walt. >> reporter: ukee, during a three hour meeting right behind me the ntsb made it clear there was nothing wrong with the train or the rails, or for that matter the engineer. he had a spotless record he wasn't on his cell even if or overly tired or impaired. what he was, the board found was distract, and it was that distraction that led to the tragic wreck. >> all of those in favor signal with the hand and say i. >> i. >> the vote is four to zero in favor of adopting the findings as proposed. >> reporter: four members of the national transportation safety board unanimously a greed that engineer brand than bostian, behind the throttle of amtrak train 188, simply lost track of where he was, accelerating in the frankford curve where the speed limit is 50 miles an hour at 106 miles an hour. >> he had lost situational awareness an awareness of where he currently was and believed that he was at a location further down the track where it was appropriate

to accelerate his train to 106 . >> reporter: the board, one year and within week after the crash that killed eight and injured 186, found bostian had likely been distract, listening to reports on his train radio from the engineer of a septa train, struck by rocks on a adjoining track. >> he went in a matter of seconds from distracted to disaster. >> reporter: board also found that amtrak's failure to install positive train control, a safety device that would have automatically stopped this speeding train played a contributory role in the deadly crash. >> we know that the lack of ptc was one reason that these eight people lost their lives and dozens more have have life changing injuries. >> we immediately said we were responsible. we took responsibility. we know that there is pain and suffering.

we understand that. >> reporter: finally the ntsb made 11 new safety recommendations including safety improvements to amtrak passenger cars, on which, several windows, popped out during the wreck resulting in passengers being ejected. >> if a passenger car window had remained intact and secured in the cars, some passengers would not have been eject and would likely have have survived the accident. >> reporter: now amtrak says that it has, as of january, installed ptc along its entire northeast corridor, repeated attempts to contact bostian's attorney for comment today were unsuccessful and finally coming up the at 6:00 a temple university professor, on board the train that night, in the audience today, he'll share his thoughts at 6:00. live from ntsb headquarters in washington d.c. i'm walt hunter for cbs-3 "eyewitness news". >> thank you, walt. now that the ntsb has made

its determination, what is next? there are two answers, philadelphia district attorney seth williams could file criminal charges. williams has said an investigation ongoing. victims and family have filed civil lawsuits in the case and there could be more to come. local attorneys for some of the survivors and victims killed in the derailment say that they are not satisfied with the ntsb's report. >> the conclusion today by the ntsb that it might have been situational unawareness that it may have been that he lost knowing exactly where he was, would not meet the standard of admissibility in a court of law. >> coming up in our next half an hour you'll hear what the attorneys say was missing from the federal investigation. right now a serious crash is tying up traffic on the schuylkill expressway during the evening rush hour, a tractor trailer overturn in the eastbound lanes near girard avenue this afternoon. big rig spilled its load of boxes around 2:00 and only one lane was getting by.

the lane closure is causing traffic, to be backup for miles. this is a live picture now from a traffic camera as crews continue to work to clear that scene. police tell "eyewitness news" one person was taken to the hospital and, of course, they are saying avoid that area if you can. rescue crews freed a man trapped in the west philadelphia home that partially collapsed. construction work was underway at the home in the 100 block of southford street when the floor inside gave way. "eyewitness news" reporter greg argos is live with more on this, greg. >> reporter: jessica, good afternoon. this is home right here behind me at 108 north salford street in west philadelphia basically just a shell of a house, freshly boarded up after investigators say the first floor of it collapsed in to the basement, injuring one man inside. this man in his teens is going to be okay but you what led him being rushed to presbyterian hospital. 10:20 tuesday morning philadelphia fire fighters

arrived at 108 north salford street in west philadelphia after reports of a partial building collapse. >> the first floor collapsed, and we had a person trapped. >> reporter: special operations units removed the man trapped have after 50 minutes. >> it was like in operation. >> reporter: using air bags to create space around him. >> they put air bags in and they lift up the material and on top and to pull him out. >> reporter: licenses and inspections officials say home has multiple violations and contractors were at the scene to make repairs to the structure when the floor gave way and felon to the the victim who was not authorized to be inside. >> our understanding at this point is that gentlemen was not part of the contractor's crew and may have been in the building, looking for a scraps. >> reporter: commotion creating havoc for neighbors who had to quickly leave their homes. >> woke me up out of my sleep. i heard the word evacuate and i knew you better get your stuff and get out of the house. >> reporter: now that all is quiet on north salford street. >> back to normal life.

