this is cbs-3 "eyewitness news". >> this is pennsylvania attorney general kathleen kane entering the courthouse in norristown this morning, as her perjury and obstruction case officially begins. good afternoon, i'm brooke thomas. >> i'm jim holden. jim donovan off today. now that the jury is set opening statements began today at the montgomery county courthouse, we learned several prominent officials in philadelphia and montgomery county set to take the stands during the trial.

we get more now from "eyewitness news" reporter justin finch. >> accused of felony perjury by leaking secret grand jury details to the media. reportedly lying about it under oath. she also faces misdemeanor charges of obstruction, official oppression, conspiracy, false swearing. over several hours, some 100 potential jurors vetted behind closed doors entering list of questions including if they were struggling deciding kane's case or if they had ties to her office. law enforcement or potential witnesses. kane has insisted she's been targeted for going after what she is called an old boy's network for her exposing of the so-called important gate scandal. the ring of racially offensive and sexually explicit emails traded by state workers. later led to several of kane's stepping down, two state supreme court justices. some the judge has said will be called to the witness stand. >> now, the judge has set this case can go for about a week in trial.

among those set to take the stand, philadelphia da seth williams, and former montgomery county da, risa vetri fuhrman, who is now a county judge. in norristown, justin finch, cbs-3, "eyewitness news". thanks, justin. detention hearing for convicted fell on joey merlino set for this morning has been rescheduled for friday. at the request of merlino's attorneys. there has been no reason given for the request. the feds arrested merlino last week for his alleged role in a organized crime ring. skinny joey was release from the federal prison in 2011 after almost 12 years in federal prison. on a racketeering conviction. police are investigating if drag racing could be to blame for the death of a three year old girl in a kensington car crash. officers say a dark colored car ran a red light at second and york street around 7:15 last night. they say it hit the passenger side of another car and the toddler was thrown from that car. she was returned to st.

christopher's where the three year old was pronounced dead. the 17 year old driver of the first car is in stable condition at a hospital. >> developing now for the first time, someone has died in texas due to defects related to zika. authorities say a baby girl with defect associated with the virus died shortly after being born at a harris county hospital several weeks ago. texas public health officials say the child's mother traveled to latin america during her pregnancy and that is where they think she got the virus. >> we're continuing to follow the developments at philadelphia international airport where delta airlines is still trying to get back up to speed following yesterday's computer glitch. have a live look right now at delta ticket counter. outage centered at the airlines at lan that headquarters yesterday triggered thousands of concellations and delays, there were at least four morning arrivals and departures canceled after the international, with seven more flight delayed. passengers are dealing with long lines for day number two.

>> first was delayed three hours and then our connecting flight was canceled. so we tried to get in line here at the delta kiosk, and that was taking even longer. so we ended up cancelling our flight altogether and re booking with another airline. >> reporter: in addition to allison's ordeal, it cost about a thousand dollars more to book that flight on different airline. altogether about 300 delta flights are canceled across the country today, the airline's offering refunds, and vouchers, but kris van cleave tells us that the airlines computer systems are older than their airplanes. >> the outage disable delta's flight status alert. >> we found out there were four hours delayed. >> airport monitors incorrect dollars listed flights as on time, delays and concellations prompted apology from delta's ceo. >> all hands on deck effort. >> delta network outage races questions about the reliability of computer systems used by airlines which are not regulated by the faa.

last year united and american both suffered computer problems. in july, a faulty router forced southwest to grounds flights, disruption, that lasted days. >> they're running on reservation system that is more than 35 years old. >> airlines now rely on computers to handle pretty much everything from reservations and seat assignments to how much fuel and smacks to load on a plane. says delta has been rebuilding it core technology for more than six months. the airline industry generally has reliable systems, but portions can be decades old. >> airlines are technology companies that fly airplanes. their technology systems have to be as reliable as their aircraft. >> the department of transportation tells cbs news, it is having discussions with delta about the outage, and continues to monitor the situation. the airline is offering compensation for people who have had canceled flights, or delays of more than three hours in the form after $200 flight voucher.

