a south jersey family, heart broken at the loss of a loved one, and now a former south jersey officer is facing charges in her death. those charges coming about a month after the deadly crash. i'm ukee washington. i'm nicole brewer in for jessica dean. cleve bryan is live in florence township where he spoke to that victim's family tonight, cleve. >> reporter: nicole, ariana williams family said they found out about her death when they showed up at the crash scene here. they only live a mile away. they say since that early morning it has been a living nightmare and it continues. >> it has been terrible. >> reporter: ronald williams from florence township says every time his daughter ariana left the house she told him i love you. last time he heard those words was almost a month ago. ariana williams was killed during a car crash early in the morning september 23rd, family says her friend justin rodriguez, a burlington township police officer who

was off-duty at the time was trying her home after they spent the night out with friend. >> she was part of my heart. >> i hear her every day. >> reporter: tatiana williams is her identical twin sister. >> some daisy just don't want to get up. she's gone. i can feel her around me. >> reporter: as williams family mourns, rodriguez was in critical condition following the crash and now faces lengthy jail time. burlington county prosecutor's office is charging rodriguez with vehicular homicide for causing the crash by drinking and driving. they say a blood sample showed he drank an excessive amount of alcohol. williams only comments on rodriguez is it is hard to forgive. >> it is like a nightmare, it is like every day you just hope that she will somehow come back through the door but, you know, it is not happening. >> very hard for me to look at pictures and my friends have

her as her background. so that is hard. but i like talking about it because it makes me happy, that people love her. >> reporter: burlington township police department released a statement earlier today saying they think charges against rodriguez are appropriate. this morning he was book, released on $50,000 bond, and being suspended without pay. live from florence township i'm cleve bryan, cbs-3 "eyewitness news". former pennsylvania congressman chaka fattah scores a small legal victory in his corruption conviction. judge threw out four bank and hail front charges based on post trial oceans. fattah was convicted in june of orchestrating several fraud schemes to raise money for his campaign and personal spending. four aids and advisors were also convicted. no sentencing date has been set on fattah's remaining counts. usually traffic tickets are bad for the driver, who gets them, right? but the tables are being turned on philadelphia police department. alexandria hoff is live in university city with more on the legal battle will that the department is facing, over speeding tickets, alex? >> reporter: nicole, here is a little background. the philadelphia police department transferred their patrols of several make or highways to state police in 2007. until 2012, they pretty much shared that job. but you at that point it became strictly state police jurisdiction. something that a new lawsuit claims that has not stopped city police from ticketing drivers. the law office of tang, haggard and others, specialize in large scale business litigation. >> doing traffic tickets is not something that we typically to. >> reporter: while working on a chance pro bono traffic case, a pandora's box was sort of opened this was not just a discrete event but ongoing practice, widespread practice, been going on for years. >> reporter: according to a new class action lawsuit filed in state court city police have been issuing speeding tickets to drivers on roadways

out of their jurisdiction, namely, i-76, 676 and i-95 without a necessary speed enforcement agreement with the pennsylvania state police. >> our feeling is that if the citizens of philadelphia have to follow the rules so should police. >> reporter: city police can pull off drivers but to issue a speeding ticket they must do so in conjunction with state police. three drivers are named in the suit, for the law firm feels that hundreds more may have been wrongfully issued citations. now anyone who was pulled over on one of these select highways, within this time frame, by the philadelphia police department, will be receiving a letter in the mail from the law firm, informing them of this suit. the philadelphia police department did not comment on pending litigation. overlooking i-76, i'm alexandria hoff for cbs-3 "eyewitness news". >> alex, thank you. crews removed wreckage of the small plane that went down in lindenwald camden county. that single engine plane went down with two people on board in the backyard of east linden

avenue yesterday. cause of the crash is still under investigation, the pilot, wayne gilchrist of marlton and passenger david miss he can of cherry hill remain hospitalized tonight. teenage suspect accused of shooting a man in philadelphia's rittenhouse square on tuesday is still on the run. investigators have issued an arrest warrant for the 17 year-old boy, who police say, the victim was trying to stop the teen from robbing a couple of people in the park. good samaritan was shot five times but is expected to survive. police also say that the suspect, knew the people, he tried to rob. scared in the city, recently released poll find public safety is the biggest issue some philadelphia resident feel the city is now facing. we spoke to today say that doesn't make their concerns about crime any less valid. >> if we can get this crime down it would be nice. >> reporter: wand a moore of hunting park is not alone in her thinking. recently released pew poll found that public safety is a top concern philadelphia resident have. >> during the time in this city, they used to call it killadelphia, there were gangs in the city back in the day and all that kind of got better, but it is still a remnant of it. >> reporter: survey shows a shift from last year, when 32 percent of philadelphians survey named k through 12 education, biggest issue facing city and its mayor and it still is for some like bonnie who has two young children. >> you have to be in competition to get in a good school in philly and other parents, kids and i don't think that is fair. >> i think all kids should be able to have a chance to be in a good safe school. >> reporter: while that is also an important issue many believe right now curbing crime is most pressing. >> a lot of people are being

