live from las vegas it's time for fox5 news at 11. the school district is facing a lawsuit... why parents say their children were not protected in the classroom. a possible end in sight for the armed occupiers at an oregon wildlife refuge. how a nevada lawmaker may be helping in the surrender. turkey, juice, and other items stolen from a food bank that feeds hungry students. what volunteers saw, before the much-needed meals disappeared. this is fox5 news at 11. local las vegas. we're starting off with breaking news tonight at 11. an apparent domestic dispute ends with one shot to death in a drive way. i'm christine maddela. i'm john huck. this happened near lone mountain and cliff shadows. that's where we find fox5's abby theodros, who spoke to the victim's neighbor and police tonight. police say this started out a fight between a couple and with the woman shooting the man. if you look behind me you can see close to where this situation

some witnesses told police they saw the couple fighting others heard the arguments and a handful of witnesses heard that fatal shot fired. police tell us one shot was fired, they believe a shot gun was used, and the man was shot in the chest area. police are still investigating what happened leading up to the shooting but the woman told a responding officer that she is the victim of domestic violence. neighbors we spoke with tell us this is a quiet suburb with little to no police activity "we have a few police officers who live around the neighborhood... we all walk our dogs across the street and we've never had this kind of problem ever. we've lived here seven years." closed captioning

a man and a teenage girl are fighting for their hospital, after suspects who broke in their home. the home invasion happened around four-40 inside a gated comunity near town center and 215.

suspects took off before they got there, leaving their victims critically injured. detectives found a gun across the street at a park, and they believe it was involved in the crime. police want to assure everyone this wasn't a victims and suspects likely know each other. neighborsin the area should feel comforted in that fact that we don't have somebody randomly going out and targeting middle of the night police aren't information on who they are looking for anything in either of these shootings, call crime stoppers at 702-385-55-55. jerimiah mazo is in jail for sexually abusing his students... but before his 2015 conviction, he had a similar abuse accusation at a different school... now his victims parents are suing the clark county school district, because they say sexual abuse could have been avoided... fox5's miguel martinez-valle spoke to the lawyer leading the lawsuit, he joins us live with

the suit against clark county school district is meant to prevent more students from falling victim to abuse at the hands of their teachers... rober eglet, the lawyer leading the charges, says the school district had a responisbility to protect these kids and they failed. in 2008 school teacher jerimiah mazo was charged with sexually abusing his students at simmons elementary school, the case was dismissed... and clark county transferred mazo to hayden elementary... the law suit claims the district should have conducted their own investigation of mazo, they shouldve notified the parents of his previous accusations, or at the very least they should have made sure he was never alone with children... " " its their responsibility to do their own investigation, the criminal standard of proof is beyond a reasonable doubt, not what the standard is with the shcool district with these teachers, they failed miserably in their responsibility to keep our

eglet says theres no way of knowning how many children mazo abused, but he says parents of the victims who have come forward described their kids throwing tantrums in order to avoid going to school, being in bad moods on days they had to take his music class, one has even said they dont want to have children because they do not want them to be abused as well. we reached out to clark county school distirst for their side of the story, they said they do not comment on pending litigation. reporting live, miguel martinez- valle, fox5 news local. las vegas. mazo was originally facing 32 counts of child molestation, last year he pleaded guilty to three lesser counts of attempted lewness with a child in order to avoid trial. we have an update to a hit and run crash in north las vegas that killed a two year girl. police are still processing a van they believe was at the scene during the crash. police found a van

matched the description of the one they're looking for. determine if this van actually hit the child. evelyn green was killed sunday night outside her home, near lake mead and pecos. no one has been arrested yet, and talking to witnesses, including the van's driver. more than 50 guests at the luxor were evacuated... after staff members found suspicious liquid and other items in a hotel room. registration desk there was a hallway elevators and it was blocked off and there were security guards blocking the entrances to that elevator." the items were found around 11 this morning in the pyramid part of luxor. fire crews evacuated the 27th, 28th, and 29th floors. police aren't saying what the liquid was, but now say it wasn't dangerous. luxor gave the evacuated guests free exhibit and spa passes.