>> reporter: these living nearby are glad no one was killed. >> it could have been real worse but as i said it is a blessing he made it and survived. >> reporter: back her live l and i, before able to quickly inspect the nearby structures and the neighbor's homes and so everyone was able to reenter their homes quickly after this man was rescued from the collapsed house here. now as for the victim in all this i did speak to philadelphia police and they tell me whether they are looking into whether or not they could face possible charges. we are live, i'm greg argos for cbs-3 "eyewitness news". chopper three over an accident involving a dump truck carrying maneuver on interest a state 295 in hamilton township mercer county. police a say that dump truck was traveling north bound near exit 63 when it crossed over in the the southbound lanes. it then hit a toyota suv and then went over the guardrail and off the road. the drivers of both vehicles were taken to the hospital, no word tonight on their conditions. chopper three was over another accident on 295, a

truck fire at the the exit for the black horse pike in bellmawr. the fire broke out around 8:30 this morning. inquire crews had their handful there, thankfully no one was injured. twin brothers from chester county air accused of blowing up several small buildings. investigators say daniel and caleb tait used improvised explosive devices to cause destruction while home from college last december. it damage a pre dues shed, well pull in chester and lancaster counties no one was injured. the 22-year olds are charged with arson and other crimes. two weeks after putting in a trade request, and skipping team activities sam bradford was in front of the microphone today. >> quarterback spoke about his absence for the first time and leslie van arsdal joins us live from the novacare complex with more on what he had to say, leslie? >> reporter: well, guys i'll tell you sam bradford said all of the right things, he he cannot exactly undue what he

summer because hopefully summer doesn't look anything like this lets go through live neighborhood network sites. you can see cloud breaking up, maybe in kutztown, in junior/senior school in bernville this is cloudy but not raining at the moment. mostly south of you. cape may courthouse is cloud which rain coming down and see where rain is as we take a look once again at storm scan three. generally from the north and western suburbs through shore points and into delaware. this is not heaviest rain we have ever seen, mainly light showers and drizzle but there are pockets rebuilding over the city that are getting steady and that will slow down traffic which is already as we told you earlier a mess outside. storm scan three as we zoom out shows activity cross eastern half of the country, heavy rain in florida. they set a record for rainfall in zero beach, florida today this system will swing through tomorrow morning and fizzle as it gets here but still a few showers earlier in the day and cloud will hang on. then we will get two days of nice weather before another round of nasty stuff comes back in for the weekend.

fifty-four in philadelphia. it is 57, chill any reading, 59 in will allentown. they have had more brightness today, we did not get a lot of rape today but add to go that may total, 2.9 inches since may 1st. we have had four dry days, so far, this month, and that is a ninth, 12th, 15th and 16th. we added another rain drop today. maybe adding another one tomorrow but 19th and 20th, thursday and friday, those are your days to look forward to. future weather continues to show that rain moving in south jersey and delaware as we head through tonight, generally light rain ending from northwest to south east. amounts up to an additional tenth of an inch possible this evening into tonight. rain ending, cloudy, cool down to 50 degrees. tomorrow still a shower possible, mostly cloud up and chilly, high only 63 degrees. maybe a few breaks of the sun late in the afternoon not all that optimistic about tomorrow but i am optimistic about thursday and friday. the thursday the sun will break through the clouds, and not the sunniest day we have ever seen but we are warmer at

eyewitness news continues at 5:30 with the results of an investigation into what caused amtrak train, 188, to derail in philadelphia last may. ntsb conclude that had engineer brandon bostian was distracted by a radio transmission, and loss track where he was as speeding train entered a sharp curve. federal up investigators say positive train control had been equipped on that stretch of track it would have likely prevented the derailment from happening. >> we looked at weather, locomotive and determine and this was a good train, on good track, but an engineer who was fit for duty, not fatigue or impaired by drugs or alcohol and not distract by a personally electric tronic device but we have long known that even in the absence of such factors human beings are foulable making a technological backstop such as