killed, and really unnecessary. >> reporter: philadelphia police say so far in 2016, there have been 227 homicides, that is up 3 percent from this time last year. but philadelphia police lieutenant john stanford says in most every other violent crime. >> looking at all of our part one, our rapes, our robbery goes, our burglary, ag assault, we're down and i'm talking about going back for the past six or seven or eight years. >> reporter: stanford says emphasis on training and building community relationships are key to keeping that trending. >> our men and women sit on these steps and they go out here and they work hard. >> reporter: interestingly you have this, those crime numbers are down amid staff shortage of 350 philadelphia police officers, they are actively recruiting at this time. live from powellton village, anita oh for cbs-3 "eyewitness news". well, we are in day two of the strike by faculty at 14 colleges and universities across pennsylvania.

100,000 students are once again out of the classroom, including at west chester university. the professors who are members of the association of pennsylvania state college and university faculties walked off the job wednesday morning. they say contract negotiations with the state system of higher education went south over curriculum issues, health care and salary. >> things are progressing. it is an attempt to still keep talking. >> we think that this kind of pressure creates pressure on that group and we hope to be moving for. we hope we are moving for. >> reporter: west chester university is still opened and home coming is still on, some students, want their honey back for missed class time. philadelphia's mayor activist are hosting a pop up weed garden at this hour. in a local park. >> i was just, going day to day, sleeping on the bench. >> reporter: one of the hundreds youth age 18 to 24 in philadelphia, who are homeless. >> we have have a huge problem. last year we served 512 young people, we turned away 546 more. >> reporter: john ducraft works with covenant house pennsylvania, who organized this pop up installation, with hundreds have of life sized cut outs. since many youth are hidden they wanted to illustrate the large number, cut out of the shelter system. >> i was really difficult. >> reporter: she ended up homeless, and fighting against her brother. she got the last bed at covenant house. now she has a job and is heading to college. >> i want to be a physician. that is my biggest dream. >> reporter: many others, are not as fortunate. the city is hoping to help shore. city council recently appropriated an additional $700,000 for youth homelessness and next week,

it came back with the vengeance, streak of the 80's, all that getting out of here. hotter nature is like bye-bye. >> yes, back to reality. >> i'm mother and i'm bringing back cold weather. put away shorts and break out jackets. beautiful looking scene right now live look from the cape may county courthouse. sunset scene there we're just coming up on sunset, right now, orange and pinks in the scene. mild temperature in the upper 60's and getting a look at center city philadelphia. yeah, building is lit up now, the sunnies setting, 73 degrees. very mild, southeasterly wind at 13 miles an hour. little breeze. southerly component to the wind flow driving warmth and moisture. dew points in the 60's indicating we have a sticky factor and that will stay here throughout the night tonight and through much of the day tomorrow w that surface moisture what to expect tomorrow areas of fog and drizzle that will could reduce our visibility, definitely want to have that umbrella in hand. scattered showers, developing mainly into late day and in the evening hours. that will be the best time frame to see some shower

activity. a few um bedded thunderstorms as well and wind pick up as we head in the second half of tomorrow evening. so, for temperatures, right now, all of the warmth. 74 degrees in reading. we are at 73 in millville. seventy-four in wilmington. but, it is showing us what is in store as we head this is up come weekend. back side of the very potent cold front temperatures much cooler. 58 degrees. right now in st. louis. that cold front will drive-in across the delaware valley, as we head through the daze tomorrow, usual inner that colder air, and windy conditions, as well, so as we head into saturday, high temperatures, in the upper 50's and this will be the first time in philadelphia that we have had highs only in the 50's, so far this season. and it has been a bit of rain as well. cold front generate something showers and thunderstorms across parts of the western and central pennsylvania, pretty nasty looking storms, severe thunderstorm watch in effect for parts of the state west of us but closer to home, nice and quiet. just a few clouds rolling through and as we head in the overnight period, the main

concern is going to be areas of fog settling in and some drizzle, 64 degrees, still very mild tonight. still on the warmer side tomorrow, up to 74 degrees. that is 10 degrees above our average. we could see period of sunshine as we head in the afternoon after the fog clears and then scattered showers will take news to tomorrow evening and down the shore, and in the poconos, those showers in the forecast with rumbles of thunder especially late in the day, high temperature in the poconos running above average at 60 degrees. we will top at 70 down the shore and then for upcoming weekend here comes the saturday high, only in the upper 60's. we will have rough, conditions, especially along the coast on saturday, where we could see wind gusts to 40 miles per hour, not way to kick off weekend. definitely a indoor movie day. sunday not too bad for birds. 62 degrees. sunshine, breezy conditions, check out these overnight lows. well down in the 40's and then by tuesday morning in the city we are teetering on 30's.