wildlife refuge say they will turn themselves in tomorrow morning. this while nevada assemblywoman michele fiore is in oregon tonight. over an open phone line live streamed on the internet... fiore says she will arrive at the refuge near burns... by one tomorrow morning. "we need you guys alive so we can continue to make sure that this doesn't happen anymore. we need you guys to stay alive so we can continue to take back our land." an fbi spokesperson surrounded the last armed protesters earlier this evening. they say no shots have been fired, and agents are negotiating with those inside. it's believed there are four people inside the refuge. the situation began january second, when protesters took over the refuge to decry what they called government overreach of federal land. protest leader ammon bundy and several others were arrested last month. a community

designed to help people in need.... has been the source of multiple break ins. as fox5's abby theodros shows us... the director of bailey's community nest is making a plea to the public. its just sickening. why steal it when you can come in and stand in line and get it for free you know? charmaine coleman says she still can't believe someone could break-in and steal from a community agency that does so much good in the neighborhood. i have children and i have a grandchild and im disabled so food stamps run slim and when youre hurting for food and you come here you get vegetables, you get milk, you get things that you really need and i benefit from it very gratefully and a lot. baileys community nest serves many people like coleman who live in and around the eastern ridge. however - in the last two weeks they've experienced a string of thefts that have depleted their food supply. in a face book post director sherry koch said most recently - someone stole 10 cases of turkey

sports drinks. fox 5 wasn't allowed on the bailey middle school campus where the pantry is located but parents familiar with the service say there are security cameras on site -that they hope recorded the theft. richard hodnett has a daughter who volunteers with the pantry - he says campus security has been investigating and believe more than one person is behind the break in they said there was a strange car out back with three guys in it and they took off when the security was out there so idk what's going on. as the community waits for answers- volunteers like dawn hodnett say this... : it really feels bad for me because its like someone taking away something that really belongs to you. whoever broke in to the nest..please turn yourself in. bailey's community nest was established in 2011. it is an agency partner of three square food bank of las vegas. a woman was saved from her burning home, by two passerbys who pulled her to safety.

emotional, as they thanked the good samaritans tonight. "you're a blessing, i want to meet you, i want to reach out and shake the guy's hand and tell him thank you for saving my mom's life. " this fire was near washington and rancho just before nine this morning. thick black smoke could be seen around town. firefighters say the fire may have started from a candle burning in the bedroom. the woman was treated for smoke inhalation, but her family says she is stable tonight. enthusiastic protestors had a clear message for n-v energy tonight about solar power. " what we're doing here is saying we the people of nevada are opposed to this decision, we want solar, we want jobs, and we want clean energy." a group called "bring back solar" projected messages on top of nv energy's building. some of the protesters were former solar employees, others were customers angry their rates are going up. the group plans to drive around

a local fifth grader saw his friend choking during lunch... and knew what to do. and now, that schorr elementary school student's quick-thinking actions are being honored. "when you make a very special decision in life it impact others and that's what we are here today to do." one special 5th grader at schorr elementary honored in front of his school today. "2 weeks ago today, my friend gabriel here was having lunch in this room and his friend kyle was also having lunch when kyle was eating, kyle unfortunatley began to choke on his food." "it felt scary. i couldn't breath. my throat started to get sore a lot. i couldn't really move." that's when gabriel wallace stepped in quickly... and performed the hemlich maneuver on his friend kyle sucalidto "well i saw that he was choking, but i really thought it was a joke. and then i did that and i realized he spit the food out and then i

the west" when it comes to the caucus. but our state could lose that status, if not enough people come out to caucus later this month. according to the reno gazette, part of the problem is not enough republicans took part in the 2008 and 2012 caucuses. less than 45 thousand people turned out both times, compared to 120 thousand democrats. there's also concerns that having a caucus tuesday night might make it difficult for some republicans to participate. some political analysts say colorado could be a possible replacement first in the west state. here's those dates you need to know: the democratic caucus is on saturday february 20th. and the republican caucus follows on tuesday february 23rd. only registered republicans and democrats can caucus. republicans must register by this saturday if they want to take part. democrats have until the day of their caucus to register... and they can do that on site. some nevada voters are practicing how to caucus early... so they know what to do on the big day.
