that the suspect is down, possible three patients. chopper has been put on stand- by. >> a clark county sheriff's deputy was shot to death serving an eviction notice this morning at a bailey home. a man opened him on him and two other deputies who were wounded. the suspect was killed. 9news crime and justice reporter anastasiya bolton joins us now live from bailey. >> reporter: let's join the press conference that's going on live. it just started. susan medina, public information for the colorado department of investigation, is talking. >> he's had a lot on his plate today. he's spent the majority of it at the hospital with the family of one of the members of his agency that was in surgery for most of the afternoon and with the family of the other deputy who was transported to st. anthony's for treatment. he wanted to stay with that family, both families by their side throughout the entire afternoon. that was his priority and as we move forward through the day

going to come back up the mountain. he's going to meet with his team here and do some other things to really take care of each other. so while he wanted to be here, he wanted me to express that, why he isn't, and also share his thoughts of thanks and great pride for this community. it's been a tremendous outpouring of support and truly love and we greatly appreciate, that especially the sheriff. so that's why fred isn't here. we're hoping the sheriff will make comments at some point. it won't be today won't be tonight, but we'll really stay with that piece. a news release was recently sent out by the clark county sheriff's office, as you know. that news release details the events of the day, listed those members of the clark county sheriff's office who was shot and it also provided a little bit of an update from the sheriff himself. if you don't have access to that information, you can find it on the jefferson county

the cdi is pushing that information out through its lip sent that out. there are a lot of information. before we provide an update on this case i wanted to talk a little bit about corporal nate kerrigan. so i don't profess to be able to share the stories that are going to be released about nate and what he's meant to this community and what he's done to help everyone around him. what i do know is that he served his community in a superior way and he made the ultimate sacrifice today in his service to that community and as we go into the evening and we're doing things with our families, we just ask that you keep nate and his entire family in your thoughts and prayers of turn on your porch lights. talk about nate. talk about all the wonderful things that our law enforcement confidents are doing on the streets of our country each and every day.

definitely talk more about nate and what he's meant to the community. it's just not my job to do that right now because i just couldn't begin to capture that. [ can't hear reporter question ] >> that i can't confirm. we'll go into questions in a minute. i have an update on the condition of the others shot and injured today. master patrol deputy colby martin was transported to st. anthony's with life threatening injuries, was in surgery most of the afternoon. he is in critical condition is the report from the hospital at this time. i'm very happy to report that captain mark hancock was also treated at st. anthony's and he has since released. so he is with his family at this point released from the hospital. an update on the case, earlier today the clark county sheriff's office requested the assistance of the colorado bureau of investigation to process this scene and to conducts the investigation with the help of the jefferson

course, clark county with the cdi we're looking at about 100 people who have responded to this area to unravel this very house. so they're working steadily throughout the afternoon and they're going to go deep into the night long after the sun sets to process as much of this area as they can and they'll keep coming back to the scene until it is processed as completely as possible and as professionally as our people are trained to do. so in the news release the suspect's name was released. i think you all have that. i know there are a lot of questions in connection with unfortunately at this time we information. we know there are a lot of rumors and chatter and things of that nature, but we just can't make any specific comments about his background or what that may involve. so we are going to keep processing that, learning more we can and when we do have

to provide that. >> reporter: can you talk about what the priority is from let's say now until morning? i mean you you talked about processing the scene. what does that entail? priority tonight? scene. that means we have our crime scene vehicle up in that area. any number of agents and investigators, so the effort is happened. so they're going to conduct a number of interviews. they're going to collect evidence. they're going to canvas the neighborhood. they're going to do what they can to really build that complete picture that relays what took place today. >> we've been listening to susan medina, the pio for the colorado bureau of investigation. we've been told clark county sheriff fred wagner is at st. anthony's hospital with one of the two deputies that remains hospitalized.

filling in is that these three deputies were serving what's called a high risk eviction wirth. they say they saw shim -- eviction notice for martin wirth. they say they saw him on his deck and followed him and that's when shots were fired. >> one of the deputies, an 11 year veteran of the clark county sheriff's office identified as deputy colby injuries. we are told the other officer, captain mark hancock, a 21 year veteran of the department is said to have nonlife threatening injuries and has, in fact, been released from the hospital. today's deadly shootout has shaken the small mountain community of bailey. many residents there personally knew the officers involved. 9news reporter christine noel is joining us from bailey this afternoon. we have learned this kind of violence is very rare in that part of our state. >> reporter: it certainly is,

we are about 200 yards away from the shooting that happened this morning. there has been a strong police presence out here all day from at least four different agencies investigating. i do want to show you about 200 yards away you can see a white trailer. next to that white trailer there is a brown porch. we are told that that is connected to martin wirth's home, the one he was living in that is also the property where three clark county deputies we're told were serving an eviction notice to wirth when gunshots began ringing out this morning. in the past two hours we've seen a s.w.a.t. team enter in full gear into wirth's home. we don't know what they were looking for or what was found. there was a bomb squad out here out of an abundance of caution. investigators say residents at this point are not in danger. i spoke with some neighbors who live in this friendship ranch community. it's pretty close-knit, not a lot happens here, fairly quiet

martin wirth, he tended to keep to himself. residents did tell me they're very, very upset that a deputy lost his life today. >> there's all kind of people up here and one rule of living in the mountains is you don't mess with your neighbors, but what this man did is uncalled for. >> sick, sick to my stomach. they're doing their job and you have some crazy person take that away from them. >> reporter: and it's a still pretty active investigation out here. we do see several law enforcement agencies combing through the screen. scene. there is a vigil to be held tonight. a lot of local community members trying to wrap their minds about what has taken place tonight. >> very busy place. the man shot by sheriff's deputies was facing eviction for a second time. online martin wirth was

