists. garcia has a new attorney who is saying the previous defense attorney -- he wants a retrial. garcia bought two bars back in 2007. the d.a. was able to convince a

jury that garcia became obsessed with a bartender. garcia was found guilty of hiring a hit man and a middle man in a plot to kill out of a rage. his new attorney again says that the previous defense attorney failed to interview a key witness, an alleged getaway driver. also, we are expected to learn the status of the defense team's attempts to review security camera footage. we should also learn about a possible sentencing date at 8:30 here at the court house. stephanie chuang, nbc bay area news. >> thank you very much for the report. >> police are investigating berkeley's first homicide of the year. police found a man shot several times near an apartment building. he was taken to the hospital where he died. police say it was not random and talked to people after looking

for leads. >> more than a dozen homes are being rebuilt. while there is progress critics of pg&e say the explosion could happen any time wraen. residents joining to discuss rebuilding the crestmore neighborhood. 38 homes were destroyed. eight died. 13 homes remain under construction. one resident is less than a month from moving back. >> it will be a better place to stay, to live, you know. many of the people are not coming back. it won't be the same again but it will be home. >> residents say they still do not trust pg&e or the utilities commission. since that explosion pg&e has made a new commitment. >> ross mirkarimi must stay away from his wife and son by judge order. mirkarimi returned to court with a new attorney asking for the

stay away order to be lifted. the judge refused. considers cited two e-mails from his wife which she thought about running away and accused mirkarimi of neglecting their son. the attorney argues that child protective services probe did not find evidence of abuse or neglect. >> fired and fighting back. one of the largest employers accused of age discrimination. 130 former employees slapped lawrence for the lawsuit. they believe they were fired because of their age. after a long time battle the case is going to trial. we spoke to an attorney for one of the plaintiff who is says it's a classic case of age discrimination. >> they turned around and the only way that they could is to do all the time, they had to let long term workers go close to

he is pulling out of florida days before tuesday's primary. santorum says he would rather spend saturday at his table doing his taxes. than campaigning 18 state where he admits he probably will not win. the cash strapped candidate has acknowledged he can't keep up with gingrich and romney. some have urged him to pack up in florida completely. >> the cruise ship belonging to the same company still reeling from the disaster in italy will be in the bay area. the ship is sailing in from l.a. this morning. we're learning the parent company costa cruises, has offered more than $14,000 apiece after the "costa concordia" capsized. it will reimburse passengers for lost luggage, travel costs, psychological trauma and medical expenses. the death toll now stands at 16 with 19 still unaccounted for.

francisco, this morning, starting out mild. we have dense fog especially at the coast. let's show you what we expect from the fog. offshore winds kick up later this morning. i think we'll be out of the fog by about 9:00 a.m. you can see at noon a nice clear bay area. looking toward comfortable conditions. taking the jet stream to the north we have a little dry trough. that will kick up the winds once that area is up in the great basin we're going to see the f offshore winds warming. so for us that means clear conditions early, we're not going to be socked in with fog. we have the mix of sun and clouds. mostly sunny. and slight warming as a result. tomorrow mild, hazy sunshine, the same for sunday. high pressure takes control and sets up. finally going to break down and move to the east.

allowing for rain chance. 65 degrees today in san jose. you had about 66 in mill pete. 65 in san rafael getting comfortable temperatures up to the north bay. napa 67. saturday and sunday the clouds increase a little bit ahead of a front that could bring us showers especially in the north bay monday into tuesday. a better chance of rain wednesday into thursday. showers for the greater bay area. you can see the lows and high temperatures down next week so. enjoy that sunshine and the warmth while it lasts. next week cooler, cloudier with a few showers. >> we'll start for our friend in the south bay. not an issue as far as traffic. southbound 17 the flow off of the roadway at lark, that's still blocked by construction crews. set to clear over the next few minutes. 880, that construction cleared so milpitas and over into

sunnyvale, the commute direction is fine. on the peninsula lower bay shore, on and off ramps, crews still there. 10 to 15 minutes. heading over to the newark side you have no major issues but construction typical. lower the speeds, though. the san mateo bridge camera shows what it's like on the hayward side. these headlights coming over from the peninsula we cannot make out the roadway. low visibility is a problem. in fact, the sign -- you can't see it to this side of the screen. it will barely be seen, heavy fog on the bridge. golden gate bridge the same situation. very heavy fog out of the north bay. lower speeds, expect a lot of slowing through novato around 37, that's where some pretty thick fog was reported but a general note, fog and misty slick roadways.

>> thank you, mike. breaking news this morning on the san jose state campus, police are searching for a man who allegedly broke into a dorm and groped a victim. campus police have a vague description of the suspect who is a man in his 20s. officers say he was last seen on the third floor of the joe west building on campus. police are asking all students to lock their doors. we have a crew on the way. we'll bring you updates throughout this newscast. >> the london olympics six months away and the city's mayor is counting the days. mayor johnson says the city is ready to deliver what he calls and predicts a summer like no other. all of the major venues complete, now the focus has switched from building to staging. meantime, the head of olympic security has emphasized police will be ready to make sure the games are safe and they are secure. >> it is official, the oakland raiders hired a new head coach. former broncos defensive coordinator dennis allen signing a four-year deal to become the

raiders new head man. 39 years old and he's never been a head coach. still a young cat. he is the seventh coach since 2003. that's a lots of turnover. he is the first head coach with a defensive background for oakland since back in 1969 when they hired john madden. >> some things are more important than the super bowl. tom brady spoke to the media this week about the health of his long time friend and quarterback coach tom martinez. the 68-year-old coach is in desperate need after kidney transplant. he is hopeful his mentor can find a donor. the former coach, martinez lives in the bay area and is working with brady since he was about 13. brady has stayed in touch with martinez throughout his career and in a recent interview with nbc bay area martinez said brady still calls him for advice every few weeks. >> preparations for super bowl xlvi in indianapolis moving along as scheduled. only nine days away from super
