minutes. we're following breaking news in the tyler cost case. he's the teenager accused in a string of sexual assaults involving more than a dozen high schoolgirls. >> we are joined live from florence. the judge is not going to dismiss the case. >> reporter: so far, that's what we're hearing. judge white is not going to be dismissing the case, at least from what we heard from inside the courth when cost was arrested at the age of 18. today the judge granted a request to move forward with one trial instead of separating it out into two. of course the defense is pleased with that decision and also that the court previously granted their motion to dismiss the first four counts against cost. the defense required the prosecution turn over any rating material they have. that's considered evidence

about president obama? you rarely hear someone on the opposite side complimenting the other side, but an attack ad against the republican candidate claims she did commit that cardinal sin. graham is fact checking the ad in tonight's campaign report card. >> reporter: a tv ad targeting christine jones claims she's a republican who said nice things about the country's top two democrats. a capable and respected leader and an effective secretary of state. when obama was reelected, jones offered support and said get excited. >> reporter: the ad was paid for by a group backing one of jones' opponents. jones faced a similar attack ad during her 2014 campaign for governor. she made the comments when she was a private citizen.

these guys. >> we drive by every day. i kept noticing all the prairie dogs. >> reporter: relocating these animals humanely is high priority. >> they deserve a chance. they have a better chance with us helping than the bulldozers. >> reporter: luckily habitat harmony and arizona game and fish were at the ready to help remove as many animals as possible. >> we blast dawn soap into the hole and the suds are to push the prairie dogs out and then we catch them. >> reporter: it's a simple, yet tedious process. so far, 7 prairie dogs have been captured but there are over 200 holes to be flushed out. the goal is to remove and relocate as many of the animals to a special spot. >> this will be a really good site for the prairie dogs because they really want to reestablish their prairie dog colonies out there.

today. we were four degrees below the average for this time of year. and even though the latest radar shows we don't have much going on, we do still have some activity out there that could impact us later. you're seeing storms line up over southwest maricopa county. they're moving in a northeasterly direction. we cannot rule out the possibility of an isolated storm or two moving in over the evening. the most active area mojave county. kingman getting slammed with heavy rainfall. so watch out in that area. flooding is going to be your biggest threat. you should watch out for gusty winds and the potential for a lot of lightning as well. out to the eastern part of the state, flagstaff quiet, peson is quiet. tomorrow is looks like the high country will stay active while the central and lower deserts