tried suing fannie mae over his foreclosure. here's 9wants to know reporter jeremy jojola. >> reporter: martin wirth had a strong distrust of government and law enforcement described as an activist with occupy denver, not holding back his opinions. we learned wirth was accused of killing a man in 1994 over a game of chess, was tried and acquitted. then the battle over his home, court records showing fannie mae foreclosed on his house several years ago. he tried suing fannie mae in september of 2014 but last the case last year. on youtube wirth can be heard ranting about what he called an illegal foreclosure and then for a second time fannie mae filed eviction proceedings against him in january. as deputies closed in, wirth's resistance ended with gunfire. for now we don't see any recent violent incidents on his record. we did find two dui cases in

>> i'm sure we'll learn more as the days progress. jeremy jojola, thanks so much. a mumps outbreak has the state warning doctors and hospitals across colorado there are at least four confirmed cases in denver and two more possible. all the cases are in the metro area. a coloradan who recently visited iowa where there was an outbreak brought it back here. the patient passed it to friends and they infected some medical professionals at a denver area urgent care. everyone diagnosed with it so far had been vaccinated, although the vaccine is not 100% effective, 9health reporter dr. john torres says it's still worth getting. >> make sure you have that protection. if you do get the mumps and have been vaccinated, chances are it won't be as intense. >> those vaccinated don't spread the mumps as easily which is typically spread through coughing and sneezing. symptoms include fever, headaches, muscle aches and swollen glands. authorities say two people died as powerful storms ripped through eastern virginia today raising the death toll from the tornadoes and severe weather

three people were killed in louisiana and mississippi when tornadoes hit there tuesday. dozens of other people were injured. severe storms are impacting several states along the east coast this evening from florida to the mid-atlantic. clean-up underway in northern florida after severe weather moved through last night. a tornado ripped through a 2- mile path through pensacola destroying apartments, townhomes, vehicles and uprooting trees. this morning governor rick scott toured the area and pledged to get displaced residents into their homes as quickly as possible. >> all of us would say our heart goes out to anybody impacted by this. you can't imagine going through this with your family, with your children. >> last reportedly 70 home and 24 familiarities suffered -- homes and 24 apartments suffered severe damage. you may be wondering where to go if a tornado hits in your area. if you're home, go to the basement. you don't have a basement, go

recorded an e cigarette blowing up inside a man's pocket. flames shot out of his pants as he desperately tries to put the fire out. this happened over the weekend as the man was at a register inside a kentucky convenience store. the confused clerk says that he was in shock and at first didn't know what was happening. the victim says he has second degree burns on his leg but is that's incredible. >> wow. the flu vaccine is doing a better job this year. preliminary data is suggesting it is 59% effective. that's a big improvement you might recall from last winter's nasty flu season when the vaccine was less than 20% effective and people around you all were sick. unlike last year's vaccine this year's is a good match to the strain that's been making people sick. it's been a milder season, though it's not yet peaked. certain new york restaurants will not be fined for not posting salt warnings on their menus, a ruling handed down from a new york state supreme court judge.

restaurants to put a salt shaker icon on menu items that exceed the recommended daily limit of 2,300 milligrams of sodium, about a zappone. the national restaurant -- about a teaspoon. the national restaurant association sued in december to stop implementation. restaurants can be fined up to $600 for failing to post salt warnings beginning march 1st. you can now do more than just like something on facebook. as of today there are five new choices, love, ha ha, wow, sad and angry. you have to hold the thumbs up up. the rollout should take a few days. you will get the feature automatically on web browser. however, you will need to update your app on iphone and android devices. >> it's a good thing because people post so much information about families and when someone would pass, your only option was like. died, really? now. >> you want to offer your

out there, so far wind gusts between 25 and 35 miles per hour mainly over the higher passes and the winds should die a bit as we head into the 5:00 to 7:00 hour. at the airport now 44 degrees, winds cresting east of town out of the east at -- increasing east of town out of the east at 22 miles per hour, 42 degrees here at the corner of speer and logan. temperatures today mid-50s for lower elevations, 60s on the plains. we typically see mid-40s for highs this time of year, the trend before the warmer weather heading into the second half of the week and upcoming weekend and the trend the neck three months, well, el nino in full gear with above average readings expected across the west, northwest, colorado and the midwest and temperatures should be cooler than average across the southwest and southeastern u.s. not a lot to show you on radar for denver and points westward. our storm is creating all kinds of problems to the east of us.

they've had about three dozen tornadoes reported, heavy flooding and rainfall and winter weather advisories to the north of chicago extending towards cincinnati, hail, rain a big problem for the carolinas in the northeast overnight tonight and the tomorrow. it's a fast moving system. it moves offshore. high pressure moves in quickly behind it. we have a warmer day tomorrow. a weak front is draped along the front range, so there's a bit of a wind shift that will keep temperatures similar to what we saw today here while the cool wet weather continues well off to the east of us. the low 50s here, mid-30s in cloud cover. many areas. winds will lay down tonight and pick up along the foothills again tomorrow, but no wind advisories are in effect and the red flag warning has now canceled out. teens in the high country and lower elevations, a bit of a warm-up for some areas tomorrow, but the end of the week we see numbers jump up a bit. 42 in blackhawk tomorrow, 40