ptc a necessity. >> may 2015 crash killed eight people and injured more than 200 others. amtrak says it will review ntsb find to fully understand what happened and how they can prevent it from ever happening again. >> in the meantime lawyers for some of the derailment victims are unsatisfied with the federal report. our alexandria hoff has that part of the story now from 30th street station, alex. >> reporter: well, attorneys representing victims and their families, they say that the a summations drawn by ntsb about the train's engineer are circumstantial at best and would not hold up in court. >> this was a good train on good track, but an engineer who was fit for duty. >> reporter: but also someone who may have been lacking situational awareness or having confusion, perhaps, that was the ntsb conclusion when it comes to amtrak train 188 engineer brandon bostian and why he may have hit a deadly curve going more than twice the speed limit. >> we're looking for a real,

concrete answer for the people who we represent. >> reporter: in a lapse in situational awareness was not that answer for attorneys watching the hearings from their offices in philadelphia. >> in our experience, witnesses memories get worst overtime, they don't get better overtime. >> reporter: they feel the ntsb report did not dig deep enough into the train's engineer who initially cited memory loss. >> we don't even know where he is. >> reporter: we were a able to reach out. >> this is brandon bostian. >> but no answer. >> please leave a message, thanks have a great day. >> reporter: following the crash bostian's friend praised his character and commitment to his job and safety. the ntsb and lawyers in philadelphia agree is that one person's error should never have been able to lead to this. >> hardest part of all this is that it was present on the tracks, a couple hundred feet away in the opposite direction. >> reporter: what he is

talking about is positive train control, a system in place just a few yards away from where that crash happened but in the on the same line. what it does do is override any potential operator error, all railroads not just amtrak must have that in place by the end of 2018. reporting live from 30th street station i'm alexandria hoff for cbs-3 "eyewitness news". >> will alex, thank you. philadelphia police are investigating a deadly shooting in the northeast that gunfire erupted early this afternoon and "eyewitness news" reporter rahel solomon is at police headquarters with the details on that, rahel. >> reporter: i can tell you detectives are inside police headquarters speaking to several people from the scene trying to get a better idea of exactly what happened this afternoon. police tell me that two weapons were recovered, one just besides the victims, possibly even belonging to the victim. for some, the sound tuesday near higbee and digman streets in the northeast were

recognizable. they have been heard here before. >> i need all new roofs because of bullet holes. this neighborhood is going down the tubes and i mean down. >> reporter: philadelphia police say they have received calls about tuesday have afternoon's shooting around 2:30. the adult male victim in his 20's was reportedly shot once in the head, neighbors say they heard many more shots. >> it was like fire works, so, more than one. >> back to back. it was six to eight shots. >> reporter: she tells "eyewitness news" the victim was found in the driveway behind a home and that is attempted to pass several people at police headquarters but wouldn't elaborate on their identities. >> we do have people here that we are talking to. >> reporter: as police collect evidence and processed the scene nearby lawton elementary school was placed on lock down, they may resume questioning what if the shooting happened just hours later. >> we have little kid out here

that play but today, you know, it is not a day to come outside. >> reporter: police tell me that the second weapon was found inside a car at the crime scene, again, several people are here at police headquarters, being questioned by detectives including the shooter i'm told, at this point no one has been named a suspect. reporting at police headquarters, rahel solomon for cbs-3 "eyewitness news". a short time ago chaka fattah left court in day two of his federal corruption trial in philadelphia. eleven term democrat ace accused of accepting bribes and misusing campaign funds, and federal grants. today on the stand the former ceo of sally may and a member of the fattah's 2007 mayoral campaign, detailed the flow of money connected to the congressman's mayoral bid. a military judge is delaying the start of the army sergeant bow bergdahl's military trial until february. bergdahl's attorneys asked for time to sort through classified documents they were granted

bergdahl is facing desertion charges for allegedly abandoning his post in afghanistan in 2009. prosecutors say that the desertion led to his capture by the taliban, in 2014 he was released in exchange for five taliban detaineeness u.s. custody. in campaign 2016 voters in kentucky and oregon make their voices heard in the presidential race. voting comes as a tax continue between hillary clinton and donald trump. craig boswell is at the white house with more. >> reporter: bernie sanders is optimistic about his chances in oregon and kentucky. >> well, i feel about oregon and kentucky the way i usually feel and that is if there is a a large voter turnout i think we will win. >> reporter: sanders is on a roll having won last two primaries but hillary clinton has 94 percent of the delegates needed and on track to secure the nomination in june. >> hello, lexington. >> reporter: clinton has invested time and money in kentucky trying to slow sanders momentum but she has saved most of her fire power
