it. >> leave it to the pros, the rest of us don't turn the back on the ocean ever really. thank you very much. we'll see you in a bit. a developing story the 49ers, with a story bigger than football. the investigation continues into an alleged sexual assault involving the star wide receiver, michael crabtree. the 25-year-old is now in atlanta preparing for tomorrow's big game against the falcons. closer to home san francisco police say they interviewed crabtree along with his attorney earlier this week about the alleged attack that happened at a hotel early sunday morning. that alleged attack happened a few hours after the team's win over the green bay packers at candlestick park last weekend. crabtree played a huge role in that win with nine catches for nearly 120 yards and two touchdowns. 49ers fans were surprised about the investigation but say they won't drop support of the star until there's more information. >> i don't know. i'm hoping it's not true. we need him out there this

sunday, so i'm hoping it all works out for him. >> his on field performance was great, don't know anything about the guy off the field. >> does it matter? >> if he's guilty it kind of matters. >> but you don't know. >> i don't know. innocent until proven guilty. >> i don't know, i haven't heard enough information, so i don't know. can't say. >> the 49ers released a statement that says in part "we are aware of the allegation against michael and understand that he has fully cooperated with authorities. the 49ers take matters very seriously. we will have no further comment at this time as the legal process is ongoing." police say crabtree agreed to any additional interviews related to the accusation, the special victim's unit is handling the case. crabtree is still expected to play in tomorrow's game against the falcons. it should be noted crabtree has no previous legal issues, all of this unfolding as the team

"today in the bay's" george kiriyama was there. >> reporter: gina gates says because of the confrontation between her family and christopher soriano's family they will not be sleeping in their homes tonight. they have separated and are staying at other locations because they fear for their safety. >> my niece, who lives with ricardo, that's like her big brother. she had to go and live in a motel room thinking things were going to be safe but she's relocating to southern california because we cannot have her here. >> [ bleep ]. >> that was not a fight. that was an ambush. >> the family of ricardo hernandez could see this coming. the family threatened them in court during the proceeding. >> when you strike someone in the face you're going to get struck back in the face so it's not a fight. what we're trying to do is follow the law but please, you

know, people in the law you've got to protect us. >> reporter: ricardo hernandez is accused of shooting and killing christopher soriano a man he suspected to be a serial burglar new year's eve. >> i don't think anyone deserves to die, if he was committing a crime which hasn't -- >> reporter: both families have fallen on hard times. >> his family received a letter addressed to ricardo sent to his home evicting him, giving his family two weeks to leave their home. >> he had no weapons or nothing. he didn't deserve that. he was shot in the back, and i'm a widow with five kids. we're homeless now, me and his kids because of this. >> the next court date is february 15th. san francisco sheriff ross mercury is again in the news and not for doing what he's supposed to be doing on the job. he and his wife are being sued by their next door neighbors.

ivory madison and her husband claim they damaged their reputations during the sheriff's domestic abuse saga. madison videotaped a tearful eleana lopez following a confrontation. it claims they falsely accused madison and her husband of conspiracy and lying to police. neither madison nor her husband have commented to nbc bay area. but we did speak with the lawyer that represents mirkarmi. he says "this is another unfortunate example of a baseless lawsuit that will only clog up the court system. i have no doubt it will be dismissed." lopez' attorney paula kanni called the case a disappointment. in the east bay the search is on for a 13-year-old hayward girl who has not been seen since thursday.

live at the waves at ocean beach. if you head out to the beach today folks the weather will be perfect but the waves are dangerous so don't turn your back. we saw a different side of lance armstrong during his interview last night with oprah winfrey. the disgraced cyclist became emotional as he talks about the role his children had in his coming clean about using performance-enhancing drugs. nbc's kurt gregory has more from the revealing interview. >> are you facing your demons? >> absolutely. >> reporter: on the second night of a revealing interview with oprah winfrey -- >> what do you say to those millions of people who believed? >> i say i understand your anger. >> reporter: lance armstrong said losing his connection to his charity livestrong was his lowest point. >> the foundation is like my sixth child, and to make that decision and to step aside w

truth. >> i'm deeply sorry for what i did. >> reporter: now that armstrong is finally admitting it to himself. kurt gregory, nbc news. >> it will be a busy weekend for bay area sports fans. the 49ers taking on the falcons in the nfc championship game tomorrow. the winner heads to the super bowl kickoff at noon in atlanta. also the san jose sharks are leaving the lockout behind with the season opener in calgary tomorrow. the puck drops at 4:00, and the harlem globetrotters are in the bay area for four games, two at oracle arena today, two at hp pavilion in san jose tomorrow. finally tens of thousands of people will flock to half moon bay tomorrow morning for the mavericks invitational surf competition. surfers expected to hit the huge waves around 8:00 in the morning but there are strict, new rules which will keep the fans from getting onto the beach to watch, some local technology, however, could offer you an even better

