jessica keen. i'm natasha brown in for ukee today. city council passed the tax by a vote of 13 -four, "eyewitness news" reporter alexandria hoff was inside city hall when it happened and joins us live outside to tell us now what is next for the beverage industry, that for the this measure tooth and nail, very divisive issue, alex. >> reporter: fight is not over but we will not have it look like what we have seen over past couple of months, with horns blaring and mega phones. we are told this fight will take shape of an immediate lawsuit. one and a half sent, a seemingly small price but apply that per ounce and it is launched a hefty battle and now historic win for mayor jim kenney. >> out of the 13, no are four, majority member of the council vote yes. >> reporter: in a 13-four vote city council gave their final approval to philadelphia becoming the first major city in the united states, to tax sweetened beverages. >> this is the first step in finding the resources and

revenue that we need to get our kids prek education. >> reporter: opposition in labor and beverage industries called the bill discriminatory. >> there is so much money laying around, in unfunded programs that the city has that could have paid for this without targeting one industry. >> reporter: representatives say a lawsuit will be drafted, immediately, questioning philadelphia's authority in implementing a tax with statewide implications. >> they spent a long time twisting the facts of this whole debate on television with millions of dollars and that wasn't effective, so we will fight the next fight when it comes. >> reporter: kenney's plans look to raise over 90 million-dollar a year to benefit expanded prek, and community programs. now some concern was spark last week when it was uncovered not all of the money, very small portion will be divert todd programs, other than community programs and prek otherwise going in the general fund in other words, so there was concern sparked

there but on both side of the aisle, they are asking for transparency as this moves forward. reporting live, i'm alexandria hoff for cbs-3 "eyewitness news". >> thank you very much. jurors wrapped up day two of the deliberations without reaching a verdict in the federal racketeering trial of the pennsylvania congressman chaka fattah, this is new video of the congressman leaving court this afternoon. fattah is accused of arranging an illegal one million-dollar campaign loan, then paying back part of it with federal grant money and charitable donations. the his lawyers blamed two political consultants who already pleaded guilty. jury deliberations resume tomorrow. home owner catches suspect thief in action and then takes matters in his own hand, setting off a dramatic series of events. between gunshots and the wild driving that caused this damage, it is no wonder no one was killed when that home owner, looking after his car went after a would be thief. blown red light, a crash and the beginning of the shooting all caught on video and it all happened right here. >> i came in around 7:00 and there was a car directly in front of my salon right on my step. >> reporter: crystal beening salon became a backstop after a morrisville man chased down and gunned down a person he saw break nothing to his car. >> he was in his vehicle. he went back inside, got his hand gun, called police at which time male fled in his vehicle which ended up being a stolen vehicle will. >> reporter: it started before 5:00 a.m. atwoodland manor apartment. resident called 911, then got his gun. at which point suspect drove off in a different stolen vehicle. the chase went a half mile before the crash, and allege burglar victim came out of his car with a gun drawn and

according to police fired two shots. burglary suspect in the elbow. >> wounded man fled to a 7-eleven, police arrived in a minute and arrested both men. >> i cannot believe that this happened around here. >> reporter: chief george maclean says bucks county district attorney will decide if the man who fired shots will face charges but wow advise doing what he did. >> don't take this in your own hand let us handle it, call it, be a good witness, don't go out there and do this. it is not worth anybody's life. >> reporter: bucks county district attorney david heckler tells me he expects that both men will face some kind of charges but nothing filed as of end of today. the one burglary suspect still in the hospital, at last check, police say that the gun shot wound to his elbow does not appear to be that serious. in morrisville i'm cleve bryan, cbs-3 "eyewitness news". >> cleve, thank you.