kris van cleave, cbs news, reagan national airport, virginia. >> all right, chris, we are enjoying a very nice summer day. but the heat is going to ramp up again. meteorologist, katie fehlinger, liver on the cbs-3 skydeck to let us know when the nine's return. >> as early as tomorrow, brooke, knocking on the doorstep essentially here, already going to be pretty warm day. certainly is very warm out here on the skydeck as we speak. still not terribly humid. but it is definitely a little bit of an up tick in terms of dew points from what we saw yesterday this same time. so the transition is starting to take effect here. but we do have sunshine, couple of patchy clouds, and that's it. if you got outdoor plans, you are good to go the rest of the day. quick peak at storm scan, which remains storm-free at the moment. you can see these clouds are starting to bill owe in back through portions of maryland. and that's what's headed our way specially tonight. currently, it feels like it is into the mid or upper 80s, even in the 90s, depending on your location, the actual air temperature is couple of degrees cooler than this, about 84, 58 degrees around

philadelphia right now, so tacking on few extra degrees for just that glaring sun, and ever so slight up tick in the humidity, boy, officially expect to hit 88 later on this afternoon, so few hours, that's where we top it off. low 80s at the shore, and in the mountains, but like we've been mentioning, there is more heat on the way, not to mention humidity, and thunderstorms. so we'll break down the pattern for you in the full seven day forecast later in the show, guys, back into you. turning to campaign 2016, hillary clinton finds herself at the center of a new controversy. the parent of two people killed in the attacks in benghazi libya have filed a wrongful death lawsuit against the democratic presidential nominee. on the republican side, donald trump is trying to get back on message in an attempt to unify the party. correspondent craig boswell has more now from washington. >> reporter: donald trump has lost the vote of another prominent republican.

senator susan collins of maine wrote in the washington post: i am a life-long republican, but donald trump does not reflect historical republican values. >> it shows you that the breds of the problem he has in the party, problems, well documented. telling you moderates are in revolt, as well. >> reporter: comes after group of 50 republicans signed a letter saying trump would be the most wreckless president in american history. the group includes former directors of the ci a and national intelligence, plus two former homelands security secretaries. >> these were the people that have been there long time washington establishment people that have been there for a long time. look at the terrible job they've done. >> it wasn't all bad news for trump. many republicans praised the economic plan he unveiled yesterday, that includes cutting taxes, but then, he took to twitter and sparked another controversy. trump tweeted: many people are saying that the iranians killed the scientists who helped the us because of hillary clinton's hacked emails. trump is referring to amiri, nuclear scientist, iran

executed after claiming he spired for the us. but iran didn't need to hack emails. amiri very publicly deflected to the u.s. in 2009 before returning to iran one year later. clinton campaign spokesman called out trump, saying, what he really means by many people are saying is i made this up. craig boswell, for cbs-3, "eyewitness news". a major blow to new jersey struggling casino industry. that federal appeals court have rejected state's bid to legalize sports betting in casinos and racetracks. the panel ruled new jersey law passed in 2014 violates a 1992 federal law. four major professional sports leagues, and the ncaa, sued the state over its sports betting legal its agents attempts, claiming it would damage the integrity of their games, and lead to game fixing. >> turning to rio now, where olympic organizers say only about 80% of event tickets have been sold, leaving many venues virtually empty.

only a few thousand fans attended events like women's rugby, cycling, kayaking. different story for the high profile events, like teen usa men's basketball, which of course is sold out. even so, some visitors are just happy to be in rio for the games. >> we got table tennis, judo, weight lifting, a bunch of random sports for like $12 apiece. >> spirit is great, i feel completely safe. haven't seen a moss keith know two days. >> olympic officials say they hope the stadiums eventually fill up with fans who have the olympic games on their bucket list. >> so here is the medal count as it stands right now. the us still leads china and australia with 19 medals overall, five of them gold. china has 13 overall, australia coming in with seven. >> it seems former eagle tim tebow is going from touchdowns to homeruns, at least he's hoping to. >> espn reporting tebow pursuing career in major league baseball, plans to hold a work out later this month.

last half of the slide. there was blood trail down the slide. >> first responders, found the ten year old, in a pool at veryuck, approximately 17 stories high. the second drop, is about 50 feet. two, three people can ride in the raft at one time, and riders are secured by velcro straps. >> it wasn't that secure being strapped in. >> paul overhouser said his belt came off while ride wag friends and his nine year old son about two weeks ago. >> as soon as i hit the bottom of the first curve, the shoulder strap kind of busted loose. >> he said he had to grip handles by his legs to hold on, and told park staff what happened. >> they casino of said oh, no, really? or something, ya, that's not good. and so it sounded like, you know, they were going to do something about it. >> in a statement, he said, safety is their top priority. and that the rides are inspected daily.

