bullhead city police, the officers were searching "jeffrey clair cave's" home for a stolen firearm. as you can see, he answered the door with a gun, but police say it was not the one they were looking for. investigators say the injured officer is 57- year-old detective dennis gilbert. police say officer gilbert is in serious condition, but he is doing well. another officer had a bullet pas through his clothing, but he was not hurt. the death penalty could be on the table for the man accused of shooting and killing a customer inside starbucks... after his card was declined in the drive thru. fox5's eric hilt is live outside the jail after talking with prosecutors - and eric they're weighing whether or not that punishment might fit in this case... prosecutors told me they're looking into the death penalty because of how brazen this murder was...

in the middle the of the day. "the sheer brutality and the shear disregard for two things clark county district attorney steve wolfson is looking at while considering the death penalty for 34 year old pedro garcia. police say on sunday garcia walked into the starbucks at warm springs and rainbow after his card was declined in the drive thru... witnesses said he fired two shots in the air and then shot and killed alexander khutsishvili a customer in the coffee shop. "so many of us visit starbucks and all we want to do is get a cup of coffee or a cold drink so for this to happen in the middle of the day, that's pretty unusual another reason why prosecutors are considering the death penalty -- garcia's criminal history. he's been charged with battery and burglary in the past. "a person's criminal history has a direct bearing on how we treat a case and how we should expect a resolution" wolfon told me a decision on the death penalty

she joins us live with more. im standing at russell near i-15 at one of the two final locations for a possible stadium. governor sandoval is still hashing out the details on when the special session is happening but he tells me he's confident with the proposal and how things are shaping up governor sandoval in southern nevada today- celebrating the grand opening of ainsworth gaming. but the raiders were the talk of the town announcer: i have to ask, since we have three nfl (inaudible) on the stage, what's your thought on the raiders? sandoval didnt respond to that question - but in an interview with fox5 - he was crystal clear gov sandoval: with regards to the stadium - this is a great opportunity for us an opportunity with a $1.9 billion dollar price tag. $750 million - coming from a hotel room tax. gov sandoval:the money thats invested through the room tax will flow through the stadium and create sales tax and modified biz tax which will in turn go to a fund that will benefit education. now its on to carson city. two new law makers joined the ranks of legislators

wynn resorts will start buying electricity privately tomorrow. the move comes after a yearlong effort to unplug from the state's leading energy provider. the two casino companies represent about six percent of n-v energy's customer base. wynn and m-g-m companies were required to pay a one hundred million dollar exit fee... to make sure n-v energy customers wouldn't see higher rates. and also happening this weekend... station casinos officially takes over the palms on saturday. the parent company red rock resorts bought out the palms for more than three hundred and twelve million dollars back in may. station casino officals say they have big plans to reinvest in the property. they plan to bring new offerings over the next year. the event recorder has been recovered from the commuter train that crashed in hoboken, new jersey. the national transporation safety board says it will spend the next 7-10 days pulling that information and investigating the scene to determine exactly what happened. karin caifa joins us now from hoboken with more.

searching for answers into why new jersey transit train #1614 never slowed down before crashing into the hoboken terminal at 8:45am thursday morning. the crash killed one woman waiting on the platorm... and injured more than 100 others. the ntsb beleives some clues could be found in the train's two event recorders -- one of which was pulled last night. but it will take some time to recover the second one. (bella dinh-zarr, right now its a very unsafe situation - there's a canopy that is resting on top of the train. once that's removed we'll be able to look more closely at this train. the ntsb is looking into all possible factors that could have led to the crash. (bella dinh-zarr, vice chairman, ntsb) we are looking into every aspect of it. we like to say we look at the man, the machine, and the environment commutors who survived and witnessed the crash describe the chatoic scene. were stunned. the engineer of the train has been identified as 48- year-old thomas gallagher -- an employee of new jersey transit for 29 years. gallagher was treated for his injuries and released from a local hospital. the mayor of hoboken, dawn zimmer, prasied the police, first responders, and fire fighters -- and her citizens. (mayor dawn zimmer/hoboken, new jersey) obviously while this was a tragedy, a major concern for our community, we also are proud, i'm very proud of how our community came together to help one another once again through another tragedy. in hoboken, new jersey, i'm karin caifa. new jersey transit service remains suspended indefinitely in and out of the terminal this morning. the ntsb says contractors have to remove debris from the top of the train before investigators can enter certain passenger cars. first responders are are feeling the heat! in the kitchen that is. they're flipping pancakes and waiting tables.... all for a good cause. and who wouldn't love some extra cash before a vacation? how one company is proving that personal life is just as important as work life. and newspapers

animal activists are angry after three live dolphins were put in a container and shipped from honolulu to arizona. cellphone video shows them confronting cargo warehouse. ben gutierrez reports. alexis thomas and other member of animal right hawaii went to the fed-ex cargo warehouse sunday and took this cellphone video showing people around stretchers often used to transport dolphins. roster full of new players and a whole lot of question marks as we head into the season. there are only three returning players from last year's roster....everyone else is new. that means a lot of new faces and names to get used to and this next month of practices leading up to the opener will be what new head coach marvin menzies is looking at in determining who gets the bulk of the playing time. what we do know - menzies will continue to focus on high energy defense to trigger the fast break....this team will run when it opportunity. but it's going to take some time for everyone to gel and things to take shape. uche ofoegbu: that's the biggest unkown but i feel like we're gonna get it throughout the season. i don't know if it's going to be the first game, or before conference but i feel like we will get and we will be successful this season. that's just the main goal right there. marvin menzies: the good thing is there is going to be a lot of competitiveness in practice. a lot of guys are battling for minutes and time but they're doing it in a brotherly fashion. we're gonna compete every day in practice. you asked me earlier