anthony slaughter is here and the same system making fantastic waves make dangerous waves for folks who want to walk along the waech beach. >> we have quite a few really hazards as we head through the upcoming week and the first to spare the air alert for our north and central bay, that's where we're looking at unhealthy air quality everywhere else, moderate quality but notice high surf advisory all the way down from monthry bay up into the north bay so anywhere across the bay if you're making plans to head out to the beach use extreme caution. look at the swells we're already seeing off into the pacific, our buoys are reading up to 10 to 11 feet and that is just what's to come as we head through the day today and again tomorrow, we're talking about swells that could top 20 to 30 feet at the coastline so you want to make sure you use caution if you're going to be out there. leave it to the surfers for this weekend. by tomorrow the temperature also warm nicely. temperatures close to 70

degrees. beach hazards really include the high surf advisory, the sneaker waves and rip currents that are strong that could pull you out and if you get caught in one of the rip currents best thing to do, swim parallel to the coast not trying to fight the waves. it's cold, we're at 28 degrees in santa rosa, 40 in san francisco, 30 down in gilroy. we've got this by high pressure area in control of us, it's going to lead to dry conditions. temperatures close to 70 in gilroy, even in the lower 70s for santa cruz and most of our coastline will get close to 70 degrees today, even san francisco 69 degrees, our average high for this time of year, only right near 60 so we're about five to ten degrees above average for today, get out and enjoy and notice for tomorrow, lots more sunshine expected with temperatures again close to 70 degrees. not only inland but at the coast as well. hang on, if you have to work this weekend, mlk jr. day bright

all right, folks, we are off to a beautiful start at ocean beach, waves are going to be something to see but watch them from a distance. we have dangerous surf conditions as well as the upcoming mavericks invitational. well' talk about that in a moment. first thanks for joining us and good morning. we have meteorologist anthony slaughter who has the forecast for the weekend and it looks like it's going to be very nice. >> it is going to be very nice. as far as the waves go, watch them closely and from far away. i don't know how that goes, much closely far away? it's 7:30 in the morning on a saturday. you get the idea. high surf advisory in effect for today so the dangerous surf going to be something to keep an eye on and again this is because we have that large system out on the pacific, pumping in those very large swells. temperatures are cold this morning, hard to believe it will warm up, close to 70 degrees later on, many places in the 20s and the east bay and the north bay, 28 our cold spot in santa rosa, we are going to warm up as i mentioned, 69 in san francisco

today, 69 in livermore. our warm spot santa cruz along the beach, it's tempting 71 to get out and enjoy the water but make sure today if you get out and enjoy the water, keep an eye on it, of course don't turn your back on it. >> watch the kids and the pets. islamic militants hold ten but possibly dozens of foreigner hostage this is morning. details emerge some of the hostages have already been killed in the standoff. for the first time the u.s. confirming americans are among the remaining hostages and at least one american hostage was killed in thursday's attack. at least 12 people, perhaps many more died in that government attack on the militants. algerian officials say about 100 of the 135 foreign workers on the site are now free and 18 of an estimated 30 kidnappers were killed.

it is an emotional debate with no easy solution. what to do with the elementary school in newtown, connecticut, where 20 children and six staff members were massacred? town leaders held their second public meeting last night to discuss the school's future. nbc has the latest for us this morning. >> reporter: the building that was sandy hook elementary school in newtown remains blocked, as the criminal investigation into the tragedy that claimed the lives of 20 children and six educators goes on. across town -- >> i think that that building should be a memorial, as you said. i don't think it should ever be a school again. >> reporter: it's a debate over that building's future, inside newtown high school more than 100 residents gathered to offer their opinions, among them a monroe police officer who lives in newtown and was at the school just days after the incident. >> i know what happened and i see it, and i, you cannot ask