police in philadelphia are investigating a deadly shooting that happened on the 5100 block of arbor street in olney. police found victim shot once in the face about 2:00 this afternoon inside of a silver pontiac. he has yet to be identified, anyone with any information should contact the philadelphia police. a small plane crash is, while trying to land at university park airport in state college. both people on board, were killed. officials say that tower crews at airport saw smoke coming from the plane as it approach the airport about 8:30 this morning. they tried alerting the pilot but could not get any response. victim's names have not been released. now to a legal victory, for jerry sandusky. >> a judge makes the major ruling as former penn state assistant football coach, tries to overturn his conviction on child sex crimes. "eyewitness news" reporter greg argos is live tonight with the look at the judge's ruling, greg. >> this is a big break for jerry sandusky and his attorneys. judge's decision essentially

grants the first step in the long process that could overturn the former penn state coach's convictions on 45 counts of child sexual a boost. >> what is there to say. >> reporter: those were jerry sandusky's word may second as he pled in front of the judge john cleland hoping why will grant him a hearing under the state's post conviction relief act. good morning. >> reporter: thursday the judge allowed that hearing which will let the former penn state assistant coach and develop more information, as they work to overturn sandusky's child molestation convictions. >> is there 33 issues. >> reporter: six weeks ago sandusky's attorneys argued those 33 issues prevented former coach from a fair trial in 2012. the judge agreed with ten of them. hearing scheduled for august will address whether sandusky's trial tea fence team should have called himself to testify and whether prosecutors improperly leaked information about the grand jury investigation. also at play here whether prosecutor joe mcgettigan lied during closing arguments in

sandusky's trial, then he said victim two was known only to god, sandusky's current lawyers argued that the prosecutor knew that victim's identity. perhaps main problem has to do with sandusky's trial attorneys, his current attorneys say they were rushed, not prepared, and sandusky not provided with an effective defense. now once again hearings are scheduled in august, judge cleland says they will take place on the 11th, 22nd and 23rd. live from the sat center, greg argos for cbs-3 "eyewitness news". >> thank you so much. workers 459 atlantic city casinos are voting on whether to authorize a strike at this point. they are demanding a new contract, by the start of fourth of july weekend. in today's vote, the workers could walk off the job july 1st if a new deal isn't in place this vote effects tropical can, caesars, harrah's and bally's and workers at trump taj mahal, already have authorized a walk out. after a day that saw rain around some parts of the area

jersey sent me a photo of blue sky peeking out there in chesterfield but in reading the clouds are still in place and clouds kind of blowing off from this next system moving through western and central pennsylvania. this is a pretty nasty looking line of storms. you can see all this tracking to the south and to the east. could we get clipped by northern edge of this? certainly we could especially areas south of philadelphia that is something we have to watch for tonight. a lot more heat and more moisture in areas over virginia, that have seen sunshine today, temperatures in the 80's to near 90 degrees. that is where storms are going. they go where they can feed off heat and moisture and for us, it is cloudy, cool all day long. mess of this is on the trajectory to miss us to the south and start to fall apart running into that stable air. a weeze head through overnight hours can't rule out showers here and there as we go through tomorrow and we will see clearing process by 11:00 a.m. much of the area seeing sunshine, clouds still hanging on down the shore and delaware those cloud dissipate

through the day, maybe a few stray showers, to the north and west tomorrow afternoon but otherwise it turns that whole lot nicer and then by saturday we are looking fantastic. humidity not bad either, little more steamy today but tomorrow back to the pleasant range. humidity will drop as we go through the day and feel it out there by the evening. it will be nice and comfortable. awesome saturday. dew point's in the 40's and 50's. sunday great as well. humidity starts to creep up high tore start next week. summer begins monday morning about 6:34 a.m. mostly cloudy overnight, 61 degrees. shower is possible mainly off to the south and to the west. watch out for that as we wake up tomorrow morning. if this system tracks further north down in delaware and south jersey we may see a morning shower. we will gradually clear it out and beautiful shore weekend, 74 saturday. seventy-five sunday. great beach day for dad. eyewitness weather seven day forecast looking good at 28 degrees on saturday. eighty-four on sunday.
