an investigation continues - after two people were found dead at an apartment. po year-old frank interlicchia was found covered in blood while holding a baseball bat - near tropicana and swenson yesterday. he was outside an apartment - where the two bodies were found inside - dead from what police describe as "obvious head trauma". one neighbor says he was parking his car - when the attacks were happening - and another neighbor was hurt. highway 95 in bullhead city. evidence indicates the man is jose caballero - who went by the name "daniel". his family reported him missing - when he disappeared from laughlin casino on august 18-th. he suffered from an onset of alzheimer's disease. police say there is no sign of foul play - and caballero was wearing the same clothing at the time he was reported missing. a doctor finds himself - behind bars. he is accused of breaking the law... due to what police say was inappropriate behavior.... with at least one patient. you're watching fox5 news at 5. local. las vegas .

at an apartment complex saw someone else - keith scott - get out of a vehicle with a gun - then get back inside. that's when officers said they felt threatened. "as the officers continued to yell at him to drop it. he stepped out, posing a threat to the officers, and officer brentley vinson subsequently fired his weapon, striking the subject." scott's family members say scott was sitting in his car - reading a book. this comes after another controvesial shooting... less than a week ago in tulsa, oklahoma. a tulsa police officer shot terence crutcher - after his vehicle broke down friday. her lawyer says crutcher was disobeying police commands - while reaching into his pocket - and into the window of his s-u-v ... the officers responded with force - killing the 40-year old father of four. "it's time for everybody to

"regardless if the window is up or down ...this is clearly a case of excessive force." dozens of protesters are calling for the immediate arrest of the officer... who has been on paid leave since the shooting. these two shootings join other similar incidents across the country - that prompted the "black lives matter" movement. here in las vegas - a clark county public defender sparked a protest in the courtroom when she refused to remove a small "black lives matter" pin. fox 5's kathleen jacob spoke to her today - and joins us live at the public defenders office guys this is a very touchy subject... the attorney i spoke with tells me... ultimately.. the judge does have the right make rules in his courtroom when it comes to things he may think are going to disturb proceedings... but does wearing a small black leppel really do that? court proceedings from yesterday. you can see public defender erika ballou and judge douglas herndon going back and forth. now ballou had a group of attorneys there supporting her... they're also wearing the small black pin. they judge ordered her to either take off the pin... or remove herself from her client's case. at that... her supporters insisted she had a first amendment right to demonstrate her opinion. my initial reaction was there's something wrong with the judge asking her to take that off. however, in thinking about it, first of all the judge has an absolute right and

maintain decorum in the courtroom. now i don't agree that this is disruptive, but i'm not the judge. so if the judge has a blanket policy of no statements in the courtroom, it might be defensible. randazza went on to say that he has seen police officers wear the black band in court for officers killed.. and other political pins or statements... so if a judge is going to have a policy, it should be a blanket. he just thinks it would have been better for her handled this outside of the courtroom with the judge. i also reached out to the judge and clark county courts,,, they gave me a statement saying their judges are committed to upholding the constitution and laws... including the first amendment... but whether or not that speech is protected... a judge has an obligation to ensure that his or her courtroom establishes an impartial forum where disputes are resolved through rule of law and presentation of admissible evidence... free from extranuous influence. of course we'll keep following up on this... the judge did move the hearing to tomorrow... so we'll see what happens there. reporting live...kathleen jacob...fox5news.. local. las vegas. a north las vegas doctor has been arrested on lewdness charges.

morning at his office - near lake mead boulevard and mcdaniel - and charged with multiple counts of open and gross lewdness. allegations were made that on multiple occasions, the doctor inappropriately touched a patient. this is an ongoing investigation and detectives are seeking any other possible victims. if you have information - call crimestoppers at 702-385-55-55. nevada residents can now apply for medical marijuana card online. the move eliminates the need for patients to make trips to the d-m-v... and a division of the public and behavioral health office. patients will be able to submit all forms on the nevada dispensary association website. the online system follows a year of negotiations between the association and state officials. local dispensaries say at one point - it took weeks - if not months - to receive a card. "anyone can get a medical marijuana patient card as long as you meet one of the qualifying conditions as outlined by the health department here in nevada" "they're conditions like severe pain, wasting diseases, glocoma" patients will now only need to leave their computers

the "life is beautiful" festival gets underway in just two days. the annual event is in its fourth year - bringing together music - food - art - and guest speakers. several blocks in downtown las vegas are already shut down for the weekend festival. you're looking at the area that is being blocked off. the festival spans 18 city blocks. doors open at 2

the festival begins friday - and wraps up on sunday. with the roads closed... there are a few downtown business that hope to benfit from all the foot traffic. police have given the all-clear at the stratosphere - after an unattended backpack prompted a partial evacuation there. you can take a live look here... at the intersection of sahara - and las vegas boulevard - where traffic is back moving. it was closed - when security guards noticed a backpack that was making noises and was left near where bags are stored at the stratosphere. the casino floor and a floor above that includes a pool were temporarily evacuated. investigators later determined the package was left by a hotel guest and contained a medical device. "we were in the restaurant and someone came and told us to evacuate because there was a suspicious package outside so we just had to leave everything and come out."