anybody to go back in there. >> reporter: besides hearing from the public about what to do with the building at the end of this long driveway, town leaders are holding private meetings with the families of the victims and survivors. they're also talking with teachers and staff who work at the school. >> i think that it's really the decision-makers should be the families. i think we all are entitled to our opinions but i think what they say should go. >> reporter: also talking this staff member who was at the school when the shooting happened. >> it's important for me to help the rest of the children in the community heal. >> reporter: residents coming together speaking out in their struggle to move on. >> we are standing with full reaching love. >> sandy hook elementary school returned to class at a neighboring school in monroe, connecticut. recommendation on what to do with the old sandy hook building could come in the spring, the

town leaders say splitting the kids up into different schools is not one of the options. now to that developing story involving 49ers star wide receiver michael crabtree. he is in atlanta this morning, but before he boarded a plane with his teammates he sat down with san francisco police who were looking for answers about an alleged sexual assault. san francisco police interviewed crabtree along with his attorney earlier this week about the alleged attack at a hotel sunday morning. the alleged attack happened just a few hours after the team's win over the green bay packers at candlestick park last weekend. nfl.com reports the victim did not contact police until a few days after the alleged assault. crabtree played a huge role in that win with nine catches for nearly 120 yards and two touchdowns. 49ers fans say they don't know much about the investigation, but they're reserving judgment.

other cars involved in the accident as well but fortunately no major injuries. the chp says there is no estimated time on reopening the roadway again. interstate 80 at central avenue and the exit ramp is also closed. a san jose family says they will not be going home any time soon after they were involved in a fight with another family outside the santa clara county courthouse. this happened after a court proceeding yesterday afternoon as the two families walked out of the courthouse. first angry words and then there were fists. ricardo hernandez is accused of shooting and killing christopher soriano new year's eve. he suspected he was a serial killer at the summer breeze apartments in san jose. spokesman says the family was not surprised at the soriano family threatened them in court during the proceedings. >> when you strike someone in the face you're going to get struck back in the face so it's not a fight. what we're trying to do is follow the law but please, you

know, people in the law you've got to protect us. >> [ bleep ]. >> the next court date is february 15th. the hernandez family hopes the santa clara county sheriff's department will take steps to prevent another fight from happening then. a stiff sentence for a high profile burglary, the man who broke into the late steve jobs' palo alto home last year was sentenced to seven years in prison yesterday. 35-year-old karim mcfarland was found guilty of breaking into the house of late apple co-founder steve jobs. he pleaded no contest to stealing at least two computers, an ipad, jewelry, jobs' wallet and driver's license. the former san jose state football player also pleaded no contest to four other bay area burglaries. in addition to prison time he has been ordered to pay restitution to all of his victims. repairs to the fenders of the bay bridge will begin on tuesday. the fenders were damages when

the oil tanker sideswiped the bridge january 7th. c caltran officials say the fender system absorbed the impact as it was designed to do so the main pier has no structural damage. the project is expected to last about four and a half months. altransallocated up to $3 million for the repairs. still ahead on "today in the bay," a big change for travelers at local airports, what the tsa is getting rid of. plus breaking his silence, notre dame star manti te'o speaks out for the first time since it was revealed that his alleged girlfriend was all an internet hoax.

the controversial body scanners that show naked images of travelers will be removed from local airports. the tsa will remove eight scanners from the san jose

head through the day today and again for tomorrow so that's why we have a high surf advisory in effect. our buoys off of half moon bay reporting about seven-foot wave height. winds only 7 miles per hour but the main concern is going to be strong rip currents and very dangerous sneaker waves that claim lives every single year. so that high surf advisory in effect not only for the bay area but all the way down through monterey bay and north bay as well. use caution if you're headed out to the beach today or tomorrow and with that said we also have a spare the air alert in effect for today for the north bay and central bay as well. east bay, south, central bay and the south bay not as bad but as you saw earlier in the sky cam in the south bay we have haze building in san jose and it's cold. 37 degrees this morning in san jose. notice the cooler spots in the east bay, livermore only at 29 degrees, concord there as well, santa rosa at 28 degrees. we have this big dome of high pressure sitting on top of us so we're expecting plenty of

sw. it is a beautiful, golden start to the day in san francisco, and throughout the bay area. little chilly now but if you liked yesterday it will be even warmer today. this is one of the most bizarre stories in sports, and even beyond. this morning, notre dame linebacker manti te'o finally answering some questions about a fake girlfriend. te'o made his first comments last night in a one on one interview with espn since the story broke earlier this week, in that interview he claims he was not part of the hoax, saying, "i wasn't faking it. i wasn't part of this, when people hear the facts they'll know." however, te'o did admit he lied to his father about meeting the woman and may have embellished details about the relationship. he also said the alleged mastermind behind the hoax has apologized to him.