>> there are no federal standards, so it really is up to the park operators, the manufacturer of the ride and the state to make sure that it is a safe environment. >> it is expected to reopen tomorrow. unclear how long the slide will remain closed. omar villafranca, cbs news, kansas city, kansas. >> so how safe are local water parks? from indoor parks to resorts down the shore, we'll check on safety measures at some of the places you may take your family. that is today at 5:00. authorities in tennessee say one of the three girls who fell from a ferris wheel last night remains hospitalized in serious condition. the other two girls are response enough answering questions. the three fell 30 to 45 feet when the car they were in slipped over at a county fair. the fair rides are closed today and will not reopen until a third party inspection is completed. it is a message to all of house love taking pictures. >> hold on tight to that smart

bling and you'll miss it, a woman scramble to retrieve her ipad out after dolphin's mouth there. it was at a viewing tank at florida sea world. she was apparently trying of course to take a picture of this animal, when she got little too close, snapped the device right out of her hands, and plopped it into the water. the woman was able to get the ipad out of the tank, and quickly walked away. perhaps from embarrassment? >> you know what? so funny because, you know, how i love my phone. i probably would have laughed. i would have wanted it back but i would have thought it so funny. dolphins are so cute. just would have been like ahh! >> and she has still not been heard from. it's been days. >> i would have lost that thing, like it doesn't know any better. >> exact lip, what's good you can replace your ipad. you can replace your smart phone. >> makes for fantastic video, too, and 15 seconds of fame, too. >> pretty good weather. >> ya, wonderful transition, you can always transition into nice weather out of a story like that, right?

looks pretty good for the rest of the day, specking nice august afternoon. it is ever so slightly more humid right now. that's precursor of things yet to come. so, let's take a look outside. we start off by taking you out to the shore, look at all of those people, ya, understandably, fantastic beach day in ocean sit. can't blame all of these folks down in cape may county. guarantee you have got hundreds upon hundreds of umbrellas, lining not just this beach but all the way down cape may county down to exit zero, right? now, meanwhile, as we go farther inland here out to the kutztown area middle school, really just seeing beautiful afternoon unfold here. it is currently 79 degrees at this location, but mainly just beautiful blue sky. so it is a nice day. when we look once more here at storm scan, things are still tranquil at the local level. i'll zoom it out couple of times here, off to the south, you see this? starting to see moisture getting drawn north, building up the instability with the heat and the humidity, you see this so often in the summertime. this is what eventually becomes our story, looking

ahead to tomorrow. specially. and there is a frontal boundery difficult to make out but it is sliding ever so slightly east. as it does so, we sort of get stuck in the squeeze marie secondly of heat, humidity, as a result more instability. with that humid and very warm air getting drawn north, and the approach of the very slow moving front, multiple days of potential for showers and thunderstorms then come along with that. so everything that comes along here in the way of any stormy weather, it is going to come through in scattered fashion. that starts tomorrow, but along with that very high humidity, just really steamy, and just classic, again, summer like weather coming our way, now, in addition to that, also going to see the heat index values spike. at the height of this afternoon, really within the next few hours, this is about the worse it is going to feel, shooting for high of 88. high of 89 when it comes to the heat index in philly that's not so bad. take a look where we end up. by tomorrow, close to the same time it, could already be

feeling like the century mark for some of you. so it will be a marked difference come tomorrow when it comes to the humidity. eighty-five is the actual air temperature at the airport, very modest wind. see it is turning more southerly. that again a sign of things yet to come. as we look ahead to this eyewitness weather seven day, majority of it into the low or even mid 90s, as everyone every those days, from wednesday through sunday, we've got to allow for couple of scattered maybe locally showers or thunderstorms. stay there, we're coming right
