today, for calling her relationship with kaplan. the defense for her parents argues they did not know relationship would turn sexual, and they did not the know her daughter was pregnant until they gave birth to the first of two daughters inside kaplan's feasterville home. did you know he wanted to have sex with your daughter. >> reporter: after her mother arrived to help with the home birth victim says she began living with kaplan as well, her police say savilla did nothing to stop sexual relationship. june 17th the victim, two daughters and nine female siblings were found inside of the feasterville home. >> only little girls. they would be outside, very sporadic but rarely you see one or two. >> reporter: they remain in protective custody. two dozen members of the amish community arrived by van and stoltzfus left church more than a decade ago after refusing to cut ties with lee cap land.

kaplan has been charged with a slew of sex crimes, the father daniel has been charged with conspiracy to commit statutory sexual assault and child endangerment, excuse me, and victim's mother savilla a has been charged with child endangerment. reporting live, i'm alexandria hoff for cbs-3 "eyewitness news". tonight, philadelphia district attorney seth williams is vowing to retry monsignor william lynn, for his handling of the sex abuse claims in the philadelphia a archdiocese. judge today released lynn from prison days after the state supreme court threw out his conviction. "eyewitness news" reporter joe holden is outside district attorney's office this center city to tell you more, joe. >> reporter: from all appearance from his both sides it is game on, round two, a trial, that monsignor lynn will face once again. he was pick up by family, taken away in a suv, no attempt at questioning. he was just too far from our cameras. the tonight monsignor william lynn is free for the time

being. six hours after a philadelphia judge signed a release order, monsignor william lynn leaves a state prison near scranton. we are told a family pick him up, his journey now through court system is far from over. >> just hell bent to retry this case. >> reporter: that is lynn's attorney tombergstorm react to go district attorney seth williams will retry the monsignor. >> for some reason, you know, he continues to want to beat up on this guy. i think we all know where he stood, meaning where lynn stood in this, in this hierarchy. >> reporter: defense attorneys claim lynn never touched a child and was following orders from the powerful now deceased cardinal anthony bevilacqua, but district attorney seth williams says lynn orchestrated the cover up of abusive pedophile priest. >> monsignor lynn was at the center of all of the evidence. is it possible others could have been charged? grand jury thought there was not sufficient evidence to charge others. >> reporter: archdiocese of fill declined to comment on the developments but confirmed

possibility of allowing women to serve as deacons in the catholic church. for more on the reaction to this ground breaking news we will turn to rahel solomon live in center city at cathedral basilica of saints peter and paul, rahel. >> reporter: jessica this issue dates back to may, when pope francis now met with the group of women in the catholic church that asked why is it women are excluded from being deacons. pope said that he was looking to it further and today he did just that. it could be the first step in a major change for the catholic church. tuesday, the vatican announced pope francis has created a commission to study the role of female deacons in the church a position not reserved for men but what historians said women once held in the early days of the church. >> to bring younger people in the church again i think you need to move it ahead, definitely at this positive step for him. >> reporter: it will consist of 12 people both men and

women and while it will examine role of the female teak on is it will then look in the possibility of female priests. deacons can preside over weddings, funerals, baptist many but priest can only lead mass. >> it is a start, you have to start is where, it has been a long time. >> reporter: many people outside saints peter and paul basilica supported the decision but some questions why has it taken this long. >> i think it is wonderful. i should have have happened many years ago. >> well, it business time. my sister is a a roman catholic. i hope she becomes a deacon. >> reporter: archdiocese of philadelphia spokesmen kevin gavin wouldn't speak on any possible outcomes but a said in a statement that the commission was just announced and its work will take time. we certainly wouldn't speculate what the commission will find, report or recommend but we will pray for those hoff been given this task that they may be filled with the wisdom of the holy spirit. the commission will include priest, nuns and laymen.

to the west. mention chance of the stray shower this afternoon and that forecast has been verified. we have one stray shower out there but again, it is not a big deal and once we get this out of here we have nice stretch of weather, dry days on the the way for tomorrow and thursday. maybe another stray within on friday. the lets take a a look outside and show you where we can put your beach plans on held for couple hours today. we had cloud around across much of the region. glummy start to the day but low and behold once you saw those first few breaks of blue sky they became nine or ten breaks of blue skies and then sun won battle and it is a a nice looking evening outside, pretty much every where all across the region, including ocean city. take a look at storm scan three which shows that one shower we mentioned. it is ever lancaster county. clipping chester county as well n honey brook, and right long the turnpike as well heading in that way it is slowing things down. this is a slow moving cell as we have seen, and it is

bringing heavy rain and drifting from berks county right down through lancaster county. rest of the region is stable. we have a east wind picking upbringing cooler a air from the 76-degree ocean water, 75 in atlantic city. seventy-five in trenton as well. eighty in philadelphia. these temperatures are fantastic for august afternoon to be in the 70's and near 80 degrees. it feels great out there. humidity is starting to drop as well. you can see in that area where that thunderstorm shower is, haven't had much lightening but dew points are higher. but as you head east we are looking at dew points in the mid 60's. sixty-two in trenton this isn't the most dry air we have he have felt but in comparison with where we have been, this evening is feeling fantastic. dew points will continue to drop as we head in the day tomorrow. lets look at our future dew points tomorrow at 2:00 we have dew points in the lower 60's and 50's, that puts us close to the pleasant range and on thursday, same story even though temperature warms up a bit we are still looking

at comfortable humidity levels with dew points in the lower 60's. very quiet stretch, sunshine, comfortable weather tomorrow, mid 80's, same story on thursday, comfortable not too hot, certainly not too humid and we will get thunderstorms out of the way. friday still in the upper 80's but will be more humid with a chance for stray thunder storm in the afternoon this trent will bring better chance for storms and that comes in on saturday afternoon. tropical satellite shows tropical storm earl not a threat to us here in philadelphia a or in new jersey or delaware but if you have any plans to take you down towards yucatan peninsula, south america, jamaica, areas like that that is one to keep an eye on that could strengthen but looks like it may stay tropical storm before headaching land fall mid week. overnight few cloud, comfortable down to 68. tomorrow mostly sunny great august day 84 degrees in the city, down the shore. eighty-one, sunny nice breeze off water. poconos mostly sunny and pleasant at 76 degrees. you're witness weather seven
