we want to warn you -- some may find this video disturbing. we have edited out the actual shooting. "officers confront suspect, shoot him." you can see in the freeze frame the bullet leaving the suspect's gun. he's been identified as jeffrey clair cave. police say the officers were issuing a search warrant at the home for a stolen firearm. cave answered the door with a gun in his hand... but police say that was not the one they were looking for. police say the officer who was shot is detective dennis gilbert. he's still in the hospital... but is doing well. a man behind the

fault for hitting and killing someone who stepped in front of him on the freeway... police say the man who was killed was running away from them... because he was a suspect in a shooting. but now the question is: what happens next for that driver? fox5's adam herbets found out, even though he didn't do anything wrong... this could still damage his career. it's not fair -- but that's just the way the system works. this driver was in the wrong place at the wrong time... and now in addition to everything else he must be going through... some people say this shooting suspect messed up more than just his own life. (nats) driving it was a decision that really didn't make sense to anyone involved. it was crazy. everybody was running. screaming. first -- you're not supposed to run away from the cops... and second -- if you crash your car... the chase is supposed to stop there. instead... it ended in the middle of the freeway. in a messed up way, but it's done. it's over with.

well if you don't know whose truck it is you always wonder if it's your truck to start with david brower works for a different company -- but either way he says there's more than just one victim in this case. (nats) some people might be calling the driver a hero... but nobody wants to be involved in something like this. my heart goes out to him. it honestly does. it's a dramatic thing to have happen to a driver -- to a human being quite frankly. it might be until he gets in the truck again before he really realizes what the effect might be (nats) to make matters worse -- even when the driver does recover... this crash will always be on his record... and for some companies... that might be a dealbreaker. it is unfair. regardless of how clear cut it seems there is no real differentiation between preventable and non-preventable brower says some companies, like his, will give drivers an opportunity to explain their crashes... but not

co-workers say he was known as one of the safest... and they hope he gets back on the road when he's ready. it's a dramatic thing. drivers are people just like us. they've got families. they've got emotions and feelings and when something like that happens it can have a long- term effect. the nevada highway patrol did release the name of the truck driver... but we've decided not to put it out there out of respect for the family's privacy. we also now know the name of the suspect who was killed. his name is lewis william borland. he was 34 years old an armed man is wanted for trying to rob a woman of wanted for trying to rob a woman of her purse. take a look of this video of the suspect approaching the woman. this happened on tuesday afternoon -- near bonanza and nellis. police say the victim was about

the other is bali hai golf course on the south strip. governor sandoval is still hashing out the details on when the special session is happening but he tells me he's confident with the proposal and how things are shaping up governor sandoval in southern nevada today- celebrating the grand opening of ainsworth gaming. but the raiders were the talk of the town announcer: i have to ask, since we have three nfl (inaudible) on the stage, what's your thought on the raiders? sandoval didnt respond to that question - but in an interview with fox5 - he was crystal clear gov sandoval: with regards to the stadium - this is a great opportunity for us an opportunity with a $1.9 billion dollar price tag. $750 million - coming from a hotel room tax. gov sandoval:the money thats invested through the room tax will flow through the stadium and create sales tax and modified biz tax which will in turn go to a fund that will benefit education. now its on to carson city. two new law makers joined the ranks of legislators tasked with

stadium. sisolak: we had some applicants and we thoroughly vetted them. and congrats to the folks that we selected former democratic assemblywoman stephanie smith for district one. she declined an interview but fox5 talked with marylin kirkpatrick who says she was drawn to smith's experience. republican businessman kyle stephens is representing susan brager's district five. sisolak: they're basically care takers for a month and a half here in nov and then they'll be out of office. sisolak: we're confident that we selected the right people. governor sandoval says hopefully sometime between october 8 and the 13th. of course stadium supporters need a two thirds vote in both houses to riase the room tax (42 legislators) if passed - stadium supporters plan to pitch the deal to nfl owners ahead of a potential team relocation vote. emergency first
